Shariat court rules whipping for drinking un-Islamic

ISLAMABAD, May 28: The Federal Shariat Court (FSC) has declared whipping for the offence of drinking as un-Islamic and directed the government to amend the law to make the offence bailable.


A full-bench of the FSC comprising Chief Justice Haziqul Khairi, Justice Salahuddin Mirza and Justice Fida Mohammad Khan gave the ruling on Thursday after hearing the arguments that the Holy Quran asks Muslims to stay away from liquor but does not specifically declares it Haram, or prohibited.


The FSC had taken up a Shariat petition of Dr M. Aslam Khaki, who had challenged different provisions of the Prohibition Order (Enforcement of Hudood) Ordinance 1979, in which drinking was provided as Hadd, prescribing 80 lashes as punishment for the offence.


Pleading the case, Dr Aslam Khaki argued before the FSC that the punishment of 80 whips was neither provided by the Holy Quran nor Sunnah, hence the offence should not be termed as Hadd. Prophet Muhammad (Peace Be Upon Him), he recalled, had awarded only 40 sticks that too of a date tree to the offender, but not 80 whips.


Article 8 of the Prohibition Order (Enforcement of Hudood) Ordinance 1979 declares drinking liable to Hadd and suggests that whoever being an adult Muslim drinks intoxicating liquor by mouth is guilty of drinking liable to Hadd and shall be punished with whipping numbering 80 whips.


Islam had declared some specific offences as Hadd which are heinous, but the offence of drinking is not a heinous crime, he argued.Though the Holy Quran has attributed drinking as both benefit and also Haram, but declared Haram is more than its benefit. Thus the offence of drinking is not absolute Haram.


He contended that Article 25 of the ordinance which provided punishment for attempt to drinking was violative of the injunction of Islam as neither Holy Quran nor Sunnah had provided any punishment for it.


If a person makes an attempt to drink but withdraws, he should be appreciated but not be punished, he said, adding intention of commission of crime without any physical act was not a crime.


The court agreeing with the petitioner declared the provisions of 80 lashes as un-Islamic and directed the federal government to amend the relevant laws to replace the punishment of whipping with sticks within six months by making it bailable offence.


In case the government failed to amend the Hadd law, the punishment will cease to exist and become void, the judgment held.

We are properly aware of benefits of drinking alcohol and example of western countries are infront of us, look how their culture and society is on the verge of collapse still we wanted to be like them, first step to accept anything is by softening up the laws and punishments who are blocking or restricting that thing to happen, this is example of complete collapse of our society that our intellectuals and learned people are giving decisions against Islamic teachings.

Now some one should check the bank accounts of the corrupt judges. I wonder how much the corrupt hukmraan paid them for the rulings.

This ruling will put the entire shariah in jeopardy. Today ruling against punishments for drinking, tomorrow will be against rape, or zana bil-raza, kissing in public, or drinking in public.

These corrupt judges could rule that nowhere in Quran it is said that 'do not drink in public'

یاد رکھئیے، شریعت بنانا فقط اور فقط اللہ کا کام ہے اور نبی (ص) کو بھی اس میں کوئی حق حاصل نہیں۔ اگر ہم آج "سنت نبوی" کو شریعت سمجھتے ہیں تو اسکی وجہ یہ ہے کہ نبی (ص) اپنی طرف سے کچھ نہیں کہتے سوائے وحی کے۔ اگر ایسا نہ ہوتا تو سنت نبوی بھی شریعت کا ماخذ نہ بن پاتی کیونکہ شریعت سازی فقط اللہ کا حق ہے۔

چنانچہ، آپ جو بھی دلیل لائیں، اس میں خیال رکھیں کہ وہ قرآن یا سنت نبوی سے ثابت شدہ ہو۔ اللہ اور رسول کے بعد کسی اور کا قول شریعت سازی کے معاملے میں قابل قبول نہیں ہو سکتا ہے۔

میں نے انصاف کی بات کی ہے اور امید ہے کہ آپ مجھ پر ناراض ہونے کی بجائے ٹھندے دل و دماغ سے دلیل لائیں گے، اور اگر دلیل ناپید ہو تو پھر ان ججز پر فقط شک کی بنیاد پر کوئی الزام نہ لگائیں گے۔ انشاء اللہ۔ ہو سکتا ہے کہ یہ جج غلط ہوں اور شراب کی سزا رسول اللہ ص نے ہی اسی کوڑے مقرر فرمائی ہو، مگر دلیل بہرحال پیش ہونی چاہیے ہے۔

for example, shirk gunah-e-azeem hai. And the attached punishment is: jahannum for ever

Those who claim there is no literally mentioned about punishment for consuming alcohol, are merely looking for escape to justify their actions.

Munafqat aur la'nat aur afsos ki baat yeh hai key iss ummat mein jo log muhafiz-e-deen they woh hi log Islam to debatable bana rahey hain.

Yeh qurb qiamat ki puri daleel hai jaisa key nabi sahebpbuh ney kaha hai.

Almost everyone in the upper class and upper middle class drinks alcohol. This includes politicians, officers of the armed forces, business men and other professionals from various walks of life. They of course consume high end foreign made merchandise.

A very vast number of people from lower financial classes also consume large quantities of alcohol. They mostly use locally manufactured bottles. You go to any remote village in any part of Pakistan and you would see it first hand.

The class that actually does not consume that much is the lower middle and the middle class.

This is apart from the fact that alcohol is not as damaging as cigarettes or shisha or other hardcore drugs which are openly consumed by a lot.

Pakistan earns around $220 Million every year exporting alcohol to other countries. The internal black market is a huge generator of revenue.

For all the preachers of Islam, Pakistan, Saudia Arabia, Kuwait, Somalia, Iran and probably one or two other Islamic countries have alcohol banned in their countries. This is not to say that these countries do not have an underground market for example in Kuwait they make home made version of beer which is quite easily available and if you want to pay extra you can get foreign stuff just like you can get in Pakistan. There is NO OTHER Islamic country where alcohol trade is treated badly. Its big business and brings them billions of dollars. The fake preachers of Islam or mullahs would not buy it.

These are the realities on ground. You can get up, shout or vent out your discontent with it but that would not change the circumstances on the ground.

Banning heroin or shisha has not stopped its trade and never will. The solution is to legally allow alcohol consumption in Pakistan. This way Pakistan can collect $$$ of millions of dollars through taxing it just like they currently do with the tabbaco products.

Not legally allowing is losing revenue to the people that have already made billions out of this industry.

Legalizing it at least you can tax them hard on it.

Not legalizing it you would NEVER and can never stop its trade in the underground market. It has never worked for anything else and it would never work for this as well.

This is most bull sh it I have ever heard. This is what illuminati and free masons have taught western folks:

1. Legalize the alcohol so you can tax them. It gives govt incentives to legalize to collect taxes. legalizing is the first step for Free masons, then they will lobby for lowering the drinking age

2. Legalize marijuana: legalize it for medicinal purposes so the drug dealers can import with license and underground usage will increase because the same dealers will sell to every body for more cost but they will pay less because its legal.


No sireeee ! this crap is just a mirage and tricks by illuinati and free masons
Once it legalized you can control as you mentioned. Guaranteed
