The petition filed by Barrister Javed Iqbal Jafree states that the rules and seniority of sessions judges have been violated in elevation of Justice Ashraf Jahan Jamali (then district & sessions judge) to the Sindh High Court as additional judge in 2013.
The petitioner says Justice Jahan Jamali was transferred to the Federal Shariat Court after some months of her elevation to the SHC without the approval of the parliamentary committee on judges appointment.
Later, he states, the president on Sept 1, 2014 extended her one-year tenure as additional judge of the SHC while she was working as judge of the FSC at that time. In another move, he said, Justice Jahan Jamali was repatriated to the SHC as additional judge in October 2014 and was confirmed on Aug 26, 2015. However, the woman judge was again appointed as judge of the FSC on Aug 28, 2015 in violation of Article 203 of the Constitution, Barrister Jafree states.
The lawyer pleads that the procedure for the appointment of Shariat Court and high court judges is different. He alleges that CJP Jamali used his position for the appointment of his wife as judge of the FSC and requests the court to set aside the appointment of Justice Jahan Jamali as judge of the FSC for being unconstitutional.
In August last, the LHC chief justice had dismissed a similar petition filed by some other lawyer for not being maintainable.
summoned: The Lahore High Court summoned on Friday the director general of the Punjab Mass Transit Authority to explain delay in payment against the acquisition of Miani Sahib Graveyards land for the project of Metro Bus Service.
Earlier, a local commission filed its report before the court revealing that over one kanal of the graveyard had been illegally occupied by office of Lahore Electric Supply Company (Lesco) since 1986.
Justice Ali Akbar Qureshi directed Lesco to vacate the land of the Miani Sahib graveyard immediately and to pay rent to its committee for the whole period of the occupation.
Lesco chief Wajid Kazmi, who was present in the court, gave an undertaking for the compliance of the order.
The commissions report revealed that the government had not paid the money to the graveyard committee against land acquired for the metro bus project.
The judge expressed concern on the inordinate delay in the payment and directed the mass transit director general to appear in person and explain the reasons. The judge adjourned hearing of the case till Dec 19.
