Metro bus completion: Delay to cost Punjab, centre Rs2.6 million per day

ISLAMABAD: The Punjab and federal governments will have to suffer Rs2.6 million loss per day if the Rawalpindi-Islamabad Metro Bus Project is not completed by January 31.

On September 10 this year, the Punjab Metrobus Authority (PMA) signed an agreement with a Turkish firm commonly known as Platform Tourism, for operations, management and maintenance of the metro bus project.

It’s the same firm that is running the metro bus operations in Lahore.
A controversial clause, 6.1.21, has been incorporated in the agreement that provides for payment of a guaranteed amount to the firm from a cut-off date, February 1, 2015, if the project is not made functional by that date.
According to the agreement, a fleet of 68 buses will be initially introduced on the track.
PMA has guaranteed the Turkish firm that each bus will travel at least 191.78 kilometers per day while, Rs201.175 will be charged by the operator for every kilometre, as per the agreement.
A cut-off date of January 31 has been agreed by PMA and Platform Tourism for running buses on the metro track, the total length of which is 22.5 kilometres starting from Flashman Hotel in Saddar Rawalpindi to Pakistan Secretariat, Islamabad.
While according to the said clause, irrespective of delay or completion of the project, a guaranteed amount would be paid to the Turkish firm from February 1.
RDA is executing the twin cities’ metro bus project for almost Rs50 billion and if it is unable to handover the project by the extended deadline of January 31, PMA would have to pay Rs2.6 million every passing day to the Turkish firm.

Ozair Shah, general manager operations, PMA, while talking to The Express Tribune, said foreign firms usually make investments after taking loans from international banks and repayment of these loans is not linked with delays or early completion of the projects.
The firm would have to repay the amounts to the bank from a scheduled date.
Shah said if you unnecessarily delay beyond fixed deadlines then you have to pay and it is a logical and acceptable practice.
He said, meanwhile, that another clause had also been included to the agreement under the head of “liquidated damages”. It says, according to Shah, that if the operator fails to bring buses on the road until that day, then they would have to pay penalties to PMA.
He said similar clauses were also incorporated while executing the Lahore Metrobus Project.
He acknowledged the fact that construction of a corridor in the twin cities might face slight delays. However, he added that he could not comment further as he was not overseeing the construction work.
The construction work had already been delayed owing to the sit-ins in the federal capital by PTI and PAT. Several construction firms engaged in the project had sought extension in deadlines.
According to a press statement issued by RDA on Saturday, work on the project will be completed by January 31. However, several officials at RDA, CDA and PMA are of the view that the corridor may be completed by that date but it is ‘near impossible’ to make the buses operational on that route by the said date.

Run down: ‘Punjab leads all provinces in crime’

LAHORE: More than 300,000 street crimes are reported with the Punjab Police each month, Pakistan Awami Tehreek (PAT) has stated in its white paper on the provincial government’s performance after one year of coming in to power.
The paper was released by the PAT Central Secretariat on Sunday. A spokesman for PAT said the data had been compiled from electronic media, print media, national and international publications, regional newspapers, police officers and officers from various departments.
It says that the police registered cases of only 25 per cent of the incidents so that the government could claim that crime had gone down. This year has also seen a spike in incidents of kidnap for ransom, the paper says, 12,245 children were kidnapped this year whereas between 11,000 and 12,000 children were kidnapped the previous year. It says FIRs of 22 per cent of kidnap for ransom cases were not registered. There were 7,000 blind murders and 14 people were killed in acts of sectarian violence, it says.

It records a 22 per cent rise in murder and attempted murder cases compared to last year – 6,000 people were killed and there were 22,000 attempts of murder this year.
The paper says 1,534 attacks on polio workers were reported in the province this year. The figure stood at 1,438 last year. Only 2,402 gang-rape cases were registered with the police whereas 6,100 incidents of gang-rape were reported this year. Last year, 5,160 gang-rapes were reported in media while only 2,269 FIRs had been registered. Half of all cases of domestic violence and crimes against women are not reported, it says.
“Punjab dominates all provinces in the crime graph.”
Police torture
The paper says the Model Town violence on June 17, the Kot Radha Kishen incident on November 4 and the Wagah Border suicide blast on November 2 had brought Pakistan a bad name. It places the onus of responsibility for the incidents on the provincial government. “They exposed the government’s incompetency.”
It accuses the government of hindering investigation into the Model Town violence, which “proves its criminal involvement”.
This year, 25 policemen died in 248 police encounters while 235 suspects were killed in police custody, the paper says.
State of the economy
Chief Minister Shahbaz Sharif, who had promised to “break the begging bowl”, has borrowed Rs850 million this year, the paper says. The mark up for these loans increases each year.
This affects budgets for education, health and other social sectors. “In its seven years in power in the province, the Pakistan Muslim League-Nawaz government has failed to establish a suitable financial management system.”
The paper says that the government’s Sasti Roti programme and mechanical tandoor schemes had adversely affected the Food Department, which had incurred Rs80 billion debts since 2012. The department has to pay a mark up of Rs9 billion each year. “This is why the government has increased the price of wheat flour.”
In order to cosy up to its “blue-eyed” traders, the paper says, the government set aside 0.7 million tonnes of wheat for export.
“The poor have to purchase wheat at exorbitant rates while the grains rot at the government’s stores.”
The PAT has demanded sale of wheat on subsidised rates for poor people and IDPs. Only 17 per cent of the budgets for education and health sectors were released in the first quarter of the financial year. The budget for Rescue-1122 was slashed from Rs1,650 million to Rs1,450 million. This affected the department’s performance. Some of its employees face payment delays, the paper says.
“It is not this government’s priority to save lives… instead it builds roads.”
Deprivation in the south
The white paper says funds allocated for South Punjab have not been utilised and only 25 per cent of the funds have been released so far.
“South Punjab has always been neglected by the government this is why extremism is on the rise in this region.”
Reactions
MPA Zaeem Qadri said the paper was ridiculous and carried baseless stories. He said the PAT should have verified facts before issuing it. “It is a fact that the Punjab has less crime compared to other province,” he said. Similarly, Punjab’s development programmes are unprecedented, he said.
Merit and transparency were the government’s hallmark.

Non-cooperative provinces: In Sindh and Punjab, LG polls not in sight

ISLAMABAD: Despite efforts by the Supreme Court and the Election Commission of Pakistan (ECP), Punjab and Sindh have still not been able to advance on the issue of local government elections. Neither of them can possibly conduct the polls at least for another one year. Already the LG polls are late by more than five years.

A top official of the ECP revealed to The Express Tribune that the two provincial governments were not cooperating with the commission on the delimitation process for LG polls.
Balochistan is still the only province where LG polls were carried out on the intervention of the Supreme Court last year.

The ruling Pakistan Muslim League-Nawaz has been in power in Punjab since 2008 and the main opposition party, Pakistan Peoples Party (PPP), is the ruling party in Sindh province for the last six years.

The apex court earlier had allowed Punjab and Sindh to finalise legislation for authorising the ECP to delimit constituencies for local government elections until October 30.

The development came as the Sindh Assembly passed a law to hand over the powers of delimitation to ECP, while a similar bill was tabled in Punjab Assembly.


A three-judge bench of the apex court, headed by Chief Justice Nasirul Mulk, also sought reports within a month from the ECP and Khyber-Pakhtunkhwa (K-P) government on the steps they have taken for holding LG elections in the province.

At the outset of the hearing, Attorney General Salman Aslam Butt submitted a report before the judges that the federal government has already issued two ordinances empowering the ECP to delimit constituencies for LG polls.


The ECP official said that despite our repeated reminders, these provinces never bothered to reply. “We sought material related to maps and delimitation of boundaries a pre-requisite to announce schedule for local government elections,” he said, adding, “So far the Punjab and the Sindh governments did not make any progress over our request.”

The official said that we are ready to hold elections in Khyber-Pakhtunkhwa province and the commission would hold LG polls in K-P at the end of March or the first week of April 2015.
LG polls would not be possible in Sindh and Punjab for one more year because of non-cooperative conduct of relevant provincial authorities.

This week the ECP issued a reminder letter to the Punjab government regarding the local bodies elections.


According to details, the letter stated that information of delimitation has not been provided to the ECP, he said. “Elections can be deferred due to the negligence of provincial government in processing local bodies’ demarcation,” the official informed.

The commission has also urged the Punjab government to submit details of union councils and wards so that the ECP can analyse them for further procedure.

A bench of the Supreme Court is to take up this case on December 1 and the ECP would inform the court about this situation.


In one of its written replies to the Supreme Court this week on preparations for LG polls in Sindh and Punjab, the commission submitted that in light of the apex court orders the election staff is being trained to carry out electoral delimitation of union councils and wards in Sindh and Punjab.
ECP further said that the training process will conclude in the second week of January 2015.

Child Custody

When dealing with Child Custody courts focus on one thing: The best interest of the children.
When determining child custody, a judge will consider items such as:

    [*=left]Sibling issues. Generally, brothers and sisters will be kept together, but under some circumstances it may be necessary to consider separating them.

    [*=left]Care arrangements before the separation. Who was the primary care giver?

    [*=left]The child’s wishes. The Office of the Children’s Lawyer is often appointed by the court to help in determining the child’s wishes. Once a child turns 12 years of age, his or her wishes to live with one parent or another are usually respected by the courts.


When determining child custody the past behavior of a parent will not be taken into consideration by the courts, unless their behavior reflects directly on the individual’s ability to act as a parent.


Understanding Child Custody:


Many people are confused as to what exactly child custody means as it is also frequently used to indicate a child’s “residence”.

“Custody” means decision making ability.


If you have custody of your children, then you are legally entitled to make all the important decisions regarding your children’s lives.

These are decisions about education, religion, medical treatment, etc. For example, while parents may have “joint custody” (joint decision making ability) the children may actually reside primarily with one parent for most of the time and a child’s residence is determinative of who will be the Payer or Recipient, of child support.


Types of Child Custody :





  • [*=left]Sole Custody – This is when one parent has custody of the children. In this case, the child always resides permanently with the parent having sole custody and the other parent may have access visits.

    [*=left]Joint Custody – This is where both parents have custody. This is also known as joint legal custody. Courts will normally only awards this type of custody to parents who are able to cooperate on parenting matters. While parents may have joint custody, the residency/access arrangements for the children may vary widely.

    [*=left]Shared Custody – This is when both parents have joint custody of the children, and both parents spend at least 40% of the time with their children. This is also known as joint physical custody.
    [*=left]
    [*=left]Split Custody – This is when one parent has custody of some of the children, and the other parent has custody of the remaining children. Courts try to never split up up younger children from their siblings. However, older siblings often choose to live with different parents.
