Azfar claimed that he was receiving threats and should be allowed to quit the case.


During the hearing of the NRO review petition in the Supreme Court, the counsel for the federation, Kamal Azfar, disclosed on Thursday that Advocate Abu Bakar Zardari had threatened him to stay away from the NRO case.

He said that Zardari had hurled the threats in a telephonic conversation with his wife, Naheedah Jaffery.

Chief Justice of Pakistan Iftikhar Muhammad Chaudhry remarked that the alleged threats were a hurdle in the judicial process.

Justice Jawad S Khawaja remarked that Azfar was receiving threats today, but he (Justice Khawaja) could also face threats. The judges will have to pack and leave if the threats are not taken seriously, he said.

The CJP summoned Islamabad Inspector General of Police Wajid Durrani and ordered him to investigate the matter and submit a report with the court registrar within in three days. He also allowed Azfar to leave the case.

On the other hand, Zardari denied hurling any threat to Kamal Azfar.

The Supreme Court (SC) has permitted the separation of Kamal Azfar, counsel of the federation, from the ongoing hearing of the National Reconciliation Order (NRO) review case here on Thursday.

According to details, Kamal Azfar wrote a letter to the Chief Justice Supreme Court Iftikhar Chaudhry, claiming Advocate Abu Bakar Zardari had threatened and forbade him to appear in court for the hearing of the NRO review case.

Although Advocate Zardari rejected the allegation, the apex court took notice of the letter and asked IG police to provide security to Mr Azfar. In the letter Azfar claimed that the advocate threatened his wife.
Earlier on April 11, the Supreme Court rejected the government’s request to change its senior counsel, Kamal Azfar, in the NRO review petition and adjourned the hearing till the following day.

The apex court ordered former Attorney General Malik Abdul Qayyum, former NAB Chairman Naveed Ahsan and Danishwar Malik to appear before court.
The Chief Justice of the SC Justice Iftikhar Mohammad Chaudhry, head of the 17-member bench, said in his remarks that the court had not been provided with complete records of the NRO case.

چیف جسٹس نے ایڈیشنل اٹارنی جنرل کو مخاطب کرتے ہوئے کہا کہ وہ اصل مقدمے میں موجود تھے اور کمال اظفر کے علیحدہ ہونےکے بعد اب وہ دلائل دیں


سپریم کورٹ نے قومی مصالحتی آرڈیننس یعنی این آر او نظر ثانی کیس کی پیروی سے حکومتی وکیل کو الگ کردیا ہے۔
یہ حکم سرکاری وکیل کمال اظفر کی درخواست پر دیا گیا جس میں اُنہوں نے موقف اختیار کیا تھا کہ اُنہیں سندھ ہائی کورٹ کے ایک وکیل ابوبکر زرداری کی طرف سے دھمکیاں مل رہی ہیں کہ وہ اس مقدمے کی پیروی نہ کریں ورنہ اُنہیں اور اُن کے اہلخانہ کو جان کا خطرہ ہے۔
چیف جسٹس افتخار محمد چوہدری کی سربراہی میں سپریم کورٹ کے سترہ رکنی بینچ نے این آر او سے متعلق عدالتی فیصلے کے خلاف حکومت کی طرف سے دائر کی جانے والی نظر ثانی کی درخواست کی سماعت کی۔
حکومتی وکیل کمال اظفر نے عدالت کو بتایا کہ اُنہیں دھمکیاں دی جار ہی ہیں جس پر عدالت نے اسلام آباد پولیس کے سربراہ کو عدالت میں طلب کیا اور اُنہیں اس معاملے کی تحقیقات کرکے تین روز میں رپورٹ عدالت میں پیش کرنے کا حکم دیا۔
سرکاری وکیل کا کہنا تھا کہ اس حالات میں وہ اس مقدمے کی پیروی نہیں کرسکتے۔ اُنہوں نے کہا کہ ایسا محسوس ہوتا ہے کہ حکومت اس درخواست پر میرٹ پر فیصلہ نہیں چاہتی اور چاہتی ہے کہ عدالت اس درخواست کو تکنیکی بنیادوں پر نمٹا دے۔
ایڈیشنل اٹارنی جنرل کے کے آغا نے عدالت کو بتایا کہ اگر کمال اظفر کو حکومت پر اعتماد نہیں ہے تو حکومت کو بھی کمال اظفر پر اعتماد نہیں ہے۔ اُنہوں نے کہا کہ اس سے پہلے ہی حکومت نے کمال اظفر کی جگہ سردار لطیف کھوسہ کو سرکاری وکیل تعینات کیا گیا تھا۔
چیف جسٹس نے ایڈیشنل اٹارنی جنرل کو مخاطب کرتے ہوئے کہا کہ وہ اصل مقدمے میں موجود تھے اور کمال اظفر کے علیحدہ ہونے کے بعد وہ اس ضمن میں دلائل دیں۔ اُنہوں نے کہا کہ وہ جس کو چاہیں اپنا معاون مقرر کرلیں عدالت اُسے بھی سُنے گی لیکن عدالت نئے قونصل کی اجازت نہیں دے گی۔
کے کے آغا کا کہنا تھا کہ اُنہیں اس حوالے سے حکومت کی طرف سے کوئی واضح ہدایات نہیں ملیں۔

چیف جسٹس نے کہا کہ عدالت اس مقدمے میں لچک کا مظاہرہ کرتے ہوئے حکومت کو بہت وقت دے رہی ہے۔ اُنہوں نے کہا کہ عدالت اس مقدمے کو تکنیکی بنیادوں پر نہیں نمٹائے گی بلکہ اس مقدمے کا فیصلہ میرٹ پر کیا جائے گا۔
بینچ میں شامل جسٹس آصف سعید کھوسہ نے اٹارنی جنرل کو مخاطب کرتے ہوئے کہا کہ حکومت کو اُن پر اعتماد کرنا چاہیے جس پر کے کے آغا کا کا کہنا تھا کہ آج تک تو حکومت کو اعتماد ہے ہوسکتا ہے کہ کل اُنہیں اُن کے عہدے سے ہٹا دیا جائے۔
چیف جسٹس نے ایڈشنل اٹارنی جنرل سے کہا کہ وہ تیاری کرکے آئیں اور وہ اس درخواست پر دلائل دیں۔ عدالت نے نظرثانی مقدمے کی سماعت اٹھارہ اپریل تک کے لیے ملتوی کردی۔

Govt seeks disciplinary action against Azfar
The federal government writes to PBC to take disciplinary action against Kamal Azfar.


The federal government has sent an application to the Pakistan Bar Council (PBC) to take disciplinary action against former federal government lawyer Kamal Azfar.


The government has blamed Azfar for misusing his authority and leveling charges against the federal government of giving him (Azfar) life threats.

The application said that the government had to face humiliation in the Supreme Court. The government requested the PBC to take disciplinary action against Azfar for being dishonest with his profession.
