ان دونوں کيسيز ميں کوئ مماثلت يا قدر مشترک نہيں ہے۔ سب سے پہلی بات تو يہ ہے کہ امريکی حکومت نے افغانستان ميں کبھی بھی طالبان کی حکومت کو تسليم نہيں کيا تھا۔ اس کے علاوہ اقوام متحدہ کی حمايت سے افغانستان ميں ہونے والی فوجی کاروائ کے بعد افغانستان ميں طالبان کی فعال حکومت کا کوئ وجود نہيں تھا۔


يہ بات نہيں بھولنی چاہيے کہ جس حکومت کی جانب سے کسی سفارت کار کی سفارتی حيثيت کا تعين يا منظوری دی جاتی ہے جب اس حکومت کا اپنا وجود ہی نہ رہے تو اس سفارتی حيثيت کی بھی کوئ اہميت باقی نہيں رہ جاتی۔


ايک جنگی صورت حال يا فوجی غلبے کی صورت ميں جينيوا کنونشن کے سفارتی استثنی سے متعلق قوانين ايک ايسا قانونی معاملہ ہوتا ہے جس پر عمل درآمد ايک سواليہ نشان بن جاتا ہے۔ جب سال 1990 ميں عراق نے کويت پر قبضہ کيا تھا تو کويت ميں موجود غیر ملکی سفارت خانوں اور قونصل خانوں کو بند کرنے کے ليے اقدامات کيے گۓ تھے۔


جہاں تک ملا ضعيف کا تعلق ہے تو پاکستان ميں ان کی گرفتاری کے وقت انھيں سفارتی استثنی حاصل نہيں تھی کيونکہ افغانستان ميں طالبان کی وہ حکومت ہی موجود نہيں تھی جو انھيں يہ سہولت فراہم کر سکتی۔ يقينی طور پر پاکستان ميں گرفتار امريکی سفارت کار کے کيس ميں صورت حال يہ نہيں ہے۔


اس کے علاوہ يہ بات بھی غور طلب ہے کہ امريکی سفارت کار کے برعکس جو کہ اپنی جان بچانے کے حوالے سے ايک واقعے ميں ملوث ہوۓ، ملا ضعيف ايک ايسی حکومت کے اعلی عہديداروں کے ساتھ گہرے مراسم رکھتے تھے جو عالمی دہشت گردوں اور مجرموں کو پناہ دينے اور ان کی حمايت کرنے کے جرم ميں شامل تھے۔ يہ ايک ايسی حقيقت ہے جسے اقوام متحدہ نے نہ صرف يہ کہ تسليم کيا بلکہ سرکاری طور پو طالبان کی حکومت کو سيکورٹی کونسل کی کئ قراردادوں کے ذريعے باور بھی کروايا۔


"کومبيٹنٹ اسٹيٹس ريوو" ٹريبيونل کے سامنے الزامات کے حوالے سے جو دستاويز پيش کی گئ تھی اس کے مطابق


گرفتار ہونے والا طالبان کا رکن تھا۔


گرفتار ہونے والے شخص نے يہ خود تسليم کيا تھا کہ اس نے سال 1996 ميں طالبان میں شموليت اختيار کی تھی۔


طالبان کے لیڈر کی جانب سے گرفتار ہونے والے شخص کو اقغانستان کے سنٹرل بنک کا صدر مقرر کيا گيا تھا۔


اس کے علاوہ طالبان کے ليڈر کی جانب سے گرفتار ہونے والے شخص کو افغانستان کی معدنيات اور انڈسٹری سے متعلق وزارت ميں ڈپٹی وزير کے عہدے پر فائز کيا گيا تھا۔


اس کے علاوہ گرفتار ہونے والے شخص کو طالبان حکومت نے کابل ميں ٹرانسپورٹ کی وزارت پر فائز کيا جہاں پر 3 ماہ کام کيا۔


گرفتار ہونے والے شخص کا آخری عہدہ پاکستان ميں طالبان حکومت کے سفير کی حيثيت سے تھا جہاں پر 18 ماہ تک دسمبر 2001 ميں اپنی گرفتاری تک کام کيا۔


طالبان کی تحريک کے ابتدائ دنوں میں طالبان اور القا‏ئدہ کے فعال کمانڈرز افغانستان کے شہر کابل اور گرد ونواح کے علاقوں سے گرفتار ہونے والے شخص کو طالبان کے "ڈپٹی ڈيفنس" کی حيثيت ميں رپورٹ کيا کرتے تھے۔


پاکستان ميں طالبان کے سفير کی حيثيت سے ان کے طالبان کی سينير ليڈرشپ کے ساتھ قريبی تعلقات تھے۔

يہ بات توجہ طلب ہے کہ سفارتی استثنی کے حوالے سے قوانين اور ضوابط کی تشکيل امريکہ کی جانب سے نہيں کی گئ تھی۔ اس کے علاوہ صرف امريکی سفارت کار ہی دنيا بھر ميں سفارتی تحفظ کے تحت خدمات انجام نہيں ديتے ہیں۔ اسی طرز کی سہوليات امريکہ ميں بھی پاکستانی سفارت کاروں سميت تمام غيرملکی سفارت کاروں کو حاصل ہوتی ہیں۔


سفارتی استثنی کو ايک ادارے کی طرح پروان چڑھانے کا مقصد يہ رہا ہے کہ اس کی بدولت حکومتوں کے مابين تعلقات کو برقرار رکھنے ميں مدد ملتی ہے خاص طور پر ان حالات ميں جب کہ ممالک کے مابين تعلقات کشيدہ ہوں يا باقاعدہ جنگی صورت حال کا سامنا ہو۔ سفارت کاروں کو وصول کرتے وقت ميزبان حکومت ايسی خصوصی مراعات اور تحفظ کا يقين دلانے کی مجاز ہوتی ہے جن کی موجودگی ميں سفارت کار فعال انداز ميں اپنی ذمہ دارياں پوری کر سکيں، اس يقين دہانی کے بدلے ميں ايسی ہی سہوليات اور تحفظ ميزبان ملک کے سفارت کاروں کو بھی مہيا کيا جاتا ہے۔


سفارت کاروں کو سہوليات اور تحفظ فراہم کرنا عالمی قوانين کی بڑی پرانی روايات ميں شامل ہے۔ يہ روايات جنھيں اس سے پہلے بھی اختيار کيا جاتا رہا ہے سال 1961 ميں سفارتی تعلقات سے متعلق ويانا ميں ہونے والے کنويشن ميں باقاعدہ قانونی شکل اختيار کر گئيں۔ جن ممالک نے ان ضوابط کو تسليم کيا ہے وہ اس بات پر متفق ہيں کہ اس طرح کی روايات متنوع معاشرتی نظاموں اور آئينی اقدار سے قطع نظر قوموں کے مابين دوستانہ روابط کی تشکيل ميں اہم کردار ادا کرتی ہيں۔ اس سوچ کا باقاعدہ اظہار ويانا کنونشن کے پیراگراف 3 ميں باقاعدہ درج ہے۔


ميں يہ بھی نشاندہی کر دوں کہ پاکستان کا نام ان ممالک ميں شامل ہے جن کی جانب سے اقوام متحدہ کے سيکرٹری جرنل کو ويانا ميں سفارتی تعلقات کے حوالے سے اجلاس کے انعقاد کے لیے کہا گيا تھا۔


ويانا کنونشن ميں سفارتی سہولیات، تحفظ اور استثنی کے حوالے سے جو مقصد بیان کيا گيا ہے اس کے مطابق انفرادی سطح پر مفادات نہیں بلکہ مجموعی طور پر رياستوں کی ترجمانی کرنے والے سفارتی مشنز کی فعال کارکردگی کو يقينی بنانا ملحوظ رکھا گيا ہے۔ اس کے علاوہ ميزبان ملک کو يہ اختيار بھی حاصل ہے کہ وہ سفارتی مشن ميں شامل عملے کے کسی بھی رکن کو ناپسنديدہ قرار دے سکتا ہے۔ يہ قدم کسی بھی موقع پر اٹھايا جا سکتا ہے اور اس فيصلے کے ليے کسی وضاحت کی بھی کوئ ضرورت نہيں ہوتی۔ ايسی صورت حال ميں سفارتی مشن بھيجنے والی رياست قانونی طور پر پابند ہے کہ وہ اس شخص کو واپس بلوا لے يا سفارتی مشن کے ساتھ اس کے تعلق کو ختم کر دے۔ مجموعی طور پر سفارتی استثنی اور اس ضمن ميں دی جانے والی سہوليات کی بدولت رياستوں کے مابين تعلقات استوار کرنے ميں بہت مدد ملی ہے۔


يہ بات بھی غور طلب ہے کہ اقوام متحدہ کے کسی بھی ممبر ملک نے اس کنونشن کو ترک کرنے يا اس ميں درج قوانين کو تبديل کرنے کے لیے کبھی باضابطہ قرارداد پيش نہیں کی۔

Zaeef entered into Pakistan as Diplomat, a proper procedure was followed, Agreema was presented and proper Diplomatic Status was awarded.
This Diplomatic Status was to remain until Pakistan declares him a person Non-Grata and sends him back or there is a new Govt in Kabul which sacks him and appoints a new Ambassador. NOTE THIS POINT, even as Persona Non Grata or Sacked Diplomat he had the diplomatic immunity until he walks out of the country. There was only one way that he could be charged under any circumstances was that the Govt he is representing withdraws the immunity.

Even if the immunity is withdrawn, he could not be handed over to a third country - USA.

Might is Right is your only principle which you want to follow in case of Raymond as well.

I feel pity for all those anti Pakistan elements who are bent upon defaming and propagating against Pakistan. With a shameless stubbornness they declare every unearthed act of destabilizing plan against Pakistan as a part of conspiracy theory. Now, when even the western cannot hide the truth they still are not feeling any shame. Most ominous in this SVR report, though, is Pakistans ISI stating that top-secret CIA documents found in Daviss possession point to his, and/or TF373, providing to al Qaeda terrorists nuclear fissile material and biological agents they claim are to be used against the United States itself in order to ignite an all-out war in order to reestablish the Wests hegemony over a Global economy that is warned is just months away from collapse.

While all eyes in the West are currently trained on the ongoing revolution taking place in Egypt, Russias Foreign Intelligence Service (SVR) is warning that the situation on the sub-continent has turned grave as it appears open warfare is about to break out between Pakistan and the United States.
Fueling this crisis, that the SVR warns in their report has the potential to ignite a total Global War, was the apprehension by Pakistan of a 36-year-old American named Raymond Allen Davis (photo), whom the US claims is one of their diplomats, but Pakistani Intelligence Services (ISI) claim is a spy for the Central Intelligence Agency (CIA).
Davis was captured by Pakistani police after he shot and killed two men in the eastern city of Lahore on January 27th that the US claims were trying to rob him.
Pakistan, however, says that the two men Davis killed were ISI agents sent to follow him after it was discovered he had been making contact with al Qaeda after his cell phone was tracked to the Waziristan tribal area bordering Afghanistan where the Pakistani Taliban and a dozen other militant groups have forged a safe haven and former CIA agent Tim Osman (also known as Osama bin Laden) is believed to be in hiding.
Of the actual gunfight itself we can read as reported by the Time News Service which, in part, says:
The scene could have been scripted in a Hollywood action thriller: For two hours at the end of last month in Lahore, U.S. diplomat Raymond Davis was closely pursued by two visibly armed men on a motorbike. He noticed them tailing him from a restaurant to an ATM, and through the crowded streets of Pakistans second [largest] city. They were close by when, in a crowded intersection, Davis produced his own handgun and fired seven shots.
The diplomat was apparently a crack shot, and all seven bullets found their mark, killing his two pursuers. Davis then called for back-up, and a four-wheel-drive vehicle raced onto the scene, striking a Pakistani bystander who was killed by the impact. But the people in the vehicle, whose identities remain unknown, escaped from the scene having failed to retrieve Davis, who was later arrested nearby.
The combat skills exhibited by Davis, along with documentation taken from him after his arrest, prove, according to this report, his being a member of the feared American Task Force 373 (TF373) black operations unit currently operating in the Afghan War Theater and Pakistani tribal areas comprised of US Military Special Forces Soldiers, CIA spies and freelance mercenaries.
Further information about Davis discovered by the Times of India includes:
According to records from the Pentagon, Davis is a former Special Forces soldier who left the army in August 2003 after 10 years of service. A Virginia native, he served with infantry divisions prior to joining the 3rd Special Forces Group in Fort Bragg, North Carolina. In 1994, he was part of the U.N. peacekeeping force in Macedonia. His record includes several awards and medals, including for good conduct.
Public records also show Davis runs a company with his wife registered in Las Vegas called Hyperion Protective Services, though it was not immediately clear whether the company has had many contracts with the U.S. government.
Since Daviss capture the US has exerted extraordinary pressure upon Pakistan to release him, including the American Ambassador warning President Asif Ali Zardari to release him or else and the cancellation of all talks between these two nuclear powered Nations.
Today, according to this SVR report, this most critical of situations became even worse when a Pakistani judge refused to bow to American pressure and ordered a further 14-day detention of Davis, and which sparked an immediate threat from US National Security Advisor Tom Donilon, who told Pakistani envoy Hussain Haqqani that the Obama administration will kick him out of the US, close American consulates in Pakistan and cancel President Zardaris upcoming visit to Washington if their CIA spy wasnt released immediately.
Fearing that the conflict over Davis may lead to open warfare, the Pakistanis were quick to let the Americans know they would not come out any conflict unscathed with their firing yesterday of their new Hatf-VII nuclear cruise missile (also called Babur after the 16th-century Muslim ruler who founded the Mughal Empire) that Major General Athar Abbas said can carry strategic and conventional warheads, has stealth capabilities, is a low-flying, terrain-hugging missile with high manoeuvrability, pinpoint accuracy and radar avoidance features.
The United States Institute for Science and International Security (ISIS) further reported yesterday that Pakistan appears to be building a fourth military nuclear reactor, signaling its determination to produce more plutonium for atomic weapons.

Not known to the masses of the American people is that the $20 Trillion they have spent on their longest wars in history has bankrupted their Nation to such an extent that the International Monetary Fund (IMF) called yesterday for replacement of the US Dollar as the Worlds reserve currency.
More crucially that the American people are ignoring is the fact that their own government has unleashed against them a 21st Century update to the dreaded US Military Operation Northwoods campaign of terror designed to enrage them to accepting war as their main way of life.
Operation Northwoods was a series of false-flag operation proposals that originated within the United States government in 1962. The proposals called for the CIA, or other operatives, to commit acts of terrorism in US cities and elsewhere. These acts of terrorism were to be blamed on Cuba in order to create public support for a war against that nation, which had recently become communist under Fidel Castro. One part of Operation Northwoods was to develop a Communist Cuban terror campaign in the Miami area, in other Florida cities and even in Washington.
Operation Northwoods proposals included hijackings and bombings followed by the introduction of phony evidence that would implicate the Cuban government. It stated:
The desired resultant from the execution of this plan would be to place the United States in the apparent position of suffering defensible grievances from a rash and irresponsible government of Cuba and to develop an international image of a Cuban threat to peace in the Western Hemisphere.
Several other proposals were included within Operation Northwoods, including real or simulated actions against various US military and civilian targets. The plan was drafted by the Joint Chiefs of Staff, signed by Chairman Lyman Lemnitzer and sent to the Secretary of Defense. Although part of the US governments Cuban Project anti-communist initiative, Operation Northwoods was never officially accepted and the proposals included in the plan were never executed.
James Bamford summarizes Northwoods as follows:
Operation Northwoods, which had the written approval of the Chairman and every member of the Joint Chiefs of Staff, called for innocent people to be shot on American streets; for boats carrying refugees fleeing Cuba to be sunk on the high seas; for a wave of violent terrorism to be launched in Washington, D.C., Miami, and elsewhere. People would be framed for bombings they did not commit; planes would be hijacked. Using phony evidence, all of it would be blamed on Castro, thus giving Lemnitzer and his cabal the excuse, as well as the public and international backing, they needed to launch their war.
Though Operation Northwoods had the approval of the Chairman and every member of the Joint Chiefs of Staff, it did not have the approval of their boss, President John F. Kennedy (1917-1963), but who barely one year after his outright rejection of this monstrous plan to kill thousands of innocent Americans was gunned down as an example to any future US leader what would happen to them if they dared go against the wishes of the Military-Industrial Complex (MIC).
Today, as the US Department of Homeland Security has just issued a grim warning that the threat of terror strike on America is at a higher level than it has been since September 11, 2001, and the WikiLeaks release of secret US government cables reveals that al Qaeda is on the brink of using a nuclear bomb, a new President stands between his people and the CIA warmongers with the only question being will he protect them like Kennedy did?
The answer to that question, sadly, appears to be no as new information recently obtained by US journalists show that not only has Obama failed to discipline those CIA officers who have led the United States to near total collapse, he has promoted them in numbers never before seen in history.

There are few very interesting paragraphs in this article written by Scott Stewart and quoted by Geo.

Pakistani officials have corroborated Davis version of events and, according to their preliminary report, Davis appears to have acted in self-defence. From a tactical perspective, the incident appears to have been (in tactical security parlance) a good shoot, but the matter has been taken out of the tactical realm and has become mired in transnational politics and Pakistani public sentiment. Whether the shooting was justified or not, Davis has now become a pawn in a larger game being played out between the United States and Pakistan.

1- It is matter of record that Punjab Police in a press conference declared that the Challan presented to the High Court in Lahore, they have submitted their findings, Raymond Davis did not act in self-defence and carried out cold blooded murders of two Pakistani youngsters.

2- So who are these Pakistanis officers who corroborated Daviss version of events according to this article? Who wrote this preliminary report and where it is?

3- If this journalist is right then there is something sinister is going on. There are some other procedures or investigations (an operative word here) are conducted to proof in the court that he acted in self defence, contradicting the Police findings submitted to the courts.

4- Who are the known traitors in Pakistani Government at the moment? I suggest one name that stands out, Mr. Rehman Malik. He according to Mr. Mehmood Qureshi was given the control of the situation, even though the matter immunity is the responsibility of the foreign office and has nothing to do with Malik. It is also been reported with in hours of the incident Rehman Malik gave assurances to Americans for the release of Davis. Even though he possibly could not have all the facts available to him, including the status and true identity of Davis.


Once again as I said many times, Pakistani media picks on what suits them and does not bother to do the relevant analysis of the material. I produce three more examples from the same article.

At the time of the shooting, of course, Davis would not have had time to leisurely ponder this potential legal quagmire. He saw a threat and reacted to it. Undoubtedly, the U.S. government will do all it can to help Davis out especially since the case appears to be a good-shoot scenario and not a case of negligence or bad judgment.

Do Kamran Khan and Geo agree with this statement by the writer? Do they agree that Davis saw a threat and reacted to it? What threat did he saw? Do they also agree that it was a good-shoot scenario and lives of Pakistanis are good-shoot targets? Do they agree Davis act was a good judgement and not negligence, or to put it correctly a criminal act?

Kamran Khan apparently have years of experience and is one of the highest paid journalist of Pakistan. But such hands pick reporting live a bad taste in my mouth. I am flabbergasted from the professionalism and capacities of our Journalists. It is matter of fact that these journalists search the web every day and find the suitable ready made stories from the articles written by others. It is a very cheap way to earn your living. I must remind, these people are paid handsome amount of money for doing these programs and they also earn fame, a product which is very difficult to quantify in monitory terms.

It is also a fact that now majority of educated people in Pakistan and Pakistanis around the world do read these stories on the internet. The world has shrunk, material is readily available from click of a mouse thank to the internet. We probably read more and known more than these anchors, so why these guys are paid so highly for the re-cycling of the information, feeding on the hard work and research of others?

I think we the educated Pakistanis or overseas Pakistanis should expose these journalists too. Especially when we have people like Sethi and Naji amongst there midst.

The writer also made this allegation in his article.


The 1979 attack was said to have been sparked by reports that the U.S. government was behind an assault on the Grand Mosque in Mecca by Saudi militants the day before. In reality, the mob that stormed and torched the U.S. Embassy was at least tolerated, if not orchestrated, by the Pakistani government, which was angry that the United States cut off financial aid to the country in April 1979. Not only did the Pakistani government facilitate the busing of large numbers of protesters to the U.S. Embassy, its security forces also stood aside and refused to protect the embassy from the onslaught of the angry mob. The embassy assault was Pakistans not-so-subtle way of sending a message to the U.S. government.

Do Kamran and Geo agree with these comments?

Lastly, the writer also commented as follows;

It was no coincidence that the Pakistani lawsuit against the CIA station chief occurred shortly after the head of Pakistans Inter-Services Intelligence directorate, Lt. Gen. Ahmed Shuja Pasha, was accused in a civil lawsuit of being involved in the 2008 attacks in Mumbai. The suit was brought in U.S. District Court in Brooklyn by family members of the American rabbi killed alongside his wife in Mumbai by Pakistan-based Islamist militants.

1- Scott is alleging Pakistan was involved in Mumbai attacks.
2- ISI was behind the Law suits filled by the family members of those killed in Drone attacks.

Kamran Khan and Geo do you agree with Scott?

Probe finds connection between Davis, drone attacks

KARACHI: Investigation teams were astonished to learn about Raymond Daviss alleged connections in North Waziristan, sources told DawnNews.

Sources revealed that a GPS chip recovered from the possession of Davis was being used in identifying targets for drone attacks in the tribal region.

The 36 year old US official was hesitant in giving out information about his visits to the tribal region during investigations, sources said.

The US Embassy Officials were also exerting pressure on the investigation teams, asking the not to expose the information received from Davis.

It was also learnt that Davis made up to 12 visits to the tribal areas without prior notification to Pakistani officials.

The Punjab government has shared the investigation and the possessions recovered from Davis with the federal government, said sources.

The Journalist in this video explains how the US wants the destroy Pakistan and most importantly WHY do they want to destroy Pakistan. We Hope and pray to the Almighty God and there plot shall never be fulfilled and God Willing Pakistan will be here till the end of the world.
A red Flag operation to attack Pakistan.

Definitely, These foreign elements and assets are making trouble in Pakisatn. Otherwise Pakistanies dont kill each others like that.

Bomb blast, and target killing.

Just through out the American Embassy , like Iran ,every thing will be OK. in few years.

Pay taxes and stop corruption.

USA is trying to deprive itself from its best friends in the world. Imagine USA is doing it against a nation, who has helped to bridge gaps between China and USA. Similarly during Cold war Pakistan was best ally of USA, who was directly threatened by USSR for Nuclear bombing on U2 issue on Islamabad. Was USA able to dismember USSR without the Pakistan’s help? Shame on political leadership of US. They are time servers.

A false flag to attack on Pakistan:
USA is trying to deprive itself from its best friends in the world. Imagine USA is doing it against a nation, who has helped to bridge gaps between China and USA. Similarly during Cold war Pakistan was the best ally of USA, who was directly threatened by USSR for Nuclear bombing on U2 issue on Islamabad. Was USA able to dismember USSR without Pakistan’s help? Shame on political leadership of US. They are time servers.
