اس قسم کے واقعات ازمنہ قدیم کی بادشاہتوں میں جا بجا بکھرے نظرآتے ہیں،جب قوم کو قابو کرنے ایسے بہادر قاضی اپائینٹ کئے جاتے تھے جو بادشاہ سے بھی نہیں ڈرتے تھے،اور وقت پڑے پر بڑے سے بڑے اہلکار کو عدالت میں طلب کرلیتے تھے،مقدمات چلتے تھے،پیشیاں طویل سے طویل ہوتی جاتی تھیں،اور قانونی موشگافیوں میں،مدعی اور مقدمہ دونوں دفن ہوجاتے تھے،
ایسے قاضی آج بھی تاریخ کے اوراق میں اپنا جبہ قبہ لہراتے نظر آتے ہیں،اور قوم آج بھی انصاف کے لئے دربدر پھرتی نظر آتی ہے،

میں موجودہ حالات کو زیادہ نہیں سمجھتا،اس لئیے اس پر بحث بھی نہیں کر سکتا،،آپ کا کیا خیال ہے،آج کل کی تراکیب جہانبانی کے متعلق؟

I am not a very big fan of Chief sb but have to see things in perspective keeping in mind the space and limitations one has to work within.

There are two types of powers: De jure and de facto. Any court in any country has only the former. Implementation of decisions is the responsibility of the administration. You may remember that Army posturing in which it indicated that it would not help court in implementing its decision, rather it would obey the govt (administration). So, all your grievances against CJ should rest if viewed in the light of that fact.

Second thing is process. It could be legal, administrative, Business or industrial. This process terminology is very important. The process has to work or to be followed within the defined mechanism/system. Good processes produce good results and bad processes produce bad results and making a process is not the court's responsibility.

Then there is trend setting......thing that have never been done before. Pak represent a deep state commonly called establishment, nurtured and strengthened during last 60 years and in that deep state judiciary was just a tissue paper.

To me the highlights of this CJ tenure were his decisions in ISI money distribution case, holding Mush for abrogation of constitution on 3 Nov 2007 and clear decision for his prosecution and forbidding any judge from legitimizing any coup in future, preempting the 3 Nov emergency declaration and a nagging persistence in missing persons' case. These cases has far reaching implications for our future as a country and civilized stated.

If somebody could only implement the ISI case decision, 75% of filth would be cleaned out of the present system and it was not his responsibility to implement it. We have all seen that what happened to the implementation of NRO decision. So, it is all PROCESS my friend and in a country like Pak it becomes very easy for crooks like Sharifs and Zardari to play with the process.

His worst failure is not to do anything for the lower judiciary, granting stay to Showbaz Mediocre Sharif in his disqualification case as an MPA and keep sitting on it for whole 4 and half years, and conniving/closing his eyes over a stolen election.

I perfectly understand your frustration and bitterness. But my friend deep state needs a systematic treatment to undo/correct it.........it is beyond.....much bigger, much larger than.......the capacity and efforts of a single man of mixed character with a fixed tenure post.......he was not a God sent reformer to cleanse the system and society to rid of all evils..........in some cases even prophet could not successfully complete their missions.....but for only our beloved prophet....final prophet........Muhammadpbuh who were specially chosen to do such a job........so we need to be a bit realistic in our expectations...

I have already given my detailed opinion about him on this thread which says I am not a big fan of him, but like all of us, he had a tenured post with a limited time and had to pick his fights (as focus of his energies) which everybody can dispute. I also do.

I have often pondered over Why do we want to see things only in black and white, while in human interactions things are rarely black or white? Why do we have low tolerance or acceptance for grey which is often the case in life situations?

Perhaps it is our hero worship or is it the dearth of heroes or our never ending wait for a Messiah? Perhaps we have been raised and trained in our education system that way...Messiah would never come at least for Pakis.....and we have to correct our own affairs thru an incremental process

What we need to learn and recognize that social and administrative systems in any polity do not change overnight or cant be changed by a single person. People play their good or bad role and vanish. It is on us that we make a fair assessment and continue and improve upon the good, and discontinue and correct the bad.

I want to ask to all who are interested in this topic, With hand on hear, how many like CJ Iftikhar we have had in our 67 years history? Give the man a fair assessment! At least we owe this to him.....

Please merge the two options poor and biased, it is just a division of votes, It could/should be biased(poor) option instead of two separate options. Some people might be in confusion that which is the worst of the two so may be they decided on the basis of that.
