LAHORE: The Lahore High Court (LHC) on Thursday restrained President Asif Ali Zardari from holding political activities, Geo News reported.

A full bench of the Lahore High Court on 10 Mar 2011 had reserved the judgment on several petitions challenging holding of dual office by President Asif Ali Zardari, after leading counsel for petitioners in the case concluded his arguments. It may be noted that different benches of the high court have been hearing these petitions since 2009.

In its verdict spread over 33 pages, the court said political activities cannot be held in the Presidency. The order said that the president was not supposed to perform political activities and was bound to be impartial, quoting several cases.

Initially, a legal panel of the federation, comprising Talib H Rizvi, S.M. Masood, Saiful Malook and Ramzan Chaudhry, had contested the petitions, however they had boycotted proceedings afterwards, expressing their dissatisfaction after the court had refused to hear the federation's objection petition first.

Later, the incumbent bench headed by Chief Justice Ijaz Ahmad Chaudhry had started ex-parte (one sided) proceedings on the petitions. However, the bench had appointed two senior constitutional experts, Abid Hassan Manto and S.M Zafar, as amicus curie (friend of court) to seek independent point of view from the constitution.

On March 10, petitioner's counsel A.K. Dogar in his concluding arguments reiterated that President Zardari’s act of holding political office was in clear violation of article 41 (1) of the constitution. He asserted that the president, being head of the state, could not hold an office of a political party.

Dogar said Asif Ali Zardari was holding the office of Pakistan People’s Party co-chairperson along with the office of President of Pakistan, making the President House a hub of political activities.

He prayed that President Asif Ali Zardari be directed to surrender the office of Pakistan Peoples Party co-chairperson.

Constitution allows president to take part in politics: Awan

ISLAMABAD: Former Law Minister Babar Awan said Thursday that under the Constitution, president of the country is allowed to take part in national politics as being part of the Parliament.
According to Article 50 of the Constitution, the president of the country can take part in the politics and as per clause-II of the same article Parliament consists of three components including National Assembly, Senate and President.
The former law minister was commenting on the verdict of Lahore High Court ordering President Asif Ali Zardari to quit one of his two offices either presidency or the Co-chairmanship of the Pakistan Peoples Party.
Babar Awan said according to 1973 Constitution, there was no restriction on president for taking part in politics.
He was of the view before restricting president to take part in politics, we have to bring out president from the definition of citizenship as constitutionally, every citizen has right to become member of any political party.
He said some elements are unhappy as in present circumstances they feel difficult to use presidency for unconstitutional act to fulfill their nefarious designs.
The elements that have objection on the presidents political character, should wait till the next elections, said Babar Awan.
He said unfortunately since 1970, not a single Assembly entered its fourth parliamentary year as president used to dissolve it using his powers bestowed on him under 58-2B of the then constitution.
However, the former law minister said the PPP cannot be pressured as people of Pakistan have given it mandate and they are the real strength.
If the Prime Minister, Chief Ministers of the provinces and its electoral collage meet with President, would it be called politics, he questioned.
To a question, Awan said US Senator John Kerry is schedule to reach Pakistan and questioned is his meeting with President would be also named as politics.
Babar Awan said the governments legal team would answer to questions after going through the detailed judgment.
He said the country was passing through difficult circumstances so national issues should be taken seriously.
To another question, Awan said after becoming president, Farooq Laghari had resigned from the party membership on his own as he was not bound to do so under the constitution.

President is allowed to conduct Political activities in the President House only in the copy of the constitution at Babar Awan's house.[hilar]

Otherwise, according to the constitutional experts President is not allowed. They have the true copy of the constitution.:lol:

Fantastic, the people who have spent their lives to uphold the law that do not know the constitution.[hilar] just because he is ex-law minister, he did PhD (phasaddi doctrate) In-law.:)

LAHORE: Pakistan Peoples Party General Secretary Jahangir Badar has said the PPP legal team will challenge the decision of the Lahore High Court on two offices of the president.
Addressing a press conference at Lahore Press Club here on Saturday, he said the PPP respected courts and did not want to pressurise them, adding it just sought justice from the judiciary.
He said the office of the president was a symbol of the federation and all provinces would be affected if the president was banned from participating in political activities.
Badar said the PPP had never targeted any institution but it was always targeted, adding that it was the basic right of every citizen to discuss any decision which affected him.
He said the PPP was the largest political party of the country and its workers had to face several tests and trials, adding the party now knew how to protect its leadership as it had sacrificed hundreds of its workers and leaders including Zulfikar Ali Bhutto Shaheed and Mohtarma Benazir Bhutto Shaheed.
To a question, he said that it was unfortune that almost all decisions of courts against the PPP had connection with Sindh province.
He said that it was also a perception that almost all court decisions in political cases were against the PPP which had contributed the most to the restoration of the judiciary and democracy.
He said that presidents of all the countries came to power through a political process and with the support of a political party.
Badar remarked that all former presidents of the country including Ziaul Haq, Ayub Khan, Ghulam Ishaq Khan, Farooq Leghari and Pervaiz Musharraf participated in politics during their presidential period but no decision was made against them.
He said that President Asif Ali Zardari was not in the country and such a decision in his absence was not in national interest.
He said the PPP had not yet decided to protest against the decision but some local organisations were protesting on their own.
