بلکہ اس کیس میں وہ شفاف ہونے کی بنیاد پر جماعت میں سلیکٹ ہو گئے اور سلیکٹ ہونے کے بعد انہوں نے پارٹی الیکشن میں کمزوریوں کا فائدہ اٹھایا مگر اس سے یہ نتیجہ نہیں نکالا جا سکتا کہ وہ ہمیشہ سے ہی بد دیانت تھے

تو صورتحال یہ ہے کہ ایک شخص نے میٹرک تعلیم کے ساتھ ایک نوکری کے لئے اپلائی کیا اور بھرتی ہو گیا اور نوکری کے دوران اس سے کوئی غلطی یا جرم سرزد ہو گیا جو کہ اسکی تعلیم کے خلاف تھے
لہٰذا اس صورتحال میں وہ ادارہ اس شخص کو نوکری کے دوران کی گئی غلطی کی سزا دے گا نہ کہ اسکی ڈگری ہی جعلی قرار دے دے گا اور یہ سزا ادارہ اپنی مرضی سے دے گا آپکی مرضی سے نہیں

جہاں تک آپ کی طرف سے دکھائی جانے والی ویڈیو کا تعلق ہے تو یہ محض الزامات ہیں
ریاستی اداروں کا کام ہے کہ وہ ان الزامات کی تفتیش کریں اور پھر سزا دیں
آپ کی ضد یہ ہے کہ ریاستی ادارے بیشک کوئی کام نہ کریں لیکن عمران خان پولیس، ایف آئی اے، نیب، آئی ایس آئی کھول لے اور ہر شامل ہونے والی رکن کی جانچ پڑتال کرے

جبکہ طریقہ یہ ہے کہ جب تک کسی شخص پر ریاستی اداروں کی طرف سے کوئی کیس نہیں ہے تو وہ شفاف ہے
اگر صرف الزام کی بنیاد پر شمولیت روک لی جائے تو پھر ایک بھی شخص شامل نہ ہو پائے گا. کیونکہ سہیل شجاع نامی شخص دروازے پر کھڑا ہو کر کوئی بھی الزام لگا دے گا اور پھر فرشتے بھی ملزم ہو جائیں گے

اس دلیل کا جواب میں پہلے دے چکا ہوں کہ جماعت یا کسی بھی ادارے کے سربراہ کو اختیار ہے کہ وہ اپنے زیر اختیار کسی بھی کارکن یا فرد کو غلطی یا بد عنوانی کی کیا سزا دیتا ہے اور ایک ہی جرم پر حالات کی مناسبت سے مختلف سزا سنائی جا سکتی ہے مگر آپ کی سوئی ایک ہی سزا دینے پر اٹکی ہوئی ہے لہٰذا اس میں مزید بحث کی گنجائش نہیں ہے

تحریک انصاف نے نہ صرف انٹرا پارٹی الیکشن کے نتیجے میں ملنے والے پارٹی عھدے واپس لے لئے ہیں بلکہ اپنی مخلوط حکومت میں شامل اتحادی وزیر اور پھر اپنی ہی پارٹی کے وزیر کو بھی کرپشن پر سزا دی. اب آپ کا فرمائشی پروگرام ہی ختم نہیں ہو رہا اور آپ بضد ہیں کہ کچھ بھی نہیں ہوا. تو یہی کہا جا سکتا ہے کہ آپ کو مطمئن کرنا ناممکن ہے

آپ کو رائے دینے کا پورا پورا حق ہے مگر بخدا یہ حق ذرا دوسروں کو بھی دیجئے. جب آپ رائے دینے کی بات کریں گے تو میرا مقدمہ یہ ہوگا کہ ایک کام جو پاکستان کی تاریخ میں شاذونادر ہی کسی نے کیا ہو، تو اگر تحریک انصاف نے اسکی بسم الله کر ہی دی ہے تو آپ بجائے حوصلہ افزائی کے حوصلہ شکنی کر رہے ہیں اور وہ بھی اس بنیاد پر کہ انٹرا پارٹی الیکشن پرفیکٹ کیوں نہیں ہوئے؟ یہ دلیل سمجھ سے باہر ہے کہ پہلی دفعہ ہی ایک بھی غلطی نہ ہو. جبکہ غلطیاں اور بدعنوانیاں ہمیشہ ہوں گی. کامیاب معاشرہ یا جماعت وہ ہے جو ان پر زیادہ سے زیادہ قابو پا لے
اسکے علاوہ کرپشن پر اپنوں کو ہی سزا دینا اور مقدمہ قائم کرنے کی روایت بھی ناپید ہے. اسکا آغاز بھی کر دیا گیا ہے. مگر اس میں بھی کیڑے نکال رہے ہیں کہ وہ کیوں بچ گیا یہ کیوں بچ گیا؟ بھائی کچھ حوصلہ کرو. پہلی ہی بار میں سارے پاکستان کی بے ایمانی قابو نہیں کی جا سکتی
یہ ایک مسلسل عمل ہے جو ہمیشہ جاری رہے گا. آپ کو شکر گزر ہونا چاہیے کہ کم از کم آغاز تو ہوا
جہاں تک ہنسنے کی بات ہے تو ہنسنے کا حق میں اس شخص کو کیسے دے دوں جسے پتا ہی نہیں کہ کیا ہو رہا ہے؟ انٹرا پارٹی الیکشن نون لیگ اور پی پی پی کی روایت رہے ہی نہیں تو انکا تنقید اور مزاح کا حق کیسے تسلیم کیا جائے؟

جب آپ کرپشن کے خلاف قوانین کی بات کرتے ہیں تو سوال پیدا ہوتا ہے کہ کون سے قوانین؟ ملک کے قوانین یا جماعت کے قوانین؟ یہ دونوں مختلف ہیں
ہو سکتا ہے کہ جماعت میں کوئی بد عنوانی ہو اور پارٹی اس میں پولیس کو شامل نہ کرنا چاہے اور اپنے طور پر سزا دے دے یا صرف تنبیہ کر دے
اور دوسرے کیس میں ہو سکتا ہے کہ پولیس کو شامل کر لیا جائے. اس صورت میں ملک کے قوانین لاگو ہوں گے نہ کہ جماعت کے

I am sorry but I cannot find anyone calling the decision of PHC as being symbolic. If you call it symbolic due to your lack of knowledge on the subject, that is another matter. To anyone having an iota of understanding will not take this decision as symbolic. Furthermore, a true nationalist would have not ended the struggle at the judgement of PHC, they would have had persecuted the matter to the highest echelons of Legal and legislative bodies (Supreme court and/or Parliament).

Cruel and unusual punishment is a phrase describing punishment that is considered unacceptable due to the suffering, pain, or humiliation it inflicts on the person subjected to it.There are generally tests that can serve as a guide to what cruel and unusual punishment is according to various legal textbooks in accordance with the law. These are: 1) the frequency at which the punishment occurs in society, 2) overall acceptance in society, 3) severity (i.e., the punishment fits the crime), and 4) if the punishment is arbitrary.

Eighth amendment: The Eighth Amendment to the United States Constitution states that "cruel and unusual punishments [shall not be] inflicted." The general principles the United States Supreme Court relied on to decide whether or not a particular punishment was cruel and unusual were determined by Justice William Brennan In Furman v. Georgia, 408 U.S. (1972), Justice Brennan wrote, "There are, then, four principles by which we may determine whether a particular punishment is 'cruel and unusual'."

• The "essential predicate" is "that a punishment must not by its severity be degrading to human dignity," especially torture.
• "A severe punishment that is obviously inflicted in wholly arbitrary fashion." (Furman v. Georgia temporarily suspended capital punishment for this reason.)
• "A severe punishment that is clearly and totally rejected throughout society."
• "A severe punishment that is patently unnecessary."

And he added: "The function of these principles, after all, is simply to provide means by which a court can determine whether a challenged punishment comports with human dignity. They are, therefore, interrelated, and, in most cases, it will be their convergence that will justify the conclusion that a punishment is "cruel and unusual." The test, then, will ordinarily be a cumulative one: if a punishment is unusually severe, if there is a strong probability that it is inflicted arbitrarily, if it is substantially rejected by contemporary society, and if there is no reason to believe that it serves any penal purpose more effectively than some less severe punishment, then the continued infliction of that punishment violates the command of the Clause that the State may not inflict inhuman and uncivilized punishments upon those convicted of crimes."

The exact amendment founds the basis for the Article 7 of the International Covenant on Civil and Political Rights (1976) to which, Pakistan has ensured approval and ratification in its legal structure.
