4)agar judges ko aazaad karna hai jo keh adliya ke kaarinde hen to phir hakoomat ke kaarindun ko bhi aazaad karna pade ga aur foj ke kaarindun ko bhi. yahee nahin her aik idaare main kaam kerne waale sab ke sab log hi aazaad hun ge. agar yahee kuchh karna hai to phir dastooro qanoon ki zaroorat hi kia reh jaati hai?

اپنے منہ پر طمانچے مار گیے۔ ایک سادہ مگر انتہائی اہم اور خطرناک الزام ، ایک جج پر حکومت وقت نے لگایا، آئین کے سینئر ترین ججوں پر مشتمل سپریم جوڈیشل کونسل کو بھیجا۔۔۔ کسی جج پر مس کنڈکٹ کا الزام ہو تو آگے بڑھ کر اسکا سامنا کرنا چاہیے تھا اور عوام کے سامنے عدلیہ کے وقار کو بلند رکھنے کے لیے پوری عدلیہ کو رات دن ایک کر کے أر یا پار لگانا چاہیے تھا۔ مگر ہوا یہ کہ ہر ممکن کوشش کی گئی کہ مجاز فورم یعنی سپریم جوڈیشل کونسل میں یہ کاروائی نہ ہو سکے۔ اور بالآخر فل بنچ نے اس ریفرینس کو یہ کلعدم قرار دے دیا۔۔ اس موقع پر اسی طرح کے شرمناک فیصلے کی یاد تازہ ہو گئی جس میں افتخار چودھری کے مس کنڈکٹ کا ریفرینس پرویز مشرف نے بھیجا تھا، جس پر ان کے پیٹی بھائی ججوں نے کیس چلنے ہی نہیں دیا۔ سیدھی سی بات ہے اگر حکومت کا الزام جھوٹا یا بدنیتی پر مبنی ہے تو وہ کیس چلتے ہی سامنے آ سکتا ہے جس سے حکومت کی نا صرف سبکی ہوتی بلکہ ججوں کے خلاف غلط ریفرینس بنانے والے بھی سامنے آ سکتے تھے۔ مگر افتخار چودھری اور قاضی عیسیٰ، دونوں کی کوشش رہی کہ کیس سپریم جوڈیشل کونسل میں نہ چلے اور اس میں وہ اپنے ساتھی ججوں اور کرپٹ وکلاء کی مدد سے کامیاب بھی رہے۔ ثابت ہوا کہ ان ججوں کے کردار میں ہی کھوٹ تھا اور مختلف تکنیکی نکات یا نقائص کی بنیاد پر اصل کیس اور الزام سے جان چھڑا گئے۔ اس موقع پر اپنی سیاسی جماعتوں کی بد دیانتی پر بھی افسوس ہوتا ہے جو بجائے حکومت کا ساتھ دینے کے ججوں کے ساتھ کھڑی ہیں۔
