Memo case: Asma expresses distrust in SC

Hussain Haqqani's counsel Asma Jehangir has expressed veiled distrust in Apex Court.


When the hearing of the memo case resumed today (Thursday), Asma Jehangir, the counsel for ex-envoy Hussain Haqqani, told the court that her client was being kept with security and she didn’t have free and easy access to him. She said it would take her two to three days to see her client.

The Chief Justice said PM Gilani first of all ordered memo inquiry, meaning thereby he believed wrongdoing possible.

The court ordered the Attorney General to arrange her meeting with Haqqani at 11am today (Thursday).

Justice Jawad S Khawaja said it is human rights violation if there was no easy access to Haqqani.

The Chief Justice said that Asma can meet Haqqani in the Supreme Court if she wants to.

During the hearing, the CJ asked Asma which forum she wants to go to for the memo inquiry. Asma said a forum where law is upheld. The CJ said Highest Judicial Commission can be formed. He also said if the SC can hear other cases such as Rental Power Plants, why it can’t hear the memo case.

Justice Jawad S Khawaja says the Parliamentary Committee can t probe the matter judiciously.

The CJ said that the federal government has not filed its reply on the affidavits submitted by the Chief of Army Staff and the DG ISI.
She said it has yet not been determined who wrote the memo and who leaked it, and with what intentions.

Earlier, the SC had ordered President, PM, COAS, ISI chief, Mansoor Ijaz, Hussain Haqqani and petitioner PML-N chief Nawaz Sharif to submit its reply regarding the petition.

In the affidavit submitted to the Supreme Court, COAS Gen Ashfaq Parvez Kayani has said that the news regarding the memo-gate are correct and evidence is available of the contacts made in the context of the conspiracy. The COAS also wrote that the memo issue has dented national security and lowered the morale of the armed forces.

While, the government in its reply to the Supreme Court (SC) in memo case has confessed that it has no control over Army and Inter-Services Intelligence (ISI) and prayed that it should not be made answerable in regard to statements of Husain Haqqani and Mansor Ijaz.

The government through Defence Ministry has sent this written confession to the Supreme Court in which it is first time admitted that the political rulers have no control over Pakistan Army and ISI operations and that is why the government is not in a position to submit any explanation of reply on their behalf.

سپریم کورٹ میں میمو کیس کی سماعت جاری ہے جس کے دوران چیف جسٹس افتخار محمد چودھری نے ریمارکس دئیے ہیں کہ آٓرمی چیف اور شجاع پاشا کے بیان حلفی پر حکومت نے جواب نہیں دیا۔ کیس کی سماعت کے دوران امریکا میں پاکستان کے سابق سفیر حسین حقانی کی سفیر عاصمہ جہانگیر نے کہا کہ حسین حقانی سے رابطہ کے لیے ایک سے دو دن لگتے ہیں ۔

ان تک آزادانہ رسزائی حاصل نہیں ۔حسین حقانی کو سیکییورٹی کے ہمراہ ررکھا گیا ہے۔ جس پر جسٹس جواد ایس خواجہ نے کہا کہ ملاقات نہ کرانا انسانی حقوق کی خلاف ورزی ہے۔ عاصمہ جہانگیر نے کہا عدالت حقانی تک آزادنہ رسائی کا حکم نامہ جاری کرے جس پر چیف جسٹس نے حکم نامہ جاری کیا کہ حسین حقانی سے عاصمہ کی 11 بجے ملاقات کرائی جائے اورحقانی اور عاصمہ کی ملاقزات سپریم کورٹ مین بھی ہو سکتی ہے۔ چیف جسٹس نے عاصمہ جہانگیر سے استفسار کیا کہ وہ کس فورم سے تحقیقات چاہتی ہیں* .عاصمہ نے جواب دیا کہ اس فورم سے تحقیقات چاہتی ہوں*جہاں*تحقیقات قانون کے مطابق ہو. اس پر چیف جسٹس نے کہا کہ تحیقات کے لیے اعلیٰ عدالتی کمیشن تشکیل دے سکتے ہیں .انہوں*نے کہا کہ رینٹل پاور کیس کی سماعت کرسکتے ہیں*تو میمو کی کیوں* نہیں. آرمی چیف اور ڈی جی آئی ایس آئی چاہتے ہیں*کہ تحقیقات ہوں*.حسین حقانی نے خود بھی تحقیقات پر رضامندی ظاہر کی.اس موقع پر جسٹس جواد ایس خواجہ نے کہا کہ پارلیمانی کمیٹی میمو کیس میں قانون کے مطابق کارروائی نہیں*کرسکتی. چیف جسٹس نے عاصمہ جہانگیر کو مخاطب کرتے ہوئے کہا کہ آپ ثابت کریں*میمو سیاسی معاملہ ہے. انہوں*نے کہاکہ میمو میں*فوجداری الزامات بھی ہیں اور سول بھی . کمیشن اس وقت بنائیں*گے جب آپ اتفاق کریں*گے.

ISLAMABAD - Asma Jahangir, counsel for former ambassador of Pakistan to US Hussain Haqqani, has declared that petition regarding Memogate was not a court issue, in the very first place.
Talking to media after her 4-hour consultations with Haqqani, she announced that Haqqani had termed the issue as a purely political matter, which could be only presented before a parliament committee.
Asma Jehangir said that the issue was deliberately blown out of proportions, and reminded that the very (American) national, who ignited the whole issue, never belonged to Pakistan in first place.
She also emphasized that the issue did not fall into the preview of the Supreme Court; and not even a judicial commission was required, since a parliamentary committee had already been formed for the purpose.
She also expressed her fears for attempt on Hussain Haqqani’s life, as “we are already receiving threats.."
Asma Jehangir also reminded that Mansoor Ejaz had already confessed that he had never met Haqqani in the first place, stressing that her client was being blamed for the episode, needlessly, and had resigned because he was getting controversial over barrage of allegations.
Expressing her exasperation over being declared as a culprit by Supreme Court “without giving her a chance to explain”, she said that Mian Nawaz Sharif would have to file a FIR and than record his statement in front of a magistrate.
