عدت مکمل کئے بغیر نکاح پر لاہور ہائیکورٹ کا اہم فیصلہ

لاہور ہائیکورٹ نے عدت اور نکاح کے متعلق درخواست کا فیصلہ سنا دیا۔

تفصیلات کے مطابق لاہور ہائیکورٹ کے جسٹس علی ضیا باجوہ نے عدت اور نکاح کے حوالے سے درخواست کی سماعت کی۔

جسٹس علی ضیا باجوہ نے امیر بخش کی درخواست خارج کرنے کا فیصلہ جاری کیا۔

درخواست میں امیر بخش کا مؤقف تھا کہ اس کی سابقہ بیوی آمنہ نے یک طرفہ طور پر عدالت سے تنسیخ نکاح کا فیصلہ لیا اور اگلے روز اسماعیل نامی شخص سے شادی کر لی۔

درخواست گزار کا کہنا تھا کہ عدت مکمل کیے بغیر اگلا نکاح کرنا زنا کے زمرے میں آتا ہے، اس لیے آمنہ اور اسماعیل کے خلاف زنا کا مقدمہ درج کیا جائے۔

عدالت نے فیصلہ سنایا عدت گزارے بغیر شادی کو بے قائدہ یا فاسد کہا جا سکتا ہے لیکن اسے باطل قرار نہیں دیا جا سکتا۔

عدالت نے ریمارکس دیئے کہ اگر درخواست گزار کے مؤقف کو درست مان بھی لیا جائے تب بھی شادی کو باطل قرار نہیں دیا جاسکتا، عدت مکمل کیے بغیر ہونے والی شادی کو بے قاعدہ تو کہا جا سکتا ہے لیکن وہ باطل نہیں۔

عدالت نے فیصلہ سناتے ہوئے درخواست گزار کی درخواست مسترد کر دی اور کہا کہ عدت مکمل کیے بغیر شادی کرنے والے جوڑے کو زنا کا مرتکب قرار نہیں دیا جا سکتا۔

I think scenario was after degree of divorce from a lower court first husband wanted to drag the case in next court just to pester her taking advantage of the snail paced court proceedings and lady immediately got remarried after the decision to avert another nightmare. Secondly another important point is how much time has already elapsed between the separation of couple. However our judicial system is rotten and unfortunately no serious reforms for the speedy justice as promised by PTI.

Court does not give divorce before three months. Courts make sure 3 months passed. Eidat is required to know if women is pregnant or not. During the court proceedings, 3 months time have passed. No need for Eidat.

True very thin majority but they should have taken some bold step to wipe off this rotten corrupt judiciary and I am pretty sure even their opponents of general public would also supported because more than 90% people are against this judiciary give time framed judicial system this was possible with ordinance i admit extremely difficult but no other way. Now you can see this judiciary is the greatest protector of status quo. Army also tied the hands of IK. Now with rising inflation even the die hard supporters are also leaving the camp. All the hopes are dashed unfortunately no other option in sight.

Yes true but it was a matter of survival now in future you will see how this filthy judiciary going to jeopardize the country further
