UK to khud doobti naiya hain. UK me pakistanis don't behave like pakistanis. Waise bhi sab pakistan ek baar pakistan se bahar chale jate hai then they don't want to do anything which jeopardizes their position abroad. USA is the world's only superpower as on date. Waha par Indians ki position jo aaj hai woh koi dankhi chupi nahi hai. And there are reasons for it. Yeh H1b kya hai? That is a transient population. I am not talking about that category of people. There is a class of Indians in the US who are a cut above the rest. They are the ones who are going to have outreach with India. And our goal is not H1B. That is something which works in the short term but its not in our long term plan. In the long term Indians will work for India.

Nahi milay ga na !...Kiyoonkay, Pakistani companies dont hire Pakistanis for cheap and start shipping them to the US to take over american jobs that will threaten the job market in the US.

Thats why its way easier to get a green card in US as a Pakistani than an Indian on H-1B :biggthumpup:

This brain gain is only Indian companies gaining cheap labor and not anykind of real brain gain.

Bales said the Justice Department had anecdotal evidence that problems with I-9 forms - used to verify employment eligibility - and visa forms were common in the tech services industry. While he would not confirm that there are other open cases, he said others should pay attention to the Infosys settlement.
"They do acknowledge that there are problems with their I-9 process, and that however it happened - unintentional or not - their visa practice had some irregularities," Bales told Reuters in a phone interview. "They have pledged to be more accurate."
"We've learned a lot in the case, and we're going to use that knowledge," he said.

(Reuters) - Tech services giant Infosys Ltd (INFY.NS) agreed on Wednesday to pay $34 million to end a U.S. investigation related to the widespread practice by Indian firms of flying workers to client sites in the United States on temporary visas.
The settlement, which the U.S. Justice Department said was the largest in a case of alleged civil fraud over visas, was filed in U.S. District Court for the Eastern District of Texas.
Infosys, India's second-largest IT services exporter, agreed in the settlement that it committed civil violations of U.S. employment law, but it was not required to admit and did not admit widespread further wrongdoing.
"Infosys denies and disputes any claims of systemic visa fraud, misuse of visas for competitive advantage or immigration abuse. Those claims are untrue and are assertions that remain unproven," Infosys said in a statement.
The company emphasized that the allegations were not criminal, and that there would be no limitations on its eligibility for U.S. federal contracts or access to U.S. visa programs as a result of the settlement.
The Justice Department had alleged in court papers that Infosys knowingly and unlawfully sent people to work without proper visas, that there were widespread failures in the company's record-keeping and that the company tried to deceive U.S. consular officials with false "invitation letters", which tell the government the purpose of travel.
One invitation letter from May 2010 for someone identified in court papers as "AR" said the person "would be involved in meetings and business discussions," but the real purpose of the trip was for computer coding and programming, the Justice Department said.
One reason the Justice Department decided to settle its allegations rather than try to prove them at trial was that Infosys took steps to fix irregularities and agree to outside monitoring, said U.S. Attorney John Bales of the Eastern District of Texas.

U.S. lawmakers are considering legislation that would make it more difficult and costly for Indian IT firms to send workers to the United States on temporary, restricted visas.
Infosys employs roughly 15,000 people in the United States. As of March 31, about 10,800 of those were on H-1B visas, which allow an employee to stay and work in the United States up to six years, and 1,600 were on temporary L-1 visas, a company filing said.
The U.S. investigation focused on the use of B-1 business visas and I-9 forms, Infosys has said. A person on a B-1 visa in the United States can participate in meetings but is not allowed to work.
"It is likely to add more fuel to the ongoing debate around visa reforms," Chirajeet Sengupta, practice director in Gurgaon, near New Delhi, at Everest Group, which advises clients on technology vendors, said on Tuesday after reports that a settlement was imminent.
"These reforms, if executed, have the potential to impact Indian service providers' landed resource model that is largely driven by access to H-1B visas in large numbers," he said.
In its statement, Infosys said only .02 percent of the days that Infosys staff worked on U.S. projects last year were performed by people on B-1 visas.
"The Company's use of B-1 visas was for legitimate business purposes and not in any way intended to circumvent the requirements of the H-1B program," the Bangalore-based company said.
Infosys has secured roughly one B-1 visa for every 10 H-1B visas, according to a person with direct knowledge of the matter who declined to be identified.
U.S. authorities had been looking into Infosys' use of visas since 2011. This month, Infosys set aside a reserve of $35 million, including legal fees, as it worked towards a resolution of the U.S. investigation.
The case is "an important event in the annals of Indian IT industry," Sundararaman Viswanathan, a consultant in Bangalore with Zinnov, which advises U.S. corporations on sending outsourcing work to India, said ahead of the settlement.
"This is a common issue amongst all the Indian service providers - just that Infosys had to deal with it," he said.
"Though the Indian service providers do not intend to flout the visa regulations, there was definitely a lack of regard for certain norms and procedures. This will be fixed. There will be an increase in onsite hiring," he said.

Last week, Infosys held a lengthy press conference in India to discuss its financial results for its third quarter, which ended on Dec. 31. And once again, the Indian press demonstrated its meekness by failing to compel Infosys executives to address the dark cloud hanging over the company as it awaits the outcome of the U.S. government’s visa and tax fraud investigation.
Infosys posted the archived video of the press conference on its website, and I forced myself to sit through all 57 minutes and 15 seconds of it. It was absolutely excruciating. The entire Infosys senior management team was present, and the assembled press had a golden opportunity to ask the tough questions that were screaming to be asked. Instead, they chose to lob softball, adulatory questions in an embarrassing display of sycophancy that does nothing but feed the arrogance Infosys has displayed since Oct. 11, 2010, the day Infosys employee Jay Palmer blew the whistle on the company.
It was almost as if the Infosys executives came up with the questions they wanted to be asked, and the reporters eagerly jumped at the chance to ask them. Just to give you an idea of what it was like, here are some of the actual questions that were asked:

  • “The mood of management is quite upbeat today. Basically, under-promising and overachieving is what Infosys has been doing so far. … Despite [the global economic environment] Infosys has done relatively better this quarter. What are the factors that are working in favor of you, especially in Europe? We see you have done quite nicely—you seem to be riding against the storm in Europe.”
  • “I’m just curious to know, you won 14 deals in the products and platforms space—can you tell me what’s the contract value for those 14 deals?”
  • “Why do you think the stock price is going up despite your 3.6 percent [revenue growth]?”
  • “This year, how does Infosys plan to add greater value to your customers in terms of new, disruptive technologies?”
Almost incomprehensibly, the reporters made absolutely no attempt to get the Infosys executives to address the U.S. government’s investigation. Nothing whatsoever was mentioned about the alleged violations or what Infosys is doing to correct the situation that prompted this intensive, multi-agency investigation. Nothing. It was pathetic.
Here are some of the questions that needed to be asked, and would have been if only the reporters could have summoned the courage and professionalism to ask them:

  • Jay Palmer, the Infosys employee whose whistleblower report sparked the U.S. government’s investigation of alleged immigration and tax fraud at Infosys, has been languishing on the bench for nearly two years. Why is that the case?
  • Does Infosys have any intention of assigning Palmer to a project?
  • You acknowledged in your IFRS Earnings Release for the quarter ending Dec. 31, 2012, that Infosys “has been advised that the DHS has found errors in a significant percentage of its Forms I-9 that the DHS has reviewed, and the [U.S.] government may seek to impose fines and penalties on the company in connection with such alleged errors.” To what do you attribute these errors, and what specifically is Infosys doing to correct the situation?
  • You noted in the Earnings Release that in connection with the grand jury subpoena for certain documents and records related to your sponsorships for, and uses of, B1 business visas, you’ve been advised by the U.S. Attorney’s Office that Infosys “and certain of its employees are targets of the investigation.” Can you identify which employees are being investigated?
  • You stated in your Earnings Release, “In the event that any government undertakes any actions which limit any visa program that the company utilizes, or imposes sanctions, fines or penalties on the company or its employees, this could materially and adversely affect the company’s business and results of operations.” What do you see as the best- and worst-case scenarios stemming from the U.S. government’s investigation and your ongoing discussions with the U.S. Attorney’s Office?
  • In light of the U.S. government’s investigation, what specific steps have you taken to ensure that Infosys is fully compliant with all U.S. immigration and tax laws?
  • Given the nature of the alleged abuses, is Infosys at all concerned that the SEC will conduct an investigation of the company, independent of the investigation jointly conducted by DHS, the Department of State, and the U.S. Attorney’s Office?
  • In hindsight, what should Infosys have done differently that might have avoided the U.S. government’s investigation of the company and certain of its employees?
So allow me to address the press in India directly. I know that many of you read my blog, and I’m certain that some of you who were at that press conference will read this post. Let me ask you, and invite your responses: Why didn’t you ask any of those questions? Why did you let Infosys off the hook?

Bro they(Indians) all are united. they spend years calmly to reach the keys positions in companies. Specially they made their way to HR department. They have strong back support from indian based industry as well. There is no leg pulling in their side.

A highly decent Indian dominated American Based company Fired three Pakistani in three years due to their fake degrees and corruption charges.(True Charges,I was eye witness) and now they specifically Ban Pakistani to be hired on Manager position.

My Request to all brother in Gulf. please be united, don't be fake. Help each other. Focus on your work rather than other's work.

The issue is that they think that the Gulf is their natural territory and they must be given jobs there. And Indian HR is ruling the roost in this region. If you see the overseas appointments pages in the indian papers then its very clear Indians are in demand there.

I don't see anything wrong in it.I am in USA and I outsource all my IT work to India.Being an Indian Origin individual, I prefer Indians over anyone. So what is the issue.? I don;t get it.

Obviously you can always turn around and exploit a loophole in your system to pin the blame on anyone. After all you make money right. Natural territory hi hai ...Its land of the muslims so naturally its ours ...and Indians are mostly only prevalent in dubai, bahrain and qatar ..in Saudi, Yemen, oman and kuwait its more Pakistanis & Bengalis that dominate ...because of better arabic language and cultural affinity ...:biggthumpup:

Jab chori sabit hee nahi hui to chor kaisa. Kuch to tha jo prove na ho saka. Warna americans to ekdum ready rehte hai for sending people to jail. Tantrik ke pass uneducated log jate hain. One way to give this issue attention is to contact Pakistan tv stations.
And hope and pray some of them will pay attention about this issue.
Fax them, email them, phone them, twitter them, Facebook them.............only then they will pay attention.
