If today you give immunity to Davis tomorrow any diplomat in any state dinner can shoot your top nuclear scientist or politician and can claim the immunity. In light of Davis case you will not be able to do anything against any diplomat what so ever he does. That’s why we should not take it just a matter of two civilians.

Davis is a diplomat, declares FO

ISLAMABAD: A letter written to Law Ministry from Foreign Office, declared the US double murderer of two Pakistani citizens, Raymond Davis, a diplomat, Geo News reported late Tuesday.

According to letter, US citizen Raymond Davis was designated in Pakistan at US consulate in Lahore as a diplomat and all the same, he enjoys diplomatic immunity according to Vienna Convention.

A few minutes ago, US President Obama and Senator Kerry demanded Pakistan to acknowledge Davis as a diplomat and urged for his early release.

I am just wondering that why only DAVIS's issue has got so much of attention. Why the media, politicians and the whole nation is going to death after Davis? Why they want to see him hanged and bring a halt to multi billions dollars trade and aid? Why they want to bring more financial, political and diplomatic instabality to the country?

If killing of 2 local nationals is a matter of such an integrity and sovereignty than dozens of Local nationals are killed everyday in Karachi, dozens of local nationals commit suicide directly becasue of the economic injustice imposed by the government, scores of LN are killed by drones everyday, dozens of LN are killed on the roads and streets because of no law and order in the country, and the same media, politicans and nation are no more than merely silent spectators.

If Davis has to been hanged for killing of 2 LNs then the people responsible for killing of LNs in Karachi, Balochistan, Tribal areas and every part of the country should be hanged along with Davis. Davis MIGHT have even diplomatic immunity, the others are prestegiously sitting in Washington, London and Islamabad with zero Immunity. Why this injustice? Why this racism? Why this hypocracy?

There are a lot families where people have arguments with one another but does that mean that any tom dick and harry can barge into their home and hit some one on the head?? What if the deceased was one of your relatives??

So now it's ok since he's a diplomat? He's not my diplomat. He should stand trial in the jurisdiction where he committed his crimes. Let him explain to all why a 'diplomat' would be carrying a sidearm in the first place. God knows he won't get any trail if he comes back to the U.S.

IN ORDER TO CLAIM BENEFIT UNDER VIENNA CONVENTION:

(a) HE MUST DECLARE HIS TRUE IDENTITY E.G. WHO HE IS WHAT IS HIS TRUE NAME

(b) WHY WAS HE AND THE AMERICANS TELLING LIES ABOUT HIS IDENTITY

(c) THIS NOW BEING COMPLETELY UNDERSTOOD THAT HE IS USING A FALSE IDENTITY, PAKISTAN FOREIGN OFFICE IS WRONG TO DISCUSS ISSUES RELATING TO DIPLOMATIC/CONSULAR/ADMINISTRATIVE/TECHNICAL STAFF IMMUNITY BASED ON A FAKE IDENTITY. GIVING ACKNOWLEDGEMENT TO A FAKE IDENTITY AND THEN DISCUSSING IMMUNITY QUESTIONS IS THE WRONG BASIS ON WHICH VIENNA CONVENTION IS BEING INVOKED.

(d) WAS HE ENLISTED WITH THE FOREIGN OFFICE IN A TRUE IDENTITY

(e) DOES THE LAHORE CONSULATE HOLDS ANY REGULAR AND PERMANENT RECORD WHICH SHOWS DETAILS OF ACTIVITIES AS A CONSULAR STAFF IN HIS TRUE NAME

(f) DOES THE LAHORE CONSULATE HOLDS ANY RECORDS WHY WAS HE THERE IN A BUSY PLACE OF LAHORE WITH A FAKE NAME OR DID HE LET THE US CONSULATE KNOW ABOUT HIS MOVEMENTS IN LAHORE ON THAT PARTICULAR DAY AND HIS RECORD BEFORE

(g) WHY WAS HE THERE WITHOUT A CONSULAR AND PROVINCIAL GOVERNMENT PROTECTION

(h) HE HAS TO EXPLAIN WHY WAS HE USING A FAKE NUMBER CAR, UNLICENSED WEAPON AND EQUIPMENT USED FOR ESPIONAGE.

(i) ALL THESE ARE OFFENCES UNDER THE PAKISTANI LAW - A RECEIVING COUNTRY. HE HAS TO BE PROSECUTED UNDER THE LOCAL LAW AND DURING HE
CAN CLAIM / RAISE THE QUESTION OF HIS IMMUNITY UNDER THE VIENNA CONVENTIONS BEFORE THE TRIAL COURT.

(j) HE HAS COMMITTED MURDER OF TWO PAKISTANIES AND HAS CAUSED TO BE MURDERED ANOTHER WHICH IS A GRAVE CRIME AND THERE IS AN EXCLUSION CLAUSE IN THE VIENNA CONVENTIONS PROVIDING THAT NO IMMUNITY IS AVAILABLE AGAINST GRAVE CRIMES.

(k) HE IS CLAIMING THAT HE COMMITTED MURDERS IN SEL-DEFENCE WHICH IS A LEGAL QUESTION AND CAN ONLY BE DETERMINED IN A COURT OF LAW.

(L) TO GRANT HIM OR NOT THE CLAIMED IMMUNITY, THE FACTS OF THE CASE HAVE TO BE BASED UPON WITH A FAIR INTERPRETATION OF THE LOCAL LEGISLATION BY WHICH THE VIENNA CONVENTIONS WERE ADOPTED IN PAKISTAN.

(M) THE PERSON HAS ALREADY BEEN ARRESTED AND DETAINED. A JUDICIAL PROCESS HAS BEEN PUT INTO MOTION. LET THE COURTS IN PAKISTAN DECIDE WHETHER THE DECISION WAS WRONG OR RIGHT OR WHAT HIS FUTURE WILL BE. HE CANNOT BE TAKEN OUT BY AN EXECUTIVE ORDER.

SIMPLE EXAMPLE - IS I GO TO A BANK AND CLAIM A CERTAIN AMOUNT OF MONEY. BUT BEFORE THAT I HAVE TO PROVE I HAVE MY ACCOUNT WITH THE BANK AND I HAVE A BALANCE TO GET PAID THE CLAIMED MONEY.

I CANNOT SAY I MUST BE PAID MONEY ONLY BECAUSE BANK IS A BANK AND THERE IS A HUGE AMOUNT OF MONEY THERE.

WE KNOW THEY DID NOTHING AFTER 1998 NUCLEAR EXPLOSIONS OF PAKISTAN - ONLY SENT MR. NAWAZ SHARIF IN EXILE TO SAOODI ARABIA.

I agree with brother Armani when it comes to the serious issue of punishing all those culprits who are enjoying zero immunity, responsible for the killings of our brothers and sisters from Karachi to Khyber which includes people from Politics and Army and its valuable to have such analysis of the situation to see ourselves in a mirror and see our own hypocrisy and two-facedness. But with all respect to that, I see Raymond Davis case from different perspective, its obvious that he is a trained Rambo and was here on a mission like thousand others allowed by the father of NRO, Pervez Musharraf.

Though his status with FO and IM is of a confirmed diplomat but he is definitely not one and his trial in a Pakistani court (despite of pressure from all over the world) will be some sort of a warning to all those engaged in secrete mission for destabilizing Pakistan which I think is more dangerous than the economic crisis which our country may or may not face if U.S will stop its aid and we have a lot of examples where U.S itself convicted diplomats responsible for the killings of U.S citizens, despite of the fact that they committed it unknowingly or it happened accidentally while we have a completely different scenario.

In short, as General Hamid Gul said in an interview that we have far more serious threat than our expectations due to the presence of people like Raymond Davis and its the most perfect time to do what an Independent Nuclear Power Muslim Nation should, to do decide what is most beneficial for our National Interest.

If u ask why Diplomat was carrying arm then why these 2 boys were carrying arms....Diplomat was carrying arm coz most of pakistanies carry arms and they can kill anyone anywhere they like and Diplomats can't wait to be killed.....It was just a matter of who shoots ist and Davis survived that battle.......If i had been in Davis's place i would have done the same coz i can't be mere spectator of my killing

Well I mention earlier that I see him from different perspective and I have also mentioned our own Pakistanis responsible for the killings from Karachi to Khyber but please don’t tell me that CIA agents playing chess and golf in their embassies and consulates and have never linked to terrorism and acts of sabotage in our homeland, people like you don’t want to open their eyes, you see two so called street thugs with guns, not even with the intention to kill anyone as their pistols’ bullets were in the chamber and you don’t want to see a so called diplomat carrying Hi-Tech devices, Satellite Phone, Weapons and many others things enough to prove him a hired Rambo and you must know that such people are highly skilled and are able to carry out risky missions anywhere in the world. Don’t confuse yourself when you have culprit in your hand, have him trailed then talk about other issues, it’s a matter of National Respect.
