بھائی، آپ بھوُل رہے ہو اُس فرعون نے جب آئینِ پاکستان پامال کیا تھا تو اُسکو قانونی تحفظ بھی اِسی جج نے فراہم کیا تھا۔ نہ صِرف قانونی تحفظ فراہم کیا بلکہ اُسے آئین میں ترمیم کی اجازت بھی دی۔
کِس لیئے؟
صرف اپنی نوکری بچانے کیلئے ورنہ جسٹس سعید الزماں صدیقی کی مثال موجود تھی۔

Justice Saeeduzzaman Siddiqui was the Chief Justice of Pakistan when the 1999 military coup d'tat was staged by then-Chairman of the Joint Chiefs of Staff Committee and Chief of Army Staff General Pervez Musharraf. Notably, he defied the request given by Musharraf via the Law Minister and Legal Adviser Sharifuddin Pirzada to take a new oath under the Provisional Constitutional Order (PCO) saying that: "Taking an oath under the PCO, in my opinion, will be a deviation from the oath I had taken to defend the constitution of 1973".

ایک چپڑاسی کو بھی ملازمت سے نکالنے کا طریقہ ہوتا ہے کُجا آپ دو تہائی اکثریت والے منتخب وزیرِ اعظم کو گردن سے دبوچ کر نکال باہر کرو۔ یہ کِس طرح جائز ہے اور اِس ساری بدمعاشی کو آئینی قرار دینے والا شخص کیسے منصف بننے کا اہل ہے۔ آئین میں فُل سٹاپ اور کامے کی جگہ بدلنے کیلئے بھی پارلیمان کی منظوری درکار ہے کیسے چار ججوں اور جرنیلوں نے مِل کر آئین توڑا اور اُسکے اہم ترین حصوں کو معطل کیا۔ آپ کیوں بھول جاتے ہو۔ سُنا ہے آئین شکنی کی سزا موت ہے۔
موضوع مبشر لقمان جیسا چول نہیں بلکہ جسٹس افتخار چوہدری ہے۔ یہ جج نوکری اور شہرت کیلئے کُچھ بھی کر سکتا ہے۔ نوکری جاتی دیکھی تو بارہ اکتوبر کی غداری کو جائز قرار دے دیا۔ پاکستان کا حلف توڑ کر فرعون کی وفاداری کا حلف اُٹھا لیا۔ پھِر نوکری جاتی دیکھ کر جرنیلوں کو آنکھ دِکھا دی ۔ ۔ ۔ ۔ لِہٰذا تاریخ لِکھی گئی تو وہ نو مارچ دو ہزار سات سے شروع نہین ہوگی بلکہ اُس میں بارہ اکتوبر اُنیس سو نناوے بھی شامل ہوگا۔

After the proclamation of PCO, on 26 January 2000 an order Oath of Office (Judges) Order, 2000 was issued that required that judiciary take oath of office under PCO. Four judges, including Chief Justice Saeeduzzaman Siddiqui, refused to take an oath under the PCO, and therefore no longer remained part of the PCO Supreme Court. To fill the positions in the PCO Supreme Court Musharraf appointed other judges, including Chaudhry, to the PCO Supreme Court. Musharraf's extra-constitutional acts were legitimized by this PCO Supreme Court.
