Islam is fundamentally about pleasing Allah and humanity.
This is how all laws are supposed to be made as far as islam is concerned.
The prophet made laws on same basis according to his time and place, situations and circumstances.
The aim was to minimise crime and provide maximum security to citizens in the state so that a society as whole could functions in such a way that it was at ease within itself.
In a good society respect for others, love and loyalty are of great value, upon which family, clan and tribe stands which are binding force for humanity.
Rape and sexual misconduct are things which have nothing to do with good human values and are part of any society that does not value good human values. Such people are those who have no respect for others, they have no concept of love and loyalty in their heads.
When any society has such people in it, it is not a good news at all.
Women in burqa can be even easier target for such people because they are already in a sack like wrapper, wrapped up to be carried away, not even able to see who is doing this to them.
It is better that women in such societies learn to look after themselves and the society at the same time must push for change for the better.
One needs to realise that humanist values only work in societies wherein people are educated to be self conscious and socially conscious good human beings.
In a jungle all one can do is do all one can to protect oneself man or woman.
As for sexual attraction, it is like hunger and thirst a human drive. The more hungry you are the more likely you will eat anything ir you will lose the sense of right and wrong food. The more starved a person is of sex the more likely he is to lose his perspective on its validity.
So concentration is needed on understanding the problem and then looking for its solutions. Legislating for sake of it will not solve the problem.
To begin with we need to set up the society the right way so that it can cater its needs and reasonable desires. Within that context legislation is to be brought in to cope with odd cases that might arise from time to time.
Islam is not about forcing people in to submission and slavery of authority. The authoritarianism in the name of islam is creation of debased mullahs to please ruler of their times. This is not to be mixed with the islam that is in the quran and the quran based ahadith.
It is the framework of islam that tells us which report could be hadith or what its right interpretation might be.
The quran and ahdith are guidelines to show us how to do things in an islamic setting.
Unfortunately there are many bad things happening in the islamic world in the name of islam. All because of lack of thoughtful understanding of the quran and the hadith by the educated people.
In the quranic context a proper aalim is such a person who has the knowledge of the quran in light of knowledge of the world in which one lives.
Anyone else is aalim in the sense that one knows something and of course some know more than others.
There is hadly any effort made in islamic world for creating proper aalims to get rid of the ignorance that exists in the islamic world. We have two separate tracks mullahism and secularism. One set against the other. When both merge in such a way that they complement each other that is the time we will start having proper quranic ulema. The real followers of the prophet. Till then things will continue the way they have been.
People will keep on fighting on length of beard and pajamas.
May Allah have mercy on us and help us get out of this rut by opening our minds to better things that bring us real peace and security and comfort.
