Lahore shooting: Families turn down settlement offers

LAHORE: Families of the three men, killed on January 27, said they had turned down the latest offers for settlement. They appeared, however, on Sunday to be leaving the door open in the Raymond Davis affair.

Zahra Faizan, the widow of Faizan Haider, told The Express Tribune that she had been contacted by a man who introduced himself as an interpreter for the US consulate. She said the man had urged her to consider a diyat settlement permitted in Islam. She said she had turned down the offer. She said she would wait for the court verdict in the case.
She said her mother-in-law had visited her after finding out that the US consulate had tried to contact her.
This, she said, was the first visit from her in-laws since she moved out following Faizans death.
She said the police had kept her national identity card, which they had found in Faizans pocket. Only recently, she said, they had returned a couple of colour photocopies when MPA Pir Ashraf Rasool intervened on her behalf.
She said PML-Qs Dr Khalid Ranjha had assured her he would be available for assistance with legal matters.
Dr Khalid Ranjha told The Tribune that though Zahra was not the complainant in the case against Davis, she was a legal heir and could not be deprived of diyat if a settlement was reached. He said he had decided to help Zahra without charging any fee.
Imran Haider, Faizans brother, said some US consulate officials had wanted to meet him but he had refused to see them. He said he had told them that he was not interested in withdrawing the case.
Imran Haider had earlier opened a bank account and made public appeals for donations to help pursue the case against Davis. He had reportedly not taken Zahra into confidence in this regard and had told her to shun media.
Waseem Shamshad, Faheems brother, refused to discuss the matter, saying that he would make a decision once a serious offer was made.
Meanwhile, chehlum prayers were held for Faizan Haider, Muhammad Faheem and Ibaudr Rehman at their residences on Sunday. A large number of people attended the chehlums, but no politician or government official was present.
Earlier, two US lawyers had arrived in at Lahore on March 5 (Saturday) to assist with Daviss case. They were reported to have contacted the families through their interpreters to persuade them to agree to a settlement.

Diplomatic immunity for criminal offences

Raymond Davis, a United States national, killed two Pakistanis in Lahore on January 27, 2011, allegedly in self-defence. According to the BBC: An American official in the Pakistani city of Lahore has shot and killed a Pakistani motorcycle rider and his pillion passenger, police say. They say that the consular employee fired his pistol in self-defence. US embassy officials confirmed that an American was involved. The men were pursuing the American in his car when the incident happened. A pedestrian was also killed by a speeding car from the US consulate which came to help, police say. Davis has been charged with murder by the Pakistani police and has been incarcerated in a local jail. He is presently facing trial in a criminal court in Pakistan. The incident has sparked anti-American sentiments in Pakistan and become an issue of public interest that is constantly being discussed and debated in political circles and in the media.
The resolution of the issue has been compounded by recent media reports that Raymond Davis is a CIA agent who was on assignment at the time of the double murder. However, this would not matter if he has diplomatic status, since spying by a diplomatic agent is one of the criminal offences covered by diplomatic immunity. According to established practice, the diplomat may, when apprehended, be transferred by the sending state, or if not, he is likely to be declared persona non grata by the receiving state.
The Raymond Davis case has the potential of becoming a major foreign policy issue that can mar the budding relationship between Pakistan and the US. The US has actively sought the release of Raymond Davis on the pretext that he has diplomatic immunity. While keeping tight-lipped about its position on the question of immunity, Pakistan appears to be exploring an alternative dispute settlement mechanism to resolve this diplomatically sensitive and politically explosive matter. For example, Prime Minister Gilani has suggested that the whole thing could be resolved under Shariah law if compensation is offered to the families of the victims killed in the shooting by Davis.
However, there is no guarantee that the compensatory scheme to resolve this matter privately will produce the intended result, given the public interest that has been generated in this matter. Any such outcome would not be accepted by the Pakistani public unless a host of issues both factual and legal about Raymond Davis official status and immunity are determined properly and made known publicly.
The legal principles regarding diplomatic and consular immunities and privileges are legally well established. Under the Vienna Convention on Consular Relations 1963, consular officers are not accorded absolute immunity from a host countrys criminal jurisdiction and are immune from local jurisdiction only in cases directly relating to consular functions. They may be tried for certain local crimes upon action by a local court.
The Vienna Convention on Diplomatic Relations 1961 provides the terms under which a diplomat may be subject to criminal penalty. Article 31 of the Convention exempts diplomatic agents from the criminal jurisdictions of host states. This article clearly states that while diplomatic immunity privileges may exist in a host state, these privileges do not exempt the diplomatic agent from the jurisdiction of local laws and courts. These privileges are not absolute either. For example, Article 32 provides that the sending state may waive all diplomatic immunity privileges enjoyed by the diplomatic agent.
While giving effect to the applicable treaties on diplomatic and consular immunities, the Pakistani law in respect thereof the Diplomatic and Consular Privileges Act, 1972 clearly lays down the principle of reciprocal treatment of diplomatic and consular officers and employees in Pakistan. Pakistan would consequently be well within its rights to rely on US policy and legal practice and procedure regarding the treatment of Pakistani diplomats and consular officers and employees in the US in case of criminal offences committed by them. The US has elaborate policies and procedures in place regarding the grant of diplomatic or consular immunity for criminal offences. These policies and procedures establish a formal legal and judicial process that can be emulated and applied by Pakistan on the basis of the principle of reciprocity laid down in its domestic law.
If nothing else, Pakistan can at least prevail on the US on the basis of its established legal practice and procedure to show the requisite patience and respect for Pakistans legal and judicial process in determining Raymond Davis diplomatic or consular status and granting immunity accordingly. Contrary to the assertion made by the US that this is not a matter that should be resolved by courts in Pakistan, the courts in Pakistan, like the courts in the US, have a constitutional mandate to interpret and apply the law. The filing of the Raymond Davis case in court by the Pakistani authorities is, therefore, not only valid but also in line with the policy of the US government in dealing with diplomatic immunity cases involving criminal offences.
Even though the law is quite clear on the subject of diplomatic and consular immunity, the publically known facts regarding Raymond Davis alleged diplomatic status remain ambiguous. Mere assertion by the US government without verification by the Pakistani government would not be enough for the Pakistani courts to accept the plea of diplomatic immunity, particularly in view of the initial conduct of the US spokesperson regarding Raymond Davis identity and status.
Left on its own in the absence of a diplomatic certificate issued by the foreign ministry the court may be inclined to look sceptically at the contention of US authorities that Raymond Davis has diplomatic status mindful of the ambiguity raised about his identity and status by the initial statement of a US State Department spokesman in his daily press briefing in Washington, DC on the day of the incident. The spokesmans continued evasiveness about answering questions regarding the nature of Raymond Davis job at the US embassy, and failure to clarify whether he was a contractor or consular employee, would give the court further cause to undertake the factual determination of his status before accepting the US governments plea regarding diplomatic immunity.
The offer by the US to investigate this matter in line with its own practice should be welcomed by the Pakistan government. Even if the US recognises the diplomatic status of Raymond Davis and submits a certificate to this effect in court and the court grants him diplomatic immunity, Raymond Davis would still not be absolved of the offence of double murder. The proper course for Pakistan would be to approach the US embassy in Islamabad as well as the US State Department and ask them to waive this privilege in view of the gravity of the alleged offence committed by him.

Court may indict Raymond Davis for murder

LAHORE: The Lahore High Court is likely to indict Raymond Davis next week for murdering two men, lawyers said on Tuesday, despite US insistence he has diplomatic immunity, acted in self-defence and should be released.
The arrest of American contractor Davis, 36, who shot dead two Pakistanis in the eastern city of Lahore on January 27 in what he said in was an act of self-defence, has put strains on relations between the United States and Pakistan.
The lawyers of the victims pleaded that David be charged, but we contested it could not happen until we get complete documents on the case, Davis lawyer, Zahid Hussain Bokhari,told Reuters.
He is probably going to be charged with murder at the next hearing, which is on March 16.
Before the next murder hearing, Davis has a hearing at the Lahore High Court on March 14 which could determine if he has diplomatic immunity and should be released.
Asad Manzoor Butt, lawyer for the family of one of the victims, said Davis declined to sign police documents but that later Bokhari signed them on his behalf.
US Officials said progress was being made to persuade Pakistan to free Davis but that Washington could take punitive diplomatic and financial action if the case was not resolved soon.
Pakistani government officials say it is for the countrys courts to decide the fate of the CIA contractor.
The hearing is taking place behind closed doors in Kot Lakhpat jail in Lahore for security reasons. The proceedings are closed to journalists.

All eyes on Saudi role in resolving Davis row

ISLAMABAD: Will Saudi Arabia once again come to the rescue of two of its staunchest allies, the United States and Pakistan, with a face saving formula for all parties that cannot be challenged, as it is based on Islamic injunctions? By delivering, Jeddah will be doing what it has done several times in the past - bailing the US and Pakistan out of difficult situations.

The question pertains to Raymond Davis, President Obama’s “our diplomat” the likes of which Pakistan hopes to deny ‘diplomatic passports’ in future. Taking advantage of his visit to Jeddah on March 3, the special US representative for Pakistan and Afghanistan Marc Grossman raised the issue of Raymond Davis during his presentation at the International Contact Group (ICG) meeting, which was also attended by Minister of State Ms Hina Rabbani Khar. The meeting was essentially to focus on Afghanistan.

Later, diplomatic sources confide Grossman raised the issue of Qisas and Diyat with the Saudi authorities on the sidelines of the ICG meeting. Spokesman at the US embassy not totally denying this says, “We are working with Pakistan to find a solution and resolve this matter but I could not tell you about (Grossman-Saudi meeting on Davis) and it would be inappropriate for me to comment”. Before this, at the end of February, President Asif Ali Zardari had met with Saudi Prince Naif on the sidelines of the Kuwati celebrations and the Davis issue came up for discussion, confide diplomatic sources.

Prime Minister Yusuf Reza Gilani has also said that the “Saudi” option remains open. Diplomatic sources from Washington told The News, “Initially Washington was in touch with the UAE authorities to prevail upon Zardari as they enjoy close relations. Apparently this did not work so the next stop was Riyadh”.

The diplomat stresses that the Saudi monarchy can prevail upon the Pakistani military, the clergy and the government and the only way out at present is the Qisas and Diyat approach. The courts would also abide by the Islamic injunctions.

“The military is miffed with the CIA for taking them for a ride but they also realise the gravity of the situation if the standoff between Islamabad and Washington continues. It is the clergy which has the street power, but once the Saudi clergy prevails upon the mullahs here, a lot of give and take can take place”, says the diplomat.

Even this week, according to The Independent, an example of the US relying on the Saudis in a completely different matter was seen when the US asked Saudi Arabia if it could supply weapons to the rebels in the Benghazi area of Libya. “The royal family in Jeddah, which was deeply involved in the Contra scandal during the Regan administration, had earlier gave supported the American efforts to arm guerrillas fighting the Soviet army in Afghanistan in 1980 and also funded and armed the Taliban”, says the report.

Intelligence sources confide to The News that the legal heirs of two men killed by Davis would find it difficult to refuse requests either by the Saudi officials or Saudi clergy and could be convinced.

“But this also involves shifting these heirs outside Pakistan and providing them with a comfort zone including means of a livelihood. The blood money resolution would also ensure that abiding by the Islamic tradition there would be less public and politic pressure on the government”, says the official.

Davis case: Victim's widow not satisfied with govt efforts

LAHORE: Zahra Faizan, the widow of one of the victims of the Lahore shooting case, stated that the Punjab government is not working sincerely in the Raymond Davis case. However, she expressed satisfaction over judiciarys role in the case.
Pakistan Muslim League-Quaid (PML-Q) Chief Chaudhry Shujaat Hussain and Former Punjab Chief Minister Pervaiz Elahi also held a meeting with Zahra in Lahore.
Talking to media after the meeting, she said that she was not satisfied with the case as yet.
She demanded that the Punjab government should bring the culprits to justice and also thanked the PML-Q leaders for their support.
Meanwhile, Chaudhry Shujaat announced to bear the expenses of Zahras family for life.

Mar 16 set for framing charges against Davis

LAHORE: Additional district & sessions (AD&S) Judge adjourned the hearing of double murder trial against Raymond Davis till March 16 on Tuesday, while the accused remained adamant not to sign a copy of the charge-sheet, insisting he has diplomatic immunity and the court could not try him.

AD&S Judge Yousif Aujla held the proceedings in Kot Lakhpat jail amid tight security as heavy contingents of law enforcement agencies cordoned off the jail premises.
The judge adjourned the court for framing charges against Davis, after handing over the complete case record to the counsels of the accused.
The court wanted to frame charges against Davis at the last hearing, but was informed by the accuseds counsel Zahid Hussain Bukhari that it could not do so until complete copies of the case record had been provided. The judge had then directed prosecutors to provide complete copies of the case to the accused.
On Tuesdays hearing, Davis refused to receive any documents or sign the charge-sheet. His attorneys said they had received it on his behalf and asked the court could include it in its orders. Sources said they sought further time to prepare for the trial.
The US consul general in Lahore Carmela Conroy was permitted for the first time by the trial court to attend the proceedings. Two Americans, who had recently arrived in Lahore to assist Davis local counsels, were also present during the course of proceedings.

Munter reiterates demand for Davis's release

ISLAMABAD: United States (US) Ambassador to Pakistan Cameron Munter on Thursday reiterated the demand for the release of American gunman Raymond Davis.
During a meeting with Foreign Secretary Salman Bashir in Islamabad, Munter said that Davis enjoyed diplomatic immunity in criminal cases hence his detention is illegal.
Bashir said the government is facing immense public pressure over the issue adding that the matter was sub-judice and it would be dealt according to national and international laws.
According to sources, the US envoy maintained that Davis could not be tried in Pakistan however he was hesitant in assuring that the shooter would be tried in a US court.

ISLAMABAD: United States (US) Ambassador to Pakistan Cameron Munter on Thursday reiterated the demand for the release of American gunman Raymond Davis.
During a meeting with Foreign Secretary Salman Bashir in Islamabad, Munter said that Davis enjoyed diplomatic immunity in criminal cases hence his detention is illegal.
Bashir said the government is facing immense public pressure over the issue adding that the matter was sub-judice and it would be dealt according to national and international laws.
According to sources, the US envoy maintained that Davis could not be tried in Pakistan however he was hesitant in assuring that the shooter would be tried in a US court.

All eyes on Saudi role in resolving Davis row

ISLAMABAD: Will Saudi Arabia once again come to the rescue of two of its staunchest allies, the United States and Pakistan, with a face saving formula for all parties that cannot be challenged, as it is based on Islamic injunctions? By delivering, Jeddah will be doing what it has done several times in the past - bailing the US and Pakistan out of difficult situations.

The question pertains to Raymond Davis, President Obamas our diplomat the likes of which Pakistan hopes to deny diplomatic passports in future. Taking advantage of his visit to Jeddah on March 3, the special US representative for Pakistan and Afghanistan Marc Grossman raised the issue of Raymond Davis during his presentation at the International Contact Group (ICG) meeting, which was also attended by Minister of State Ms Hina Rabbani Khar. The meeting was essentially to focus on Afghanistan.

Later, diplomatic sources confide Grossman raised the issue of Qisas and Diyat with the Saudi authorities on the sidelines of the ICG meeting. Spokesman at the US embassy not totally denying this says, We are working with Pakistan to find a solution and resolve this matter but I could not tell you about (Grossman-Saudi meeting on Davis) and it would be inappropriate for me to comment. Before this, at the end of February, President Asif Ali Zardari had met with Saudi Prince Naif on the sidelines of the Kuwati celebrations and the Davis issue came up for discussion, confide diplomatic sources.

Prime Minister Yusuf Reza Gilani has also said that the Saudi option remains open. Diplomatic sources from Washington told The News, Initially Washington was in touch with the UAE authorities to prevail upon Zardari as they enjoy close relations. Apparently this did not work so the next stop was Riyadh.

The diplomat stresses that the Saudi monarchy can prevail upon the Pakistani military, the clergy and the government and the only way out at present is the Qisas and Diyat approach. The courts would also abide by the Islamic injunctions.

The military is miffed with the CIA for taking them for a ride but they also realise the gravity of the situation if the standoff between Islamabad and Washington continues. It is the clergy which has the street power, but once the Saudi clergy prevails upon the mullahs here, a lot of give and take can take place, says the diplomat.

Even this week, according to The Independent, an example of the US relying on the Saudis in a completely different matter was seen when the US asked Saudi Arabia if it could supply weapons to the rebels in the Benghazi area of Libya. The royal family in Jeddah, which was deeply involved in the Contra scandal during the Regan administration, had earlier gave supported the American efforts to arm guerrillas fighting the Soviet army in Afghanistan in 1980 and also funded and armed the Taliban, says the report.

Intelligence sources confide to The News that the legal heirs of two men killed by Davis would find it difficult to refuse requests either by the Saudi officials or Saudi clergy and could be convinced.

But this also involves shifting these heirs outside Pakistan and providing them with a comfort zone including means of a livelihood. The blood money resolution would also ensure that abiding by the Islamic tradition there would be less public and politic pressure on the government, says the official.
