I am not a very big fan of Chief sb but have to see things in perspective keeping in mind the space and limitations one has to work within.
There are two types of powers: De jure and de facto. Any court in any country has only the former. Implementation of decisions is the responsibility of the administration. You may remember that Army posturing in which it indicated that it would not help court in implementing its decision, rather it would obey the govt (administration). So, all your grievances against CJ should rest if viewed in the light of that fact.
Second thing is process. It could be legal, administrative, Business or industrial. This process terminology is very important. The process has to work or to be followed within the defined mechanism/system. Good processes produce good results and bad processes produce bad results and making a process is not the court's responsibility.
Then there is trend setting......thing that have never been done before. Pak represent a deep state commonly called establishment, nurtured and strengthened during last 60 years and in that deep state judiciary was just a tissue paper.
To me the highlights of this CJ tenure were his decisions in ISI money distribution case, holding Mush for abrogation of constitution on 3 Nov 2007 and clear decision for his prosecution and forbidding any judge from legitimizing any coup in future, preempting the 3 Nov emergency declaration and a nagging persistence in missing persons' case. These cases has far reaching implications for our future as a country and civilized stated.
If somebody could only implement the ISI case decision, 75% of filth would be cleaned out of the present system and it was not his responsibility to implement it. We have all seen that what happened to the implementation of NRO decision. So, it is all PROCESS my friend and in a country like Pak it becomes very easy for crooks like Sharifs and Zardari to play with the process.
His worst failure is not to do anything for the lower judiciary, granting stay to Showbaz Mediocre Sharif in his disqualification case as an MPA and keep sitting on it for whole 4 and half years, and conniving/closing his eyes over a stolen election.
