SC asked to stop media criticism of army

ISLAMABAD: A lawyer who briefly served as deputy attorney general during the Musharraf government filed a petition in the Supreme Court on Thursday seeking an order restraining the media from criticising the armed forces, intelligence agencies and other security and defence institutions.

Advocate Sardar Muhammad Ghazi said the media should be restrained from levelling baseless and unverified allegations against these institutions so that their work did not suffer in any manner.

The petition, drafted by Advocate Raja Muhamamd Ibrahim Satti, also requested the court to lay down guidelines to protect institutions from mala fide and baseless allegations and criticism.

The respondents named in the petition are the federal government through the information ministry, Pemra, analyst and anchorperson Najam Sethi, Capital Talk`s host Hamid Mir, Geo TV Network, publisher/editor of Daily Express Tribune, Islamabad, and Ejaz Haider who recently wrote an open letter to ISI chief General Shuja Pasha.

Habib Jalib said it better than anyone else. In one of his poem, he talks about the army and says (it was the time when east pakistan became bangladesh and people like Jalib were protesting against the dictatorship of Yahya Khan).

This case can never be won as it would mean that (God forbids) any future dictator can use this to silence media. If it wasn't for the media pressure, there would have been no commission on OBL death or Saleem Shehzad's Murder, or army facing questions from the parliament. I hope supreme court rejects this.

Would you say that this should have been true for Musharraf, Zia, Yahya or Ayub? They represented the army didn't they? Are they above criticism too?

We shouldn't be hypocrites and pick and choose generals we are allowed to criticize.

No institution is beyond criticism, accountability and scrutiny. These things have never harmed an institution, on the contrary, it has made it more effective and efficient.

Only Allah, His Prophets and Angels and his divine books are beyond criticism, no one else has the right to claim this immunity.

Criticism on an institution is associated with its performance. If the performance of an institution is good, people will appreciate and support it but if the performance of the institution is poor, i dont think that any sensable person will dare to support it.

Take the example of Pakistan cricket team; what we do, when our team performs good we support and appreciate them and when they give poor performance we criticise them. When we criticise them its mean we criticise their performance, criticising their performance means to point out defects in their performance and mistakes they made. Our criticism reaches to the players through media. And it gives them a chance to fix their mistakes and improve their performance. A good player will always consider fair criticism and try to improve his performance but a bad player will not give a damn to it and take it as a 'mater of ego and pride'. This is the case with Pak Army and ISI. Instead of learning from mistakes and improving their performance, Army has made it a 'mater of ego and pride' so the army has become a 'bad player' that never learns from mistakes rather 're-enforce the failure'.

Do we have any right to criticise Pak-Army?

Yes; first; freedom of speech is our fundamental right guaranteed by the Constitution of Pakistan; second; we the people of Pakistan are 'stakeholders' in Pak Army; [a 'stakeholder' is one who even have a minor 'interest' either 'commercial or moral' in any 'body' or 'institution'] army receives a large chunck of our budget every year; we the taxpayers of Pakistan pay for their salaries and other incentives; thus we have every right to question their performance and held them accountable for what they do.

Those who support the arguments that 'there must not be any criticism on Army and ISI': Please Answer the following questions:

1. Quote ONE SINGLE example from 2001 till 2011 where Army & ISI protected national interests of Pakistan.
[Remember flood relief work, meter reading, and sensus services by army do not fall within the definition of 'national interest' and it is not their job anyway]


2. Quote ONE SINGLE example where any General was ever punished for violation of Constitution of Pakistan.

So when the performance of Army is so poor; the criticism is natural. Media is doing its job; if army as a 'bad-player' cannot face the truth and fix its mistakes, it cannot 'block' the truth.

If aour army jenrals take orders from other country's representatives we are not allowed to speakup. when our secrity forces kill us, unarmed in front of camera we are not supposed to cry. and when someone come with the arms and our forces cant protect there head quarter and there critical base and the invaders hit there target and runaway.......and our navy cheif gives a stupid speach for explaination we should appreciate it....
