Not "Reciting" fatiha behind the Imam did not make Namaz incomplete infact reciting Fatiha behind Imam make Namaz against the Quran and Hadith(even according to Hadith presented above)

like Hadith said "Jee Main parhay" so when ever you listing something CARE Fully you are actually reciting in HEART.
"Jee Main parhay" also shows that one should not recite by "tongue"

one Hadith that also shows that "Who did not recite Fatiha his namaz is incomplete" is not about the prayer behind Imam.
Malik Muwatta
"Whoever catches the ruku has caught the sajda." (Book #1, Hadith #1.3.17)

And that is what we practice that when we got late in catching Imam in namaz from start and we see Imam going In Ruku we join him in the ruku and did not repeat that perticular Rakat. although we have missed the Sura Fatiha.

So I hope above Hadith and joining Rakat in Ruku and not repeating it shows that it is not for the prayer behind Imam.
Thanks

There are few more things that need some clarification but not touching them

Dear Abdul Allah,

Thank you very much for your response. You mentioned an hadith from Malik Muwatta "Whoever catches the ruku has caught the sajda." (Book #1, Hadith #1.3.17). This hadith is for exceptional case. The exceptional case can not be applied to the main rule. For example, If you can not find water for Wadu you are allowed to do "Tayamum" but this is valid only for exceptional case.

Please see following Tafseer by Dr. Israr Ahmed, where he talks about above issue in detail:

Regarding reading Surah-e-Fatiha behind Imam or not was not my main target. May Allah forgive our weeknesses (Aammen).

I wanted to touch the issue of SHIRK which is worst of all sin.

Allah says in the Holy Quran Chapter 4 Surah Al Nisa Verse 48:

Allah forgiveth not that partners should be set up with Him; but He forgiveth anything else, to whom He pleaseth; to set up partners with Allah is to devise a sin Most heinous indeed.

Please read above verses and then read again the Tafseer of following verse of Surah-e-fatiha:

Dear
The hadith that i present make it clear that reciting Fatiha in ever rakat is not for the prayer behind Imam. if it is a must to recite situation then Rakat should be repeated if one skip it.
you talk about exceptional case
Can we skip Ruku in "exceptional case"? Answer is no. if a person joins Namaz after ruku he must repeat the Rakat even in "exceptional case"
Bcz Ruku is a "Must to perform" rukun of the Namaz
So above Hadith clearly shows that oblegation of reciting Fatiha is not for the prayer behind Imam.
I hope now it is clear???

another Hadith that i found and I think is more clearly support what i am trying to say.
'ta' b. Yasar reported that he had asked Zaid b. Thabit about recital along with the imam, to which he said: There should be no recital along with the imam in anything, and alleged that he recited:" By the star when it sets" (Surah Najm) before the Messenger of Allah (may peace be upon him) and he did not prostrate himself. (Book #004, Hadith #1192)

I hope it clarify bit more

Please read above verses and then read again the Tafseer of following verse of Surah-e-fatiha:

That was the same thing for which i said i do not want to touch but as you asked it directly so i will try to answer in short.

The short answer is
that is it.

your post talk about

well I am afraid that line bring Hazrat Suleman alihay salam under that.(May Allah forive) and i know you cant even think about it.
Hazrat Suliman alihay salam ask his chiefs to bring throne of the queen before she reach. He should have ask Allah for that. and who brings it miraculously? A MAN with knowledge of the book and do it within blink of the eye.
So ظاہری لحاظ سے that man was not able to do it. (bringing that within the BLINK OF EYE)

A person who got Knowledge of the Book(not quran obviously) have such power.
then think about some one who have knowledge of Quran.

So I hope you must have get the point that saying every thing as shirk only by reading few Ayath of Quran is actually WRONG.

another point.
Your post also talk about
Well Sura Yousaf told us that
A nabi can even smell from miles away. and people who do not have knowledge think it as an error. listening something is far more less thing.

94. And when the caravan departed, their father said: "I do indeed feel the smell of Yusuf (Joseph), if only you think me not a dotard (a person who has weakness of mind because of old age)."

95. They said: "By Allah! Certainly, you are in your old error."

Note:
Tawaaf , Sajada should not be done as it is shirk.
Sajada of any type is not allowed. weither Sajada Ibadat or Sajada Tazeemi. Sajada Ibadat is Kufar. Sajada Tazeemi is Gunaah

Thanks Malik This Hadith was in mind but I was missing the referenence Thanks :)

This Hadith Clearly tells us that the obligation of reciting Fatiha is not for the prayer behid Imam
Yahya related to me from Malik from Abu Nuaym Wahb ibn Kaysan that he heard Jabir ibn Abdullah say, "Someone who prays a raka without reciting the umm al-Qur'an in it has not done the prayer except behind an imam." (Book #3, Hadith #3.9.40)

Dear Abdul Allah,

My brother it is very unfair to mention the story of Prophet Sulaiman (AS) to justify the SHIRKIA acts. He (AS) was bestowed by Allah with many qualities such as:

  1. The Prophet Sulaiman (AS) was endowed with the quality of giving sound decision in complicated cases. "And Dawud (David) and Sulaiman (Solomon) when they gave judgement concerning the field, when people's sheep had strayed and browsed therein by night; and We were witnesses to their judgement. And We made Sulaiman to understand (the case); and unto each of them We gave judgement and knowledge." (Quraan 21: 78, 79)
  2. The Prophet Sulaiman (AS) was endowed with special gifts. Wind was made subservient to him and he could easily perform long journey in the twinkling of an eye. The Holy Qur'an affirms: "And (We made) the wind subservient to Sulaiman whereof the morning course was a month's journey and the course a month's journey." (Quraan 54:12) "So We subjected the wind to his power, setting fair by his command withersoever he intended" (Quraan 38:36) "And unto Sulaiman We subdued the wind in its raging. It flows by his order towards the land which We had blessed And of every thing We are aware." (Qurann 21:81)
  3. The Prophet Sulaiman (AS) was gifted with the knowledge of understanding the speech of birds, animals and insects. He was also capable to talk to them. The Holy Qur'an testifies to it in the following Verses: "He (Sulaiman) said: O' People! We have been taught the language of the birds and have been given (abundance) of all things; this is indeed grace manifest (from Allah)." (Quraan 27:16)
  4. He was also given the power over Jinns and Devils. He utilized them in his service. They carried out his orders ungrudgingly and were punished when they became refractory The Holy Qur'an affirms: And to Solomon (We made) the Wind (obedient): Its early morning (stride) was a month's (journey), and its evening (stride) was a month's (journey); and We made a Font of molten brass to flow for him; and there were Jinns that worked in front of him, by the leave of his Lord, and if any of them turned aside from our command, We made him taste of the Penalty of the Blazing Fire. (Quraan 34:12) They worked for him as he desired, (making) arches, images, basons as large as reservoirs, and (cooking) cauldrons fixed (in their places): "Work ye, sons of David, with thanks! but few of My servants are grateful!" (Quraan 34:13)
In another Verse the Holy Qur'an says: "And before Sulaiman were marshalled his hosts--of Jinns, and men and birds and they were all in order and ranks." ( Quraan 21: 17)

It is stated that the Jinns were subjugated to the Prophet Sulaiman (AS) to help him in the construction of the Holy Baitul Muqaddas (Masjid Aqsa).

The Incident of the Queen of Saba:

When the queen got wind of an expected attack of the Prophet Sulaiman (AS) she proceeded towards him to patch up differences. When the King came to know of her departure, he (AS) ordered (not begged at any shrine) one of the Jinns to bring the magnificent throne of the queen in the twinkling of an eye. The command was obeyed immediately. When the queen arrived at the court of Prophet Sulaiman (AS) after a long journey, she was asked to identify her throne. She recognised the throne and said:

"I am already aware of your power and majesty. I have come to you as your submissive servant."

The Holy Qur'an states: "So when she arrived she was asked: Is it your throne? She said: It was just like this and we were given the knowledge before it and we were already submissive and he diverted her from the worship of others besides Allah, for she was Sprung of a people that have no faith." (Quraan 27:42, 27:43)

Again it is very unfair to mention the story of Prophet Sulaiman (AS) in support of performing SHIRK. Prophet Sulaiman (AS) was given that power to bring things himself in the blink of eyes. But he decided to order some of his Jinns to perform this job, who did it as it was expected by them (and they were capable of doing it as per Quraan).
And to Solomon (We made) the Wind (obedient): Its early morning (stride) was a month's (journey), and its evening (stride) was a month's (journey); and We made a Font of molten brass to flow for him; and there were Jinns that worked in front of him, by the leave of his Lord, and if any of them turned aside from our command, We made him taste of the Penalty of the Blazing Fire.(Qur’aan 34:12)

On the other hand, there is no proof from Quraan and Authentic Hadeeths that you can go the grave of dead saint Ali Hajveri (RA) and ask for help. If someone does it he/she is performing SHIRK, the act, for which there is no forgiveness from Allah.

Allah forgiveth not that partners should be set up with Him; but He forgiveth anything else, to whom He pleaseth; to set up partners with Allah is to devise a sin Most heinous indeed.
(Quraan 4:48)

The SHIRK is such a worst sin that all good deeds are wiped out. So as a Muslim we must be very careful before performing any act where there is slightest doubt that it may come under the definition of SHIRK. At the same time those who are stubborn to justify SHIRKIA acts as non-Shirks, should be very careful because if somebody become involved in Shirkia acts just after reading someone’s justification, on the day of judgment they may face consequences. May Allah save our Muslim brothers and sisters from all kind of SHIRKS (Aameen)

Dear Abdul Allah,,

Again, it is very unfair to justify SHIRKIA acts by giving example of Prophet Ya'qub (AS) and his son Prophet Yusuf (AS). Allah conveyed to the Prophet Ibrahim (peace be upon him) glad tidings regarding the birth of elite Prophets, Ishaq and Ya'qub (peace be upon them). The Holy Quran says:

"We gave him Ishaq and Ya'qub. Each of them We made a Prophet. And We gave them of Our mercy and assigned to them a high and true renown." (Surah 19: Verses 49-50)

Qualities of the Prophet Ya'qub

The Prophet Ya'qub (peace be upon him) was the son of Prophet Ishaq (peace be upon him) and his (AS) wife. He (AS) was born at Palestine. He (AS) passed his life exactly in the footsteps of his father and grandfather. He (AS) had full faith in the Oneness of God. He (AS) directed his followers to do good and shun evil. He (AS) advised them to keep up prayer . He (AS) was a man of parts and wisdom. God showered His blessings on him (AS) and his (AS) kith and kin. The Holy Quran affirms:

"And We gave him tidings of the birth of Ishaq, a Prophet of the righteous and We showered Our blessings on him and on Ishaq and of their off-spring are some who do good and some who plainly wrong their own selves." (Surah 37: Verse 113)

Allah bestowed Prophet Ya'ub (AS) and other Prophets with extra ordinary qualities. And some of the qualities were unique to a Prophet. So if Prophet Ya'qub were able to smell his son Prophet Yousuf (AS) because he had extra-ordinary qualities which is proven by Qur'aan, but it does not make the dead saints Ali Hajvairi (RA) or dead saint Khuaja Moeen Chusti (RA) are also capable of such qualities in their graves. Whoever believes that these saints in their graves can listen to you are capable to help you in any way are performing SHIRK, which is worst of all sins and Allah will not forgive SHIRK.

He merges Night into Day, and he merges Day into Night, and he has subjected the sun and the moon (to his Law): each one runs its course for a term appointed. Such is Allah your Lord: to Him belongs all Dominion. And those whom ye invoke besides Him have not the least power. (Quraan 35:13)

If ye invoke them, they will not listen to your call, and if they were to listen, they cannot answer your (prayer). On the Day of Judgment they will reject your "Partnership". and none, (O man!) can tell thee (the Truth) like the One Who is acquainted with all things. (Quraan 35:14)

Those whom they invoke besides Allah create nothing and are themselves created. (Quraan 16: 20)

(They are things) dead, lifeless: nor do they know when they will be raised up. (Quraan 16: 21)

Behold! verily to Allah belong all creatures, in the heavens and on earth. What do they follow who worship as His "partners" other than Allah. They follow nothing but fancy, and they do nothing but lie. (Quraan, 10:66)

Say: "Do ye see what it is ye invoke besides Allah. Show me what it is they have created on earth, or have they a share in the heavens bring me a book (revealed) before this, or any remnant of knowledge (ye may have), if ye are telling the truth! (Quraan, 46:4)

And who is more astray than one who invokes besides Allah, such as will not answer him to the Day of Judgment, and who (in fact) are unconscious of their call (to them)? (Quraan, 46:5)

And when mankind are gathered together (at the Resurrection), they will be hostile to them and reject their worship (altogether)!
(Quraan, 46:6)

Verily it is We Who have revealed the Book to thee in Truth: so serve Allah, offering Him sincere devotion. (Quraan, 39:2)

Is it not to Allah that sincere devotion is due? But those who take for protectors other than Allah (say): "We only serve them in order that they may bring us nearer to Allah." Truly Allah will judge between them in that wherein they differ. But Allah guides not such as are false and ungrateful. (Quraan, 39:3)

Allah says in the Holy Quran Chapter 10 Surah Yunus verse 18:

They serve, besides Allah, things that hurt them not nor profit them, and they say: "These are our intercessors with Allah." Say: "Do ye indeed inform Allah of something He knows not, in the heavens or on earth?- Glory to Him! and far is He above the partners they ascribe (to Him)!" (Quraan, 10:18)

And they have taken (for worship) gods other than Allah, to give them power and glory! (Quraan, 19:81)

Instead, they shall reject their worship, and become adversaries against them.
(Quraan, 19:82)

When those who gave partners to Allah will see their "partners", they will say: "Our Lord! these are our 'partners,' those whom we used to invoke besides Thee." But they will throw back their word at them (and say): "Indeed ye are liars!"
(Quran, 16:86)

That Day shall they (openly) show (their) submission to Allah. and all their inventions shall leave them in the lurch. (Quran, 16:87)

But when He giveth them a goodly child, they ascribe to others a share in the gift they have received: but Allah is exalted high above the partners they ascribe to Him.
(Quraan 7:190)

Do they indeed ascribe to Him as partners things that can create nothing, but are themselves created?
(Quraan 7:191)

No aid can they give them, nor can they aid themselves!
(Quraan 7:192)

If ye call them to guidance, they will not obey: For you it is the same whether ye call them or ye hold your peace!
(Quraan 7:193)

Verily those whom ye call upon besides Allah are servants like unto you: Call upon them, and let them listen to your prayer, if ye are (indeed) truthful! (Quraan 7:194)

Have they feet to walk with? Or hands to lay hold with? Or eyes to see with? Or ears to hear with? Say: "Call your 'god-partners', scheme (your worst) against me, and give me no respite! (Quraan 7:195)

"For my Protector is Allah, Who revealed the Book (from time to time), and He will choose and befriend the righteous. (Quraan 7:196)

That Day shall they (openly) show (their) submission to Allah. and all their inventions shall leave them in the lurch. (Quran, 16:87)

My online answer is enough

but let me add few more points to it.
Allah APPOINT Jin for Hazrat Suleman AS. Yes.
That is what we believe that Allah appoints.
But who was the person who bring it A jin??? NO. a MAN with the knowledge of Scripture and he was not a prophet but he was a beleiver of that time with knowledge of scripture(Not Quran). Read Tafsir Ibn Kathir for that .And Zahir Lihaz sy he was not able to do that but He did.

and no it is not unfair to prove my stance using Quran. bcz i firmly believe that I am not doing shirk. READ MY ONe LINER ANSWER.

ok add my one more point to one liner
They Do it bcz Allah Allows them to help others. they do it with the help of Allah.

The story of Hazrat Yaqub Alihy salam clearly proof that
your point that if one believe that any one hear from a distance is doing Shirk. is WRONG.
your point that He was able to do it bcz Allah give Him that power well. That is what we believe.

You bring Ayath that talk about
"Allah k siwa pukarty hain" well all the Ayath refere to calling them while Taking them as MABOOD. Not just simple "Pukarty hain"

also answer my these Questions.
are you against of asking for Help(not as Mabood) only from those you think are dead?
or you are against of Asking in general?

and do you believe on Sahi hadiths or not??

A short answer according to Quraan:
