It is Haram to declare somebody a "Kafir" who says "Assalam-o-Alaikum"

Khalid bin Waleed learnt from this that (Book #005, Hadith #2319) he should not judge someone by intention, but rather by his actions. This helped him in the time of Musailamah Kazab, who used to claim to be the brother of Muhammad and another messenger.

Muja'a was a man who spent some time accompanying the Prophet (saw), and he was from the same town as Musailamah and later was captured, by Kahlid bin Waleed, among followers of Musailamah. Muja'a said to him: "Assalamu 'Alaikum Wa Rahmatullah." Khalid looked to him and said: "Now you give me salaam?"

He (Khalid bin Waleed) consulted with other sahabah and he killed Muja'a, because he judged his kufr actions NOT his intention.

Narrated Usama bin Zaid: Allah's Apostle sent us towards Al-Huruqa, and in the morning we attacked them and defeated them. I and an Ansari man followed a man from among them and when we took him over, he said, "La ilaha illal-Lah." On hearing that, the Ansari man stopped, but I killed him by stabbing him with my spear. When we returned, the Prophet came to know about that and he said, "O Usama! Did you kill him after he had said "La ilaha ilal-Lah?" I said, "But he said so only to save himself." The Prophet kept on repeating that so often that i wished i had not embraced Islam before that day. (Sahih Bukhari: Book #59, Hadith #568)

And that is why you should not get your deen from Hadith, both these hadith which you yourself posted in this very thread contradict each other. Allah s.w.t did not give anyone the authority to declare anyone kaffir nor can you kill anyone for becoming apostate.

Even the Prophet s.a.w was guided by Allah s.w.t as to who was a mushrik or kaffir and what to do with them, so even if the Prophet declare someone a mushrik or kaffir it was by Allah's guidance. Once the Prophet s,a,w left this world that chain of communication ended.
