A judge ruled that Abercrombie & Fitch violated federal law when the company fired a Muslim worker at one of its Hollister stores for refusing to take off her hijab.

Judge Yavonne Gonzalez Rogers ruled in favor of Hani Khans request for a summary judgment against Abercrombie, which owns Hollister, last week, according to court papers. The Equal Employment Opportunity Commission sued Abercrombie on behalf of Khan in 2011, after she claimed the company fired her in 2010 for her decision to wear the religiously-mandated headscarf.

Reasonable jurors could determine that by offering Khan one option to remove her hijab despite her religious beliefs Abercrombie acted with malice, reckless indifference or in the face of a perceived risk that its actions violated federal law, the judgment reads.

A trial will begin at the end of September to determine what Abercrombie owes Khan as a result of its illegal actions.

An Abercrombie spokesman wrote in an e-mail statement that it's company policy not to comment on pending litigation.

"Abercrombie & Fitch does not discriminate based on religion and we grant religious accommodations when reasonable," the statement reads.

The judge also denied Abercrombies claim that allowing Khan to wear her hijab on the job would present undue hardship to the companys brand and sales. Khan had been wearing her hijab for four months at work before a district manager visited the store and decided it was against the companys controversial Look Policy, which some say goes too far in micromanaging an employees dress.

Abercrombie must provide more than generalized subjective beliefs or assumptions that deviations from the Look Policy negatively affect the sales or the brand, the judgment reads. The evidence presented does not raise a triable issue that a hardship, much less an undue hardship, would have resulted from allowing Khan to wear her hijab.

Khans complaint is one of many accusing the retailer of discriminating against certain types of employees and customers. Abercrombie found itself in hot water earlier this year after a years-old quote from CEO Mike Jeffries resurfaced, boasting about the companys exclusionary look. In addition, Frances human rights watchdog is investigating Abercrombie over claims the company discriminates in hiring based on appearance.

This is called justice .... She can get justice in a non-muslim country.

Unfortunately, in a muslim country like Pakistan... It's easy to kill any one just by putting allegation of "gustakh-e-rasool".

Wah re musalman tere double standards !

This is a typical childish behavior on the lines of fakira alam:)

The company was merely following the provincial order of france govt.

But france legal system & humane rights laws did justice to the lady!!

Well the problem lies with ghettofication & disintegration of muslim community in west; West want these people to integrate.

State has no business in enforcing the dress code. Less than a century ago Europe tried the same thing with Jews which resulted in the Holocaust. We will not allow the same discrimination, in the name of integration, extended to Muslim. We are very well integrated. Thank you very much.

This did not happen in a backward country like france. This happened in California, USA.

So this is the United states Justice system.

Muslim communities in the US are very well off. Even those who have to work hard, can make a middle upperclass living.

Those who do not have immigration status, are the ones who struggle. But since 2001 most of those have either moved to canada and became Canadians, or have went back and some have been deported back. So there are very few lower income families.

Integrate into the west doesn't mean you give up your religion or identity. I know many women in my family, friends and community that wear Hijab and get along well with everyone in their Jobs , colleges, neighborhoods.

present islam is only confined to have beard, hijab, keep fasting, halal foods, hajj, namaz as social act......that's all.........namaz, hajj, roza sub baaqi......tu baqqi nahin hai....

Great to see her stand up for her rights. We must also show the very same respect to non-Muslims living in Muslim countries, especially the Christians.

Discrimination is everywhere, but it is good that they have a better justice system. But i think the case also took too long to complete as it took almost 2 years for a simple case which was clearly violations of law.
