Presidential pardon to Rehman Malik challenged

LAHORE: A constitutional petition has been moved in the Lahore High Court challenging the presidential pardon given to Interior Minister Rehman Malik, waiving sentence upheld by the high court in two NAB cases.

Imtiaz Rashid Qureshi, media adviser of Save Judiciary Committee, filed this petition in which Rehman Malik, the Federation of Pakistan through the secretary ministry of interior, the principal secretary to President Asif Zardari and the NAB chairman had been made party.

Petitioners counsel Barrister Farooq Hassan stated that remission of sentence of Rehman Malik by the president under Article-45 of the Constitution was illegal. He has submitted that it is a usual requirement to give benefit of this provision to an accused only when he or someone on his behalf had utilised all legal remedies.

He stated that if someone was convicted in any court, he had the right to file an appeal against his sentence in the Supreme Court and if his petition was not heard in the apex court or decision was given against him then he could file a mercy petition with the president.

The counsel stated that the minister had not approached the Supreme Court in this connection and it was possible the apex court would have set aside the High Court verdict. The counsel said the unholy manner in which the pardon has been granted showed the good governance of the government.

He said the president has exercised his constitutional powers twice every time on the urgent advice of the prime minister during recent weeks, but all the time to save the skin of his cronies and the NRO beneficiaries. He said it appeared to be a clear case of conflict of interest and blatant abuse of discretion by the president.

this shows their moral and mental bankruptcy ... he could have easily gone to Supreme Court and have had his sentence waived or would have been granted bail ... but they are so desperate that he used the last option in the first place. a group of nutters ...

Its not the fault of AZ bro. Despite every body knows he is completely incompetent, his advisers are feeding him wrong advice. May be people within PPP want him out too, who knows

we have to wait n see. I think AZ will keep dragging until his term is over. Budget and VAt is coming soon, we should expect loss of lives on street. 16% new tax and a highly taxed budget will kill people already burried under taxes and corruption. I wish gen Kyani simply shoot the entire cabinet.

yeah and shooting them will make them martyrs like Akbar Bugti ... just one punishment is enough. They should be stripped of their powers and rule and their names should be put on ECL for life ......... they will die before death comes.

What AAZ and his cronies want is to bring the situation to a apoint where they will be dismissed by some force so they can cry foul and lay claim to having been removed by non democratic forces
to be able to avoid the legal proceedings. They are not naive and they are not being ill advised rather they know what they are aiming for. ZA Bhutto did similar thing by falling sick and by tearing up the Warsaw Resolution at UNO, thus creating situation for his return without accountability. I pray that AAZ and his cronies stay in their positions for the whole term with the people and law abiding lawers and citizens keeping them tied up in lawful matters where they would have to explain their actions and decisions.
