Rambo goes home

by Eric S. Margolis

THE US government has decided Islamic syariah law is not so bad after all at least not in the case of jailed CIA agent Raymond Davis.
The burly Davis, an ex-US Special Forces soldier, former Blackwater gunman and now CIA "contractor" (jargon for mercenary) was jailed in Pakistan after shooting dead two Pakistanis, who were either robbers or government security agents. A third Pakistani was killed by a car driven by a CIA rescuer racing up a one-way street the wrong way.

Pakistanis were outraged, but their weak government, which subsists on US$3 billion (RM9 billion) of annual US aid, caved in to its American patrons. After weeks of intense negotiations over US claims that Davis had diplomatic cover, some US$2.3 million (RM6.9 million) or more "diyaa," or blood money, was paid to the grieving families of Daviss victims. Case closed.

The CIAs man in Islamabad was rushed out of Pakistan to a US base in Afghanistan. US Secretary of State Hillary Clinton, who has become as adept at bending the truth as her hubby Bill, stoutly denied Washington had paid any money to get Davis released.

She was technically right. The Zardari regime in Islamabad paid off the families after strong-arming them to accept the sleazy deal. Washington will pay Islamabad back.

According to sources in Washington, the "diyaa" ploy was the brainchild of Pakistans ambassador to the US, Husain Haqqani, which my old friend denies. He is widely known as the smartest ambassador in Washington.

Very diplomatic, very clever. The Davis crisis is over at least in Washington. But not in Pakistan, where public fury over Islamabads crass sellout is boiling.

The Davis case will confirm the growing belief among most Pakistanis that their nation has been de facto occupied by the United States as part of its war in Afghanistan. What else could they conclude when American Rambos and spies run amok in Pakistan and US Predator drones pound its northwest frontier? Or as they watch Pakistans once proud soldiers, now turned sepoys of the new Raj, stand at attention to receive Pentagon orders.

Even the unloved former president, Pervez Musharraf, claims right after 9/11, Washington "put a gun to our head" and told him to either accept US semi-occupation of Pakistan or be bombed back to the Stone Age. This meant US use of Pakistans major ports, depots, key airfields, radar sites, intelligence service (ISI), security police and 120,000 troops.

Senior military and intelligence officers deemed insufficiently pro-American or Islamist were purged, among them many of the armys ablest officers.

A decade later, polls show most Pakistanis believe the US is continuing to take over Pakistan and aims to get control of their nations dispersed nuclear arsenal.

At the same time, Pakistan is increasingly becoming a free-fire zone for US gunslingers and CIA hit teams. The Zardari government in Islamabad, well lubricated by secret US "black" payments and stipends, raises few objections.

CIA harbours deep mistrust of Pakistans intelligence service, ISI, because it still puts Pakistans strategic interests ahead of those of the US.

The Davis affair is very unfortunate for the United States. At a time when Washington is preaching democracy and rule of law to the Arab world, it is seen in Pakistan to be crassly violating norms of law and diplomacy, simply bribing its way out of trouble with Pakistani politicians and officials.

This behaviour further undermines the feeble Zardari regime, the house of cards on which the US-led Afghan War rests. Nor did it help last week in Washington when US Afghan commander, Gen David Petraeus, asserted there were less than 100 Al Qaeda in Afghanistan.

CIA chief Leon Panetta had previously told the US Congress there were no more than 50 Al Qaeda types left in Afghanistan. So why, one wonders, are there 110,000 US troops and another 40,000 Nato troops there? Could it be some other reason?

Davis should never have been allowed to Rambo around Islamabad, armed and dangerous, in a cowboy shirt. Who is running US policy in Pakistan?

Davis release: 'Victim's family hiding in Pakistan'
Published: April 2, 2011

Faheem's elder brother says that family accepted the blood-money for the sake of Pakistan.
The family of Faheem Shamshad, who was killed by CIA contractor Raymond Davis in January, is reported to be residing in their hometown near Toba Tek Singh, dispelling earlier speculations that the family had moved to the United States or Saudi Arabia.
The family is considering buying a permanent house in their hometown and has already started searching for bargains.
Earlier, media reports had quoted Faheem’s elder brother as saying that the United States was not directly involved in the blood-money deal and the family was under no pressure to sign the agreement.
He was quoted by a local newspaper as saying that the family accepted the money after weighing the pros and cons of the case and it was done for the sake of Pakistan.
He also said that the family is hiding at an undisclosed location due to security concerns.
On Friday, Lahore High Court ordered the Punjab government to submit a report about the whereabouts of the families.
The families of victims Faizan and Faheem had gone into hiding after receiving Rs200 million as ‘blood money’ for the release of Davis, who was also paid Rs20,000 as fine for carrying an illegal weapon.
While the compensation amount was paid, US Secretary of State Hillary Clinton has denied that the American government had paid anything. US admission of having paid compensation would have confirmed that Davis was, after all, not entitled to immunity and was not a diplomat – which would have gone against Washington’s uncompromising stance on the issue that had been reiterated by even President Barack Obama himself.

Davis’s release reply sought from federal, Punjab governments
Published: March 30, 2011

CDGL says the land belongs to Punjab govt, stay order has lapsed.
LAHORE:
The Lahore High Court (LHC) on Tuesday sought replies from the federal and provincial governments on a petition seeking an explanation from the Federal Law Minister, Babar Awan, Chief Minister Shahbaz Sharif, Additional District and Sessions Judge Muhammad Yousaf Aujla and others for allegedly facilitating Raymond Davis’s release.
The petitioner, Advocate Javed Iqbal Jafree, said that the LHC had issued orders to put Davis’s name on the exit control list (ECL), which was also violated by the respondents. The petitioner requested the court to seek affidavits from the aforementioned officials as well as Federal Law Secretary Pir Masood Chishti and lawyers Zahid Hussain Bukhari and Raja Irshad if they had prior knowledge about the deal. Barrister Jaffree said that the LHC order of putting Davis’s name on the ECL was still in place. He said the government had not asked the LHC for its permission before making the release. The petitioner said that Davis was allowed to leave the country in violation of the court order. Justice Chaudhry Iftikhar Hussain adjourned further proceedings for March 31.

Lawyers harass Davis case judge

Lawyers vandalise judge’s nameplate, vow to force his transfer.
LAHORE:
Muhammad Yousaf Aujla, the additional district and sessions judge who handled the diyat case of Raymond Davis, faces harassment from lawyers angry at his role in the release of the American CIA contractor, The Express Tribune has learnt.
A group of lawyers gathered outside his courtroom last Thursday and chanted slogans against the judge. They also vandalised the sign bearing his name at the entrance to the courtroom, pasting ‘American Court of Injustice’ and ‘Justice Seller’ on the name plate.
“We have sent him a message that we haven’t forgotten his decision against the country,” said one of the lawyers involved in the action, speaking on condition of anonymity.
Some members of the Lahore Bar Association (LBA) said they would not allow the “pro-American” judge to continue in his post. “We will start a movement to force his transfer, like we did before with the sessions judge,” one lawyer said, referring to Judge Zawar Hussain, who was transferred from the post of Lahore district and sessions judge after protests by lawyers.
Aujla appeared to have expected an angry reaction from some lawyers. He went on leave for three days after Davis was released on March 16, a court staffer said. Before returning, he called up the staffer three times to ask the mood among lawyers concerning Davis’ release. The staffer told him that the reaction was subdued.
Chanting lawyers
The staffer said that last Thursday, the judge was hearing a murder case when the group of lawyers approached the court. Hearing them chant slogans outside, the judge slipped away into his retiring room.
“They never came inside,” the staffer said.
However, they did glue a piece of paper to the judge’s nameplate making plain what they thought of his handling of the Davis case.
The staffer said that they did not notice the vandalism until a few hours later when it was pointed out by staffers from another courtroom. They then removed it, though traces of the white paper stuck to the sign remain.
LBA president Shehzad Hassan Shaikh said that he was unaware of the incident, but if one of the association’s members was involved in Thursday’s protest, the LBA would investigate.
Aujla is in the process of being investigated by a Member of the Inspection Team of the LHC after a complaint was received about him. The Supreme Court has also sought a copy of the report. Several petitions are pending in the LHC questioning the proceedings in the Davis case.

Nisar asks PM to form body on Davis case

ISLAMABAD: Opposition Leader in National Assembly Chaudhry Nisar Monday questioned as to why extensions in service were granted to those who tried to hush up the Raymond Davis episode, Geo News reported.

In his address during the National Assembly session, Ch Nisar urged the Prime Minister to take the house in confidence on the Raymond Davis issue and that he would give a nod if the latter forms a parliamentary in this regard.

The issue of Raymond Davis was the most important one but the president did utter even a single word on it, he regretted.

On reopening of Zulfiqar Ali Bhuttos case, he said no legal expert had described the decision of going for reopening of the case after a lapse of 31 years as a correct one.

He said 99.9 per cent people feel that sending ZAB to gallows was unjust and the one who celebrated this incident by distributing sweets and for whatever he kept on writing and saying should seek forgiveness from Bhuttos soul, Pakistan nation and PPP jiyalas.

The Opposition leader NA said misinterpretation was being noticed in Benazir murder case.

He said he holds the armed forces in high esteem but would never allow them to play any role that is beyond the safeguarding of borders.

Govt had been directed to include Davis name on ECL.

LAHORE:
The Lahore High Court on Friday once again issued notices to the federal and Punjab governments for April 26, on a petition challenging the removal of Raymond Davis name from the Exit Control List (ECL), allegedly, without obtaining the consent of the LHC which had earlier ordered it.
Barrister Javed Iqbal Jaffree filed the petition requesting the court to seek an explanation from the federal law ministry, Chief Minister Punjab Shahbaz Sharif, Additional District and Sessions Judge Muhammad Yousaf Aujla and others, for allowing Davis to leave the country despite the LHCs restraining orders.
He submitted that the LHC had directed the government to include the name of Raymond Allen Davis in the ECL and that the court was assured by a law officer and the concerned ministry that the same had been implemented.
The petitioner submitted that upon Davis release, the LHC order was in place as the court had not suspended or withdrawn its order.
The petitioner contended that in violation of the courts orders, Davis was allowed to leave the country. However, the Punjab chief minister claimed that he was not aware of all these developments, he said.

Probably I am not aware of:
1-The jail authority works under provincial govt?
2-Shahbaz sharif did n't resist, if he knew the arrangements being done by fed. govt?
3-He flew out a night before, why?

Can anyone answer these please?

We have no right to celebrate independence because we are still a slave and we take dictations from our lord America for every single issue in the country. As Raymond had allegations of double murdering and his act was strongly condemned by the whole nation, he was set freed. Imagine the intensity of heat and grief on the sad incident that wife of a victim committed suicide out of feelings of helplessness and despair from the justice delivering faction of the society. Religious groups and political parties pushed the families of victim to accept blood money referring it as a shariah law. At last but not least it was proven that money can buy you anything even pardon. It is shame for the whole nation that we have no dignity but compromises in life .we pardoned Raymond Davis for three lives but could not manage a pardon for Aafia for just attempt to attack on Nato officer. Shame, woe and curse many times on all of us for being sold out for dollars and humble slaves of America.
Another victim of Raymond Davis found in a posh area of Lahore
