Musharraf charged with Benazir's murder

RAWALPINDI: Former military ruler General (retd) Pervez Musharraf was indicted on three counts Tuesday in Rawalpindi's anti-terrorism court (ATC) over the 2007 murder of ex-prime minister Benazir Bhutto.

Musharraf was also produced in the ATC amidst tight security during todays hearing of the case headed by ATC judge Habibur Rehman.
A challan was read out against the former president and six others nominated in Benazirs murder during the hearing.
He was charged with murder, criminal conspiracy for murder and facilitation for murder, public prosecutor Chaudhry Azhar told AFP at the ATC in Rawalpindi hearing the case.
The six accused persons include former City Police Officer (CPO) of Rawalpindi Saud Aziz, the then SP Khurram Shahzad, Hasnain Gul, Rafaqat Hussain, Sher Zaman and Abdul Rasheed respectively.
Musharraf and the accused men denied the charges.
The court ordered the authorities to produce all the defendants in a hearing fixed for August 27 as it subsequently adjourned the matter to the said date for evidence to be brought.
Following the adjournment, the former president returned to his Chak Shahzad residence, which had been declared sub-jail.
Benazir Bhutto was assassinated in a gun-and-bomb attack outside Rawalpindis Liaquat Bagh on December 27, 2007 while Musharraf was president. She was killed after addressing an election campaign rally in the city.

Charge of Murder on Musharaf is serious stuff and mandates better defence team on his part and finding of BB murder culprit.

In criminal law to be charged is a serious thing as it implies that Prima facie a case exits. Although he is in jail technically but with murder charge means owing to co-presence of section 497 release on bail becomes more difficult. A person in prison and not free finds it quite hard to construct a defence for himself. So far Musharaf has relied on usual run of the mill lawyers and his own instincts and connections. Lets see what turn the cases take and see whether he does employ some serious and competent persons both to defend himself and also to find Benazir Murderers. I do not think that state will be able to proov Musharaf connection but as Bhutto used to say in defence in the supreme court , wherever there is a missing proof or absent link to kink connection , it is alleged that a phone call was received to fill in the blank and yes some lawyer will tell us about "Wada Mauf Gawa" clause in this thread hopefully .

Musharaf has been tolerating PMs anyway , and all the parleys with Americans were about bringing in such characters again in the political system , it would have been foolish both for him and for public to consider that murder of hers would benefit him in any manner. Charge is Not convincing . Musharaf was however not in favour of NRO , this was told to me by someone who himself attended the grand political meeting where NRO was discussed. Benazir Bhutto after the first attack in Karachi had accepted as reality that Taliban are not after her as they sent a message to her that they were not involved as they too were anxious to clear themselves before a possible future PM of their innocence . It was the view of many in establishment that Baitullah was aligned with foreign powers . What ever the truth killers of anybody , even Benazir Bhutto type remote and ineffective prime minister should be found out and that Musharaf needs a proper lawyer and a proper Sherlock Holmes. It may be that his defence material is not with him and others have it already .

just a big drama, enjoy for few more months, something will happen with a bam and bang and Mussharuff will be free of all his cases soon to be part of Pakistani politics, thats the rumor circulating right now:lol:

اڈیالہ جیل میں اسکو بھی کچھ اندازہ ہوتا کہ وہاں ڈالے ہوے قیدیوں کا حال کیا ہوتا ہے ،اور اسکے کیس کی سنوائی بھی اڈیالہ جیل میں ہی ہونی چاہئیے تھی ............... ................

Biggest fault of previz musharaf is that he is Urdu speaking , he is not punjabi & painduoon, great brave and successful tenure in the history of Pakistan. Baghairat General Zanni proved to punajbi General.

Pakistan charges Musharraf with Bhutto's murder

RAWALPINDI, Pakistan (AFP) - A Pakistani court on Tuesday charged former military ruler Pervez Musharraf with the 2007 murder of opposition leader Benazir Bhutto, an unprecedented move against an ex-army chief.

It is the first time a head of Pakistan's army has been charged with a crime, challenging beliefs that the military is immune from prosecution and threatening to fan tensions with civilian institutions.
While murder will be difficult to prove, it may embolden efforts to try Musharraf for treason for seizing power in 1999 and for violating the constitution by sacking judges and imposing emergency rule in 2007. Treason can carry the death penalty.

Musharraf, once the most powerful man in the nuclear-armed state, appeared in court on Tuesday to deny the charges against him.

"He was charged with murder, criminal conspiracy for murder and facilitation for murder," public prosecutor Chaudhry Azhar told AFP at the anti-terrorism court in Rawalpindi hearing the case.
The 70-year-old retired general's brief appearance was accompanied by massive security. He was protected by scores of officers and roads leading to the court were shut down.

Officials had said threats against his life were too severe for him to be charged on August 6 as initially scheduled, although he had appeared in person at an earlier hearing on July 30.

The case was adjourned until August 27 although no date has been set for any trial.
Raza Bokhari, a spokesman for Musharraf, dismissed the indictment as "false, fabricated and fictitious" and "an undignified attempt to smear the honour and integrity of the former president".
"We are not afraid of the proceedings. We will follow legal procedures in the court," his defence lawyer Syeda Afshan Adil told AFP.

Bhutto, twice elected prime minister of Pakistan and the first woman premier of a Muslim country, was killed in a gun and suicide attack in Rawalpindi on December 27, 2007.

Musharraf's government blamed the assassination on Pakistani Taliban chief Baitullah Mehsud, who denied any involvement. He was killed in a US drone attack in 2009.

In 2010, a UN report accused Musharraf's government of failing to give Bhutto adequate protection and said her death could have been prevented.

Under Bhutto's widower, President Asif Ali Zardari, the previous Pakistan Peoples Party (PPP) government initiated proceedings against Musharraf.
In November 2011, the same court also indicted two police officers and five alleged Taliban militants over Bhutto's death, but none of them has yet been brought to trial.
"There is a long way to go and it will be very, very difficult to prove that he engineered the murder conspiracy or that he was the mastermind," political analyst Imtiaz Gul told AFP.

"All we have seen is a politically motivated indictment, which may be of no real significance in the long run."
Nor has the indictment silenced speculation about the possibility of a behind-the-scenes deal that could allow Musharraf to leave Pakistan without going to jail.

For politicians, being hauled before the courts is par for the course in Pakistan. Current Prime Minister Nawaz Sharif was sentenced to life in prison after being deposed by Musharraf in 1999, but was shortly afterwards allowed to go into exile in Saudi Arabia.

Sharif returned to win elections in May, taking over from a PPP government in Pakistan's first handover of civilian power after several spells of military rule down the years.

Zardari himself, who spent 11 years in jail for alleged corruption, was also indicted in 2003 over the murder of a steel mill chairman, but became president in 2008.

Musharraf, on the other hand, has enjoyed the comparative luxury of house arrest at his villa on the edge of Islamabad since April after returning from self-imposed exile.

He has been formally granted bail in two of three cases against him.
Analyst Hasan Askari said the indictment will stoke tensions between the military and civilian institutions of the judiciary and government, but that the army would play a quiet game.
"They will quietly monitor the situation as to how this case proceeds and to what extent it reflects negatively on the military," he told AFP.

"They are not on the back foot but... they will be concerned about implications of this case for the military."
Musharraf, who was barred from running in the May elections, is also wanted over the death of Baluchistan rebel leader Nawab Akbar Bugti during a military operation in 2006.

The new government headed by Sharif is investigating the evidence against him for treason, after saying he should stand trial for subverting the constitution.
