عدالت نے متنازع ٹوئٹ پر مقدمے کو ایف آئی اے کے اختیار سےتجاوز قرار دے دیا

اسلام آباد ہائی کورٹ نے متنازع ٹوئٹ پر مقدمے کے اندراج کو ایف آئی اے کے اختیار سے تجاوز قرار دے دیا۔

تفصیلات کے مطابق عدالت نے اپریل میں حکومت تبدیلی کی سوشل میڈیا مہم کیس کا فیصلہ جاری کردیا۔ جسٹس بابر ستار نے شہری کی درخواست منظور کرتے ہوئے متنازع ٹوئٹس پر شہری کے خلاف درج مقدمہ خارج کر دیا۔

عدالت نے متنازع ٹوئٹ پر مقدمہ درج کرنے کو ایف آئی اے کے اختیار سے تجاوز قرار دیتے ہوئے کہا کہ ایف آئی اے نے یہ کیس درج کر کے ریاست کا مذاق بنایا۔

عدالت نے ریمارکس میں کہا کہ ایف آئی آر کا مقصد اظہار رائے پر غیرقانونی سینسرشپ لگانا تھا۔ فیصلے میں مزید کہا گیا ہے کہ کسی بھی ٹرینڈ میں محض ٹوئٹ کرنے سے کوئی جرم سرزد نہیں ہوتا۔

جسٹس بابر ستار نے کہا کہ ٹوئٹ کرنے والے کے اپنے الفاظ میں جب تک کچھ غلط نہ ہو جرم نہیں۔ عدالت نے کہا کہ متنازع ٹوئٹ میں مخصوص ٹرینڈ سے متعلق کہا گیا اس میں لکھنے پر ادارے ماورائے قانون کارروائی کر سکتے ہیں۔

فیصلے میں کہا گیا ہے کہ ایف آئی اے کا ایسی ٹوئٹ پر کریمنل کیس بنا کر عوام کے ذہن میں شبہات کو تقویت دینا المیہ ہے۔ ٹوئٹر صارف نے ویگو ڈالے اور ماورائے قانون جبری گمشدگیوں کی بات کی۔

Athar is the person who granted more relief to criminals than anyone else. He has been giving relief to criminals or white wash them and trying to equalize by giving relief to innocents for fake cases.

It takes a moment for the judges to convert from human to patwari... remember how the judges acted when Khan said that he will take legal action against the lady judge Zaiba, and the judiciary became insecure. Babar Sattar was part of the bench that decided to indict Khan.
