ARE THOSE WHO REBEL AGAINST THE RULER FROM THE KHAWARIJ?
The issue of revolting against the unjust ruler is something the people of Ahlus-Sunnah have differed over, the revolt against a Muslim ruler, not against a Kafir ruler, it’s consensus that you can revolt against him [the ruler that disbelieves] this consensus was mentioned more than once by the people of knowledge and amongst those who mentioned it was Al-Qadi Al Iyad, Hafidh Ibn Hajar, Imam Nawawi and many others, May Allah have Mercy on them.A group of the companions of the Prophet sallallahu ‘alayhi wa salam, revolted against the rulers of their time, Talha Ibn ‘Ubaydullah rebelled against the ruler and he is one of the 10 that received the promise of attaining Jannah in their lifetime. Az-Zubayr Ibn Al-Awwam rose against the ruler and he is also one of the 10 who gained the promise of Jannah in their lifetime.The mother of the believers ‘A’ishah [May Allah be pleased with her] spoke against the rulers, and it is narrate that the Prophet [pbuh] said in Tirmidhi that she will be his wife in Jannah.Al Husayn Ibn Ali rebelled against Yazid and he and his brothers are the leaders of the youth in Jannah, Mu’awiyyah Ibn Abi Sufyaan may Allah be pleased with him, rebelled against the ruler, An-Numan Bashir rebelled against the Ummayads, may Allah be pleased with him.
More than one companion of the Messenger of Allah sallallahu ‘alayhi wa salam, rebelled against the ruler of their time, has anyone said that they are Khawarij? Will you keep in mind that they received the glad tidings of Jannah, has anyone said anything about them? Will someone dare to say anything about them? As they are the people of truth and refuge in Allah is sought by them. They are the dogs of hellfire? Will someone dare to say that?
The At-Tabi’een revolted against the rulers, a group of At-Tabi’een revolted against the ruler of their time, amongst them was Abdullah, a son of a man who was washed by the angels, who on the night of his marriage, he was with his wife when the he heard the Messenger of Allah [pbuh] saying “..O horse riders of Allah! Rise on your horses..” he went out from his wife and did not wash himself, and he was killed in the battle, and the angels washed him between the heaven and the earth, his son Abdullah revolted against the Ummayads.Abdullah Ibn Zubayr, the son of the companion of the Messenger of Allah sallallahu ‘alayhi wa salam, his mother is Asma [Bint Abi Bakr] the woman of two the belts, his grandmother through his father is the paternal aunt of the Prophet sallallahu ‘alayhi wa salam - Saffiyah, his grandfather through his mother is Abu Bakr May Allah be pleased with him, his aunt is the mother of the believers, ‘Ai’shah [may Allah be pleased with her]. Abdullah Ibn Zubayr also rebelled against the Ummayad King. Just as the people of Madinah came out against their ruler, as well as the people of Al-Basra rebelled against their rulers, as told by Al-Hafidh Ibn Hajar [may Allah have Mercy on his soul], the jurist of Al-Basra revolted against the rulers, the Imam Ash-Shabi rebelled, Imam Ibn Abi-Nitur revolted, the Imam Sa’id Ibn Jubayr rebelled and others amongst them rebelled against the rulers of their time, he came out and supported those who rebelled against the Abbasids, with money and young people.The Imam Abu Hanifah An-Numaan [may Allah have Mercy upon him], he said regarding those who got killed by revolting against Abbasids as Al-Mansur Abi Ja’far said **“..It is like they got shot on the day of Badr..”** he said **“..Woe to me that I wasn’t in his place..”.** The same applies to Imam Malik [may Allah have Mercy on his soul], when he was asked about the permissibility of revolting against Al-Mansur in 145H he allowed the revolt, they told him **“..We pledged alligance, we have alliance to our neck with him [the ruler]..”**, He [Imam Malik] said “..rather you were forced, and there is no allegiance on the forced one…”. Imam Malik gave a legal opinion on this matter, the same for Imam Sha’fiee in his old school of law, he sees the permissibility to revolt against a tyrannical ruler.
Imam Ahmad [May Allah have Mercy on him], which many of the contemporary speak about and try to include him in their beliefs and fundamentals, they say that they are part of the Hanbali school of thought, the Imam Ahmad – may Allah have Mercy on him – in his time Imam Ahmad bin- Nasr Khuzzai rebelled against the ruler of his time, he rebelled with the sword and fought till he was killed. When they killed Imam Ahmad bin Nasr Khuzai as mentioned by Imam Ibn Katheer in Al-Bidayah Wa-Nihaya, “Imam Ahmad wept over him, and it was very sad for him, and this made him sad for a long time..”, and he said **“..may Allah have Mercy upon him, he certainly fought with his soul in the path of Allah..”**. Ponder over the lessons of Imam Ahmad about rebelling against the ruler in his time, he said**“..may Allah have Mercy upon him, he certainly fought with his soul in the path of Allah..”**, are they capable of this those who join false and wrong inside the school of law of Imam Ahmad today? Are they able to say those who rebel against one of these rulers, are they able to say of the rebellion said “..may Allah have Mercy upon him, he certainly fought with his soul in the path of Allah..”, or do they say, “..they are lost..”, “..they are amongst the dogs of the hellfire..”, and “..If it was not the fear of receiving the reproach of the Prophet sallallahu ‘alayhi wa salam I would have killed them..”, so weight between the two types of law. Fiqh of the Salaf, and Fiqh of the Khalaf [which joins false and wrong inside the Fiqh of Salaf].If you join a people who have honour we say, [poem] You are right but what a bad childbirth, and the sermon on which it is based is not evident, and the children sermon have monopolised it. So here is the case of Imam Ahmad, and there is cases of others in the Ummah, Imam Abu Al-Arab At-Tamimi may Allah have Mercy upon him, rebelled against the ruler of his time, in the Islamic Maghrib, he is the author of the book “Al-Mihaan”, he died in the year 333H, but before that Imam Al-Jadda rebelled against the rulers of his time. And amongst them we see the permissibility of rising against the unjust ruler is the Imam Ibn Hazm – may Allah have Mercy upon him – he did an explanation in his book ‘Al-Fisaal Milal wa fee Al-Nihal’, others who see the permissibility in Islam – Imam Al- Ghazzali who died in 505H, Imam Al-Jawzi amongst the Hanabillah and Ibn Al-Razil, Imam Ibn Aqeel who is a Hanabillah and other than them amongst the Ulema of Islam see the permissibility of revolting against a Fasiq ruler.So no one who rebel against any ruler at any time is considered a Khawarij, this is not the criterion to judge an individual if he is part of a school of Khawarij or not. This is not the way of the people of Sunnah and consensus and this is not the criterion that was known at the time of the Salaf, May Allah be pleased with them all.Therefore a Sunni can revolt against the ruler and the innovator, as well as the Shia can revolt against the ruler, the Khawarij rebelled against the ruler and even the Murji rebelled. Some Murji’ah that were contemporary to the Salaf as Dharr Al-Hamodani, the people of science warned against them, Sa’id Ibn Jubayr, may Allah be pleased with him, did not make salaam to him because of his Irjaa’, he warned against them because of his Irjaa’. The Imam Ibrahim An-Nakha’ee, may Allah have Mercy on him, was an Imam who rebelled against Al-Hajjaj and also warned against Dharr Al-Hamoudi because of his Irjaa’, and yet he saw permisibility to affiliate the Murji’ah to rebel against Al-Hajjaj by the sword, this is the Murji’ah that were contemporary to the Salaf and this shows that anyone who rise against the ruler is not qualified as what? As being part of the Khawarij. You will find a democrat revolting, a secular rebel, a communist, rises against the ruler, the secularist revolts also, these people are disbelievers, so are they fitting the legal condition of a Khawarij?No one who rebels against the ruler is considered a part of the Khawarij but it is essential that he adheres to the principles of the Khawarij that was mentioned to you in this lesson, for which I ask Allah – The Exalted and Glorified -to bless and it is through this you will find that the accusation is invalid and it would be fair to say regarding the Murji’ah affiliated **“They are the Murji’ah with the rulers and the Sultan and Khawarij with the preachers and Mujahideen”**You have learned most of the signs of a Khawarij and that many of the words of the Khawaij apply on the contemporary Murji’ah when dealing with preachers and Mujahideen, when dealing with the rulers and sultan, we will show by the agreement and the will of Allah and His grace and His word and His strength.Allah is the Most High and knows Best, May Allah’s peace and blessings be with the one who He had sent down with the sword and not with the pen.By Sheikh Abu Sufyan as-Sulamee may Allah preserve and protect him

We also need to elaborate on how many Imams of Ahl us-Sunna walJama`ah have rebelled against tyrant ruler and no one ever called them Khawaarij. It was also not known that these rulers were kuffar either. We will now present you with examples of those Imams who went out against the rulers and in some cases fought against them,
1- An-Nafs az-Zakiyya, whose name was Muhammad ibn Abdullah ibn Hassan ibn Hassan ibn Ali ibn Ali Taalib, died in 145 AH. He went out of the Abbasid Khalifate, but Khalifa alMansur had him killed. Imaam Maalik said his Bai`a was correct.
2-Mu`awiya ibn Abu Sufyan, 6 months and two days after Hasan ibn `Ali was given bai`a as the khalifa, came out against him in dispute. This was due to the unresolved bloodshed that had resulted in the death of Mu`awiya’s cousin, the third khalifa of Islam, `Uthman ibn `Affan.
3- Perhaps the most famous example in Islamic history above all, is that of alHussain, who went out of Yazid ibn Mu`awiya and was killed in the batttle of Karbala. No one once said Hussain was Khawaarj.
4- Abdullah ibn Az-Zubair, the son of Az-Zubair ibn al `Awwaam, went out of Bani Ummayya and was given bai`a as the amir of Madina as well as against the existing Khalifa. He was killed and hung for three days.
5- At the time of the Khalifa Hadi (170 H), Imam Abu `Abdullah Hussain ibn Ali ibn Hassan ibn Hassan ibn Hassan ibn Ali ibn Abi Taalib, who died in 167 AH, went out against the Khalifa in Makkah and the Hijaaz. His revolution ended when he was killed and left to be eaten by the scavenging animals and birds.[29]
6- Imam AbulHasan Musa Kaazim ibn Jaafir as-Saadiq ibn Muhammad alBaaqir, who died 183 AH, revolted against the Khalifa Harun ar-Rashid, was arrested and put in jail until he died.[30]
7- Imam Muhammad ibn Jaafar as-Saadiq, who revolted in the Hijaaz and Makkah, went out against Ma`mun.
8- Imam `Ali ar-Rida ibn Musa Kaazim ibn Jaafir as-Saadiq ibn Muhammad ibn alQaasim revolted in the time of the Khalifa Mu`tasim. He was captured and defeated.
10- Ibrahim ibn Musa Kaazim ibn Jaafar as-Saadiq revolted against the rulership and killed many people in Yemen.
11- Perhaps the most famous example of going out of a ruler in recent times is the case of Sheikh ulIslam Muhammad ibn `Abdul Wahhab (RH) [1116-1206 AH (1704-1792 AD)], who went out against the `Uthmani Khalifate in his struggle to rid to Peninsula of grave worship and so forth.
None of the historians or scholars of Ahl us-Sunna have referred to neither these Imams as Khawaarij, nor the rulers of their time as kuffar either. What then of the Mujahideen? They are seeing such a clear kufr from everywhere, in which we have so much support for in the Book and Sunna to rebel against them, that the evidences are too numerous and too famous to elaborate on in this short treatise. These kinds of rulers aren’t even legitimate rulers.

5- At the time of the Khalifa Hadi (170 H), Imam Abu `Abdullah Hussain ibn Ali ibn Hassan ibn Hassan ibn Hassan ibn Ali ibn Abi Taalib, who died in 167 AH, went out against the Khalifa in Makkah and the Hijaaz. His revolution ended when he was killed and left to be eaten by the scavenging animals and birds.[29]
6- Imam AbulHasan Musa Kaazim ibn Jaafir as-Saadiq ibn Muhammad alBaaqir, who died 183 AH, revolted against the Khalifa Harun ar-Rashid, was arrested and put in jail until he died.[30]
7- Imam Muhammad ibn Jaafar as-Saadiq, who revolted in the Hijaaz and Makkah, went out against Ma`mun.
8- Imam `Ali ar-Rida ibn Musa Kaazim ibn Jaafir as-Saadiq ibn Muhammad ibn alQaasim revolted in the time of the Khalifa Mu`tasim. He was captured and defeated.
10- Ibrahim ibn Musa Kaazim ibn Jaafar as-Saadiq revolted against the rulership and killed many people in Yemen.
11- Perhaps the most famous example of going out of a ruler in recent times is the case of Sheikh ulIslam Muhammad ibn `Abdul Wahhab (RH) [1116-1206 AH (1704-1792 AD)], who went out against the `Uthmani Khalifate in his struggle to rid to Peninsula of grave worship and so forth.
None of the historians or scholars of Ahl us-Sunna have referred to neither these Imams as Khawaarij, nor the rulers of their time as kuffar either. What then of the Mujahideen? They are seeing such a clear kufr from everywhere, in which we have so much support for in the Book and Sunna to rebel against them, that the evidences are too numerous and too famous to elaborate on in this short treatise. These kinds of rulers aren’t even legitimate rulers.
