Now that the Speaker and Deputy Speaker have resigned, then unless their resignation is accepted, can anyone else, whom the Speaker has nominated can exercise his powers as a Delegate?
This is provided in Article 53 of the Constitution:
According to the Article 53, Section 1, read with Section 7(a), whenever the Speaker resigns, the office becomes vacant and the void can only be filled in by electing a new speaker in the house through a vote.
Is it justified that the speaker on his way out hand over his powers to someone he deems fit? Constitutionally, NO!
Now, lets see, how the custodians of the Constitution (aka the SC) take this vote according for its legitimacy and validity.
