What I Dont Understand About the Judicial Commission Report




The Judicial Commission report is out and the media is having a field day. Frankly on a personal note I never expected it to be much different than what it is, but then, even I am surprised at the loose ends of the report. There are major gaps and unanswered questions as a consequence of this report.





JC report aside for a moment, i am surprised at the way and manner in which the entire media is blasting PTI and Imran Khan. At the time of the Elections virtually every party had claimed about gross irregularities in the elections. This includes the PMLN and PPP and even the PMLQ, JUI and the ANP. Secondly the media that was in the forefront of proving irregularities in the elections, was suddenly on a reverse and virtually all they had claimed earlier was conveniently forgotten.

I wish some of the media could have had the courage to run telecasts, and clips from their respective election transmissions and also apologise if this is how they feel now. Now everyone I see on screen or virtually everyone that I have come across on television is busy digging the PTI grave. PTI has done many blunders in the last two years and some of them are inexcusable, but their commitment to electoral reforms cannot be doubted. They, besides Jamaat E Islami remain the only political party that conducts elections within their own party unlike the others where top positions are inherited. I Will reflect on that some other time but for the moment lets focus on the Judicial Commission report as this seems to leave many questions unanswered.


  • The JC claims it was not systematic rigging but does acknowledge that extra ballots (Papers) were sent to 149 constituencies. If this is not organised then what else is? If this is not systematic then what else is ? (See page 170-186)
  • 6,802 polling bags were unsealed. However in the eyes of the worthy commission members this is not regular rigging..See page 121
  • 687 Polling bags were missing but they are not considered systematic rigging?
  • Over 20,000 form XVs were missing but this is not systematic rigging. I mean if the form is not crucial and critical then why was it printed in the first place? See page 183
  • We just discovered thanks tot he worthy observations that form XV has no value and did not matter. Thats good news I am amazed though. Why were they printed and made part and parcel of the system if they were redundant? Why are they even a part and parcel of the election procedure then? Why were these forms required to be filled up at all then? See pages 120-121
  • 25 million ballots are unaccounted for but then the commission feels this is not electoral rigging. Thank you kind sirs, really enlightened to discover this.
  • Approximately billions were spent in acquiring the magic ink when it could not have assisted in the verification process as per the NADRA Chief? Obviously this cannot be systematic rigging at all and under any circumstances it will be termed as a usual happening.
  • The statement of the Care Taker Chief Minister of Punjab are on record that power base had shifted to model town around 16 days before the elections and that all bureaucrats were taking direct orders from Raiwind, but for the Honourable Commission it had no significant impact on the electoral results and this is obviously neither planned nor systematic rigging.



  • The statement by the Care Taker CM of Baluchistan that he was powerless and in actual it was the Chief Secretary who ran the show and he could not know what happened as a consequence. Needless to say this is not systematic rigging. page 191-196.
  • When all major political parties claim the elections were rigged, but the honourable JC believes this is not systematic rigging.



  • It seems and I could be wrong but please educate me but in my opinion the Commission failed to exercise the powers conferred by the Ordinance to empower them. The Section 4 of the Ordinance says…” The Commission shall have all powers of a criminal court under CRPC and that of the Civil Courts under CPC..” And the the JC report on page 6 para 9 says, “A Commission of inquiry is not a court of law. As such it is not bound by the usual rules of procedure and evidence which are used and applied in such circumstances and evidence which are used and applied in such courts.Whether adjudicating on Civil or Criminal matters…”
  • Sadly this only means one thing that the Judicial Commission itself deviated from the true spirit of the Ordinance and its Provisions thereto, being mandatory for them.


I can recall the famous words of Quaid E Azam when he was given the map of Pakistan to approve by Lord Mountbatten. He uttered a famous line, “I accept but I do not agree”. Imran Khan in the footsteps of the Quaid has accepted but without speaking to him I can be sure he does not agree with the findings of the commission.


This report has also failed to identify any grey areas that could have made elections better and more transparent in the future. Whilst PTI is taking most of the brunt as a consequence I personally feel in the days to come the honourable Judiciary will be under severe pressure to justify to the nation that it did justice to their mandate. That despite so many irregularities as pointed out by themselves they failed to take any notice or offer any remedies as a solution.





Meanwhile some PMLN office bearers are jubilant and excited. They claim that for two years PTI had halted the economic progress of the country with their Dharna and agitation politics. I wish today the same media could run their previous footage as well when all including the Prime Minister had claimed the Dharna was of no consequence and did not halt their record breaking progress.
In the name of public mandate we just saw how the biggest theft in the history of the country has been legitimised and all beneficiaries are jubilant about this fact.
This may not be systematic rigging as the Honourable JC claims, but is this not systematic murder of the public Mandate Honourable Sirs???


On a personal note may i ask whatever happened to the Commission Report of Justice Baqir Nadjfi on Model Town Massacre?? Why has that not been made available yet after almost a year and this report before even reaching the hands of the claimant Imran Khan was with everyone in the media? Who in this country is responsible for this terrible leak???
