Why Madarsa Moulvis are involved in child abuse

Few days back I posted following under the topic "Why Madarsa Moulvis are involved in child abuse" , on siasat.pk:

Following are some of fatwas taken from the books such as Dar Mukhtar, Chalpi shara Wiqayah, Fatawa e Alamgir. Hidayah, Fatawa Khaniya misr etc., these books are part of Madarasa syllabus. Anybody who wants to complete Aalim Fazil program has to go through above listed books. Following are some fatawas from these books.

Although these fatwas has no support from Qur'an and Hadeeth but since the above listed books are part of the Aalim Fazil course in most of the Pakistani madarasas, every so called Aalim has to go through these listed below Fatwas.

1 – Is someone pays a woman to do zina [adultery] , there is no hadd [no punishment] ( Dar Mukhtar, kitab Hudud, fatawa khaniyah misr vol 3 p 508, kanz daqaiq ed deoband p 180, and this fatwa is attributed to Imam Abu Hanifa while his two students say there is hadd [Adultery Law]. It is well known that the hanafi books of fiqh there is no Chain of Narration [isnad] to their Imam)

2 – The salary of the prostitute is halal [lawful] (Chalpi shara Wiqayah)

3 – If he pays a woman to do zina or wati [Adultery or Intercourse] or if he says I will give you so much dirham or she says give me so much, there is no had [no punishment under Adultery Law] (Alamgiri, vol 2 p 168)

4 – If someone does jima [intercourse] with an animal or with a dead or a young girl (underage girl) and there is no inzal [ejaculation] , then ghusl [bathe] is not wajib [obligatory] (Dar Mukhtar Kitab taharah, masail ghusl, aussi Alamgiri, Kitab taharah)

5 – If someone does sodomy with a woman who fasts or a man who fasts, their fast is not broken (Hidayah, Kitab Sawm)

6 – If a young boy of 10 does Jima [intercourse] with a balighah [adult] Woman, there is no Ghusl [bathe]( Alamgiri Kitab taharah)

7 – If someone enters his penis in his dubur (anus), then ghusl is not obligatory (Dar Mukhtar Kitab taharah Masail Ghusl)

8 – If a man in his dubur [anus] or a woman in her vagina enters the penis of the dead, or his finger, or wood, there is no ghusl [bathe] (Hidayah Kitab Taharah)

9 – If someone enters the penis of an animal in her vagina or dubur [anus], the ghusl [bathe] is not wajib [obligatory] (Dar Mukhtar Kitab Taharah Masail Ghusl)

10 – If someone enters the penis of a boy without desire in her vagina or dubur [anus], the ghusl [bathe] is not wajib [obligatory] (Dar Mukhtar Kitab taharah Masail Ghusl)

11 – After doing Jima [Intercourse] with a young girl (underage girl), it is not necessary to clean his penis (Dar Mukhtar Kitab taharah Masail Ghusl)

12 – If someone does jima [intercourse] with a virgin and the maidenhead is not broken, ghusl [bathe] is not wajib [obligatory] (Dar Mukhtar Kitab taharah Masail Ghusl)

13 – If someone does wati [intercourse] in the dubur [have anal sex or
commit bestiality] of an animal or in his anus and there is no inzal, then Ghusl [bathe] is not wajib [obligatory] (Hidayah kitab taharah)

14 – If the balighah woman [adult woman] does wati [intercourse] with a young boy or with a crazy, then the woman has no hadd [Punishment for Adultery] (Dar Mukhtar Kitab hudud)

15 – If someone does wati [intercourse] with a non balighah woman [non adult woman], or with a dead or an animal, there is no hadd [punishment] (Dar Mukhtar Kitab hudud)

16 – If someone does zina [adultery] with the salve of his child or great child, there is no hadd (Dar Mukhtar Kitab hudud)

17 – If someone does zina [adultery] with the slave of grand father or grand mother, there is no Hadd [Punishment for Adultery](Dar Mukhtar Kitab hudud)

18 – If someone has a slave in rahn (security for loan) and he does zina [adultery], there is no hadd [Punishment for Adultery] (Dar Mukhtar Kitab hudud)

19 – If someone does nikah [Marriage] with a mahram [sister, mother or daughter or real blood aunt] for ever woman and consider it halal [lawful], there is no hadd [Punishment for Adultery] (Dar Mukhtar Kitab hudud)

20 – The woman that are for ever forbidden, and he does nikah and he even if he considers that haram [Unlawful] , there is no hadd [Punishment for Adultery] (Dar Mukhtar Kitab hudud, et Alamgiri who attribute that to Imam Abu Hanifa)

21 – If he does nikah [marriage] with a woman and joins in nikah his wife’s sister or mother, there is no hadd [Punishment for Adultery] (Alamgiri)

22 – If he does temporary marriage [Muta'ah] and he considers that haram [Unlawful], there is no hadd [[Punishment for Adultery] (Alamgiri)

23 – If someone does nikah with a woman who is married before, and he knows she has a husband and it is haram [Unlawful] , there is no hadd [Punishment for Adultery] Fatawa Khaniya misr vol 3 p 508)

24 – There is no hadd [Punishment for Adultery] of zina [Adultery] for the one who cannot speak, neither any hadd [Punishment for Adultery] for something else, even if the witness are present and he admits with isharah [gesture] or by writing (Alamgiri misr, vol 2 p 168)

25 – If someone kidnaps a slave, does zina [Adultery] and pay his responsible [Owner] for her price, there is no hadd [Punishment for Adultery] (Dar Mukhtar Kitab hudud)

26 – If someone gives permission to another to do zina [Intercourse] with his slave, there is no hadd [Punishment for Adultery] (Alamgiri vol 2 p 169)

27 – If the Khalifah or the imam or the king does zina [ADULTERY] there is no hadd [PUNISHMENT] (Dar Mukhtar Kitab hudud) [also in Hidaya and that Hidaya is being taught in Pakistani Madressah]

28 – There is no hadd for sodomy [Anal Intercourse] (Dar Mukhtar Kitab hudud)

29 – If someone does zina [ADULTERY] in dar ul harb [Land/Country of Infidels] or in the land of revolted people, there is no hadd [PUNISHMENT] (Dar Mukhtar Kitab hudud)
Imagine an Aalim from these madaras is given task to teach children, what would you expect from these so-called madarasa moulvis.

Government should regularize the madrasa syllabus so that it may be free from all above “kharafaats”

اب یہ کتابیں مدرسے میں ٹین ایجر پڑھتے ہیں جن میں لواطت کی باریکیوں پر بحث موجود ہے،، لیکن سکولوں میں اگر بچوں کو بتانے کی کوشش کی جائے کہ اس کام سے بچ کر رہنا ہے تو شور مچ جاتا ہے کہ سیکس ایجوکیشن کے نام پر بچے خراب ہو رہے ہیں۔

جب مولوی صاحبان کو بچوں کا مختار کل کی حیثیت حاصل ہو گی تو پھر اس طرح کے کیسز تو ضرور ملیں گے . . . . . لوگوں کے دلوں سے یہ بات نکالنے کی ضرورت ہے کہ بچہ چوبیس گھنٹے مدرسے میں گزار کر کبھی عالم دین نہیں بن سکتا

Its all true what goes on in Madrassahs but I don't think our population is educated enough and have enough of faith to accept these acts as wrong and unislamic , so I don't expect any positive change but its a start as a movement, hopefully people will get civilized.

There is a financial reason to it as well. Lot of folks cant afford to pay for education and food for their children so they sent them to these madrassahs. I am quite sure they are aware to some extent of what goes on in there but wont accept it as a bad practice.

مدرسوں میں زیادہ ترتعداد ان بچوں کی ہوتی ہے جن کے والدین کو مولوی نے سکھایا ہوتا ہے کہ اندھا دھند بچے پیدا کرتے جاؤ ، رزق اللہ کے ذمے ہے اور جب ان کے گھر میں دھڑا دھڑ بچے پیدا ہوجاتے ہیں اور ان کو کھلانے کو کچھ نہیں ہوتا تو پھر یہ ان کے لئے اللہ کے رزق کا انتظار کرنے کی بجائے مدرسوں میں پھینک جاتے ہیں کہ اب قوم ان کے بچوں کو پالے، قوم چندوں، خیراتوں، صدقوں، قربانی کی کھالوں کے ذریعے ان کی پرورش کا خرچہ اٹھائے، یہ سارے کے سارے مدرسے، ان میں پڑھنے والے لاکھوں بچے اور ان مدرسوں سے منسلک ہزاروں مولوی پوری قوم پر بوجھ ہیں، ان میں اور بھکاریوں میں کوئی فرق نہیں، دونوں طبقات قوم اور ملک کے سر پر بوجھ ہیں، ناکارہ ہیں۔۔ دونوں طبقات ملک اور معاشرے کو کسی قسم کی خدمات فراہم نہیں کرتے، صرف مفت کی روٹیاں توڑتے ہیں اور دوسروں کی محنت کا رزق خود کھاتے ہیں۔۔۔ ان مدرسوں میں پڑھنے والے بچے چونکہ والدین کے لئے زائد اور فالتو ہوتے ہیں اس لئے وہ ان کو کلی طور پر مولوی کے تسلط میں دے دیتے ہیں اور مولوی کو ان بچوں پر چوبیس گھنٹے، دن ، رات، پورا اختیار ہوتا ہے،۔۔ مولوی ان کو جانوروں کی طرح پیٹے، یا زنجیروں سے باندھ کر رکھے، کوئی مولوی کے اختیار کو چیلنج نہیں کرسکتا۔۔ مولوی کو پورا اختیار ہوتا ہے کہ چاہے وہ دن کے وقت یا پھر رات کے کسی بھی پہر، کسی بھی بچے کو اٹھائے اور اپنے حجرے میں لے جائے اور جس جگہ وہ قرآن و حدیث کی تعلیم دیتا ہے، اسی جگہ اس بچے کو زیادتی کا نشانہ بنائے، اور پھر اگلے دن ٹیسٹ بدلنے کے لئے یہی بدکاری کسی اور بچے کے ساتھ کرے اور چاہے تو دو ، دو بچوں کے ساتھ ایک ساتھ یہ کام کرے۔۔۔ مولوی کو کھلی چھوٹ ہوتی ہے۔۔۔

Friend, I'm getting your intent, however there is no point calling for guilt or to shift the responsibility of a crime. Common people have neither the resources nor the duty to curb this prevailing social crime other than to report to the authorities.
It is the state's and law maker's responsibility to handle and stop this crime though rational and bold laws, catch and punish the criminals. In the modern states, the health, education and well-being of the children is the responsibility (and foremost duty) of the society (which just means The State) not just the parents. It is our political leaders, activists and parties which need Shaoor for the action, not the common people.

its all crap taken out of context. I can a whole lot more on the subject from @pakistani1947's muslak or other liberals who are on this forum. madrassahs are not a close unit any more. most madrassahs are open to public and anyone can walk in. in this age there are many paid minions and there are others who are paying the minions to post something to show Islam in bad light. and at that time it is people like the above mentioned who become tools in the game and end up sheeding bad light on the whole DEEN.

its all crap taken out of context. I can a whole lot more on the subject from @pakistani1947's muslak or other liberals who are on this forum. madrassahs are not a close unit any more. most madrassahs are open to public and anyone can walk in. in this age there are many paid minions and there are others who are paying the minions to post something to show Islam in bad light. and at that time it is people like the above mentioned who become tools in the game and end up sheeding bad light on the whole DEEN.

please give us info about pakistani1947 maslak because he bring lot of thing against maslak Ahlsunnat and imam ABU HANIFA RA im so upset never the less all brealvi and deoband we all are follower of imam Azam .

Ahle-Hadith: There were some scholars who spent their time, energy and efforts in collecting and recording the various hadiths of the Messenger of Allah (saws); and they came to be recognized as the Ahle-Hadith. But as time went by, the people who claimed to be Ahle-Hadith propagated that they need not follow any of the major schools of thought, but it would be best to take direct guidance from the Quran and Sunnah.


Deobhandhi: The students who graduated from the Dar-ul-Uloom madrasa in Deobhandi, came to be recognized as Deobhandis. Although they claim to follow the teachings of the Hanafi school of thought, they propagate many things which are absolutely alien to the teachings of the great scholar of Islam, Imam Abu Hanifa. Today, Deobhandhis are more closer of the mystic or Sufi sect of Islam. Most, not all, of their beliefs today have given rise to various aspects and manifestations of shirk and bidah.


Barelvi: The person, Ahmad Raza Khan, who started the Barelvi sect was originally a student of the Dar-ul-Uloom Deobhandh, and thus a Deobhandhi himself. Due to some differences of opinion, he moved away from the teachings of Deobhandhis, and formed his own madrasa in the district of Barelvi in India; and thus the students who graduated from the madrasa at Barelvi came to be recognized as Barelvis. They too claim to follow the Hanafi school of thought, but their base has become mysticism or Sufism and they too propagate a significant amount of shirk and bidah in their teachings.


The Guidance of Allah and His Messenger (pbuh) to the believers is very straight forward and basic: Remain united in the One Ummah of Islam, and do not divide yourselves into sects and creeds! And that should be the stand of every believer, who truly believes in Allah and the Last Day. The believers should be proud to be recognized by the name that Allah has chosen for them: that is, Muslims! Not Shias, not Sunnis, not Barelvis, not Deobhandhis, not Ahle-Hadiths, not Ahle-Sunnah, etc., but Muslims!


Allah says in the Holy Quran Chapter 23 Surah Muminoon verse 52-53:


(Qur'an 23:52) وَإِنَّ هَـٰذِهِ أُمَّتُكُمْ أُمَّةً وَاحِدَةً وَأَنَا رَبُّكُمْ فَاتَّقُونِ​
And verily this Brotherhood of yours is a single Brotherhood, and I am your Lord and Cherisher: therefore fear Me (and no other).
اور بے شک یہ تمہاری جماعت ایک ہی جماعت ہے اور میں تم سب کا رب ہوں پس مجھ سے ڈرو


(Qur'an 23:53) فَتَقَطَّعُوا أَمْرَهُم بَيْنَهُمْ زُبُرًا ۖ كُلُّ حِزْبٍ بِمَا لَدَيْهِمْ فَرِحُونَ​
But people have cut off their affair (of unity), between them, into sects: each party rejoices in that which is with itself.
پھر انہوں نے اپنے دین کو آپس میں ٹکڑے ٹکڑے کر لیا ہر ایک جماعت اس ٹکڑے پو جو ان کے پاس ہے خوش ہونے والے ہیں


Allah says in the Holy Quran Chapter 22 Surah Hajj verse 78:

(Qur'an 22:78) وَجَاهِدُوا فِي اللَّهِ حَقَّ جِهَادِهِ ۚ هُوَ اجْتَبَاكُمْ وَمَا جَعَلَ عَلَيْكُمْ فِي الدِّينِ مِنْ حَرَجٍ ۚ مِّلَّةَ أَبِيكُمْ إِبْرَاهِيمَ ۚ هُوَ سَمَّاكُمُ الْمُسْلِمِينَ مِن قَبْلُ وَفِي هَـٰذَا لِيَكُونَ الرَّسُولُ شَهِيدًا عَلَيْكُمْ وَتَكُونُوا شُهَدَاءَ عَلَى النَّاسِ ۚ فَأَقِيمُوا الصَّلَاةَ وَآتُوا الزَّكَاةَ وَاعْتَصِمُوا بِاللَّهِ هُوَ مَوْلَاكُمْ ۖ فَنِعْمَ الْمَوْلَىٰ وَنِعْمَ النَّصِيرُ​
And strive in His cause as ye ought to strive, (with sincerity and under discipline). He has chosen you, and has imposed no difficulties on you in religion; it is the cult of your father Abraham. It is He Who has named you Muslims, both before and in this (Revelation); that the Messenger may be a witness for you, and ye be witnesses for mankind! So establish regular Prayer, give regular Charity, and hold fast to Allah! He is your Protector - the Best to protect and the Best to help!
اور الله کی راہ میں کوشش کرو جیسا کوشش کرنے کا حق ہے اس نے تمہیں پسند کیا ہے اور دین میں تم پر کسی طرح کی سختی نہیں کی تمہارے باپ ابراھیم کا دین ہے اسی نے تمہارا نام پہلے سےمسلمان رکھا تھااوراس قرآن میں بھی تاکہ رسول تم پر گواہ بنے اور تم لوگو ں پر گواہ بنو پس نماز قائم کرو اور زکوٰة دو اور الله کو مضبوط ہو کر پکڑو وہی تمہارا مولیٰ ہے پھر کیا ہی اچھامولیٰ اور کیا ہی اچھا مددگار ہے

Al-Tirmidhi Hadith 171 Narrated by Abdullah ibn Amr:


Allah's Messenger (pbuh) said: There will befall my Ummah exactly (all those) evils which befell the people of Isra'il, so much so that if there was one amongst them who openly committed fornication with his mother, there will be among my Ummah one who will do that. And if the people of Isra'il were fragmented into seventy-two sects, my Ummah will be fragmented into seventy-three sects. All of them will be in Hell Fire except one sect. They (the Companions) said: O Messenger of Allah (saws) which is that? Whereupon he (pbuh) said: It is one to which I and my companions belong.



The Messenger of Allah (pbuh), his noble family, and his noble companions were all Muslims, and that is the name Allah Subhanah has Himself chosen for the true believers.

(Qur'an 3:103) وَاعْتَصِمُوا بِحَبْلِ اللَّهِ جَمِيعًا وَلَا تَفَرَّقُوا ۚ وَاذْكُرُوا نِعْمَتَ اللَّهِ عَلَيْكُمْ إِذْ كُنتُمْ أَعْدَاءً فَأَلَّفَ بَيْنَ قُلُوبِكُمْ فَأَصْبَحْتُم بِنِعْمَتِهِ إِخْوَانًا وَكُنتُمْ عَلَىٰ شَفَا حُفْرَةٍ مِّنَ النَّارِ فَأَنقَذَكُم مِّنْهَا ۗ كَذَ*ٰلِكَ يُبَيِّنُ اللَّهُ لَكُمْ آيَاتِهِ لَعَلَّكُمْ تَهْتَدُونَ
And hold fast, all together, by the rope which Allah (stretches out for you), and be not divided among yourselves; and remember with gratitude Allah's favour on you; for ye were enemies and He joined your hearts in love, so that by His Grace, ye became brethren; and ye were on the brink of the pit of Fire, and He saved you from it. Thus doth Allah make His Signs clear to you: That ye may be guided.
اور سب مل کر الله کی رسی مضبوط پکڑو اور پھوٹ نہ ڈالو اور الله کا احسان اپنے اوپر یاد کرو جب کہ تم آپس میں دشمن تھے پھر تمہارے دلوں میں الفت ڈال دی پھر تم اس کے فضل سے بھائی بھائی ہو گئے اور تم آگ کے گڑھے کے کنارے پر تھے پھر تم کو اس سے نجات دی اس طرح تم پر الله اپنی نشانیاں بیان کرتا ہے تاکہ تم ہدایت پاؤ


31 ۞ مُنِيبِينَ إِلَيْهِ وَاتَّقُوهُ وَأَقِيمُوا الصَّلَاةَ وَلَا تَكُونُوا مِنَ الْمُشْرِكِينَ
32 مِنَ الَّذِينَ فَرَّقُوا دِينَهُمْ وَكَانُوا شِيَعًا ۖ كُلُّ حِزْبٍ بِمَا لَدَيْهِمْ فَرِحُونَ
(Qur'an 3:31): Turn ye back in repentance to Him, and fear Him: establish regular prayers, and be not ye among those who join gods with Allah,-
(Qur'an 3:32):: Those who split up their Religion, and become (mere) Sects,- each party rejoicing in that which is with itself!
اسی کی طرف رجوع کیے رہو اور اس سے ڈرو اور نماز قائم کرو اور مشرکوں میں سے نہ ہوجاؤ- جنہوں نے اپنے دین کو ٹکڑے ٹکڑے کر دیا اور کئی فرقے ہو گئے سب فرقے اسی سے خوش ہیں جو ان کے پا س ہے


Narrated Hudhaifa bin Al-Yaman: The people used to ask Allah's Apostle about good, but I used to ask him about evil for fear that it might overtake me. Once I said, "O Allah's Apostle! We were in ignorance and in evil and Allah has bestowed upon us the present good; will there by any evil after this good?" He said, "Yes." I asked, "Will there be good after that evil?" He said, "Yes, but it would be tained with Dakhan (i.e. Little evil)." I asked, "What will its Dakhan be?" He said, "There will be some people who will lead (people) according to principles other than my tradition. You will see their actions and disapprove of them." I said, "Will there by any evil after that good?"

He said, "Yes, there will be some people who will invite others to the doors of Hell, and whoever accepts their invitation to it will be thrown in it (by them)." I said, "O Allah's Apostle! Describe those people to us." He said, "They will belong to us and speak our language" I asked, "What do you order me to do if such a thing should take place in my life?" He said, "Adhere to the group of Muslims and their Chief." I asked, "If there is neither a group (of Muslims) nor a chief (what shall I do)?" He said, "Keep away from all those different sects, even if you had to bite (i.e. eat) the root of a tree, till you meet Allah while you are still in that state." (Sahih Bukhari; Book #56, Hadith #803)


Question: After reading clear verses of Quraan and Hadith from Sahih Bukhari, if we still stick to our sects like, Hanafi, Shaafi. Maliki, Hambali, Ahle-Hadeeth, Shia, and Ismailee etc. wouldn't we be dis-obeying Allah's Order?

Friend, I'm getting your intent, however there is no point calling for guilt or to shift the responsibility of a crime. Common people have neither the resources nor the duty to curb this prevailing social crime other than to report to the authorities.
It is the state's and law maker's responsibility to handle and stop this crime though rational and bold laws, catch and punish the criminals. In the modern states, the health, education and well-being of the children is the responsibility (and foremost duty) of the society (which just means The State) not just the parents. It is our political leaders, activists and parties which need Shaoor for the action, not the common people.

Brother, I see your point. It is true that arresting and penalizing such people, is responsibility of state but we can also contribute by preventing such environment that makes such incidents happen. That's what I tried to say in my last comment.

لگتے ہاتھ یہ بھی بتا دیں کے آپ مرزائیوں کے ہاں بھی مدارس ہوتے ہیں اور ان میں کیا یہ مکروہ کام نہیں ہوتے اگر نہیں ہوتے تو ان کو کیسے آپ لوگوں نے روکا اور اس بارے حضرت جی کا کوئی فرمایا ہوا آڈیو ویڈیو بھی لگا دیں
