Contempt-Case-PM-Gilani-to-Appear-Before-Court-Tomorrow.jpg

Ex-Prime minister Yusuf Raza Gilani-led renewed campaign against the independent judiciary, portraying it as being against the PPP and in favour of the PML-N, is a complete lie and based on incorrect facts but is orchestrated purely for political goals to the benefit of the corrupt and convicted.

The PPP (also desi liberals) propaganda campaign against the judiciary is aimed at maligning the judiciary, as if it is soft towards the Sharifs but is against the Zardaris and Gilanis of the ruling party.

The anti-judiciary campaigners allege that while Gilani is convicted and being sent home, Shahbaz Sharif's Punjab government is running on a stay order; the corruption cases of the PPP leaders are the focus of the Supreme Court attention, which, however ignores taking up cases of Sharifs' loot and plunder; and that why the Supreme Court acquitted Nawaz Sharif in 2009 in the Oct 12, 1999 hijacking case after a lapse of nine years.

The facts are, however, altogether different and prove the government's campaign as totally absurd and a pack of lies. The following are the lies versus the facts:Lie: The PPP campaign says that Shahbaz Sharif's Punjab government is running on a Supreme Court's stay order.

The Fact: On March 11, 2011, in the wake of claims that the Punjab government was functioning on account of SC's stay order the Registrar SC formally issued a press statement, advising the people to check their facts with the registrar before making statements on sensitive matters. Following an order of the CJP, a search was carried out in the presence of a team of 10 journalists but there was no such stay order found pending before the SC. The chief justice had also asked the then Advocate General of Punjab, Khawaja Mohammad Haris, to clarify whether any case relating to stay being granted in favour of the Punjab government was pending in the Supreme Court.

Complying with the order of the court, Khawaja Haris visited the office of the registrar and examined the record and found no case pending. The registrar also submitted his report to the chief justice in which he suggested that if any individual had information about such a stay order, he should bring it to the notice of the court. The chief justice also offered that if any such case was pending, it would be fixed before the court on March 14, 2011.

In future, the chief justice said in his order, if anyone intends to make any statement in the above context, he should check his facts with the registrar instead of coming out with a version, which is not supported by the court record.

Lie: The PPP anti-judiciary campaigners allege that Nawaz Sharif was acquitted in the hijacking case as an exception and there was no precedent in the past that an appeal is entertained by the Supreme Court years after the high court's order.

The Fact: In July 2009, Nawaz Sharif was acquitted in the plane hijacking case by the Supreme Court, which annulled the Sindh High Court's verdict. The Gilani government, whose attorney general was Sardar Laif Khosa (now governor Punjab), supported the PML-N chief appeal's and did not raise any objection, which means the prosecution supported Nawaz's plea. On the day of SC's order acquitting Nawaz Sharif, Sardar Latif Khosa while talking to newsmen hailed the judgment as a "commendable decision, which would further strengthen the democratic process.

Regarding the lapse of nine years, the PML-N chief's counsel along with the appeal also filed an application to condone the delay, which was allowed by the Supreme Court on the basis of past precedents and following the appellant's plea that he was exiled soon after the high court's decision against him. After his return from exile in 2007, he contended that he did not file the appeal before the Dogar court because the PML-N never accepted it as a valid court. Additionally the past precedents quoted included cases of some ordinary Pakistanis where they were allowed to file appeals before the SC even after a lapse of seven years.

Lie: The Supreme Court is accused of taking up PPP leaders' cases but not any of the corruption cases relating to Sharifs.

The Fact: There is no corruption case pending before the Supreme Court against Nawaz Sharif or Shahbaz Sharif. The name of Nawaz Sharif, besides several other politicians, journalists etc, however, appears in the Asghar Khan case, also known as Mehrangate, which is presently being heard by the Supreme Court. While the PPP, following the NRO judgment, has been demanding for the early taking up of the Asghar Khan case but despite repeated directions from the Chief Justice of Pakistan the government of convicted Gilani is not producing before the Supreme Court the all important inquiry/commissioner reports. Apparently in a bid to secure two former generals, one of whom was Benazir Bhutto's ambassador and the other was awarded medal for upholding democracy, these two reports have been misplaced.

The Fact: The corruption cases against Sharifs were closed by the accountability courts over 10 years ago following a request by the then NAB chairman. These corruption cases are still lying with the accountability courts but the convicted Gilani regime did not allow its tamed NAB to get these cases re-opened for which merely the NAB chairman had to write to the concerned accountability courts.

Instead on October 11, 2011, the then closest of all presidential aides, Babar Awan, had confirmed to The News that the corruption cases against the Sharifs had been shelved by NAB on the directions of President Asif Ali Zardari. Babar Awan said that President Asif Ali Zardari had done this to bring an end to the condemned policy of political persecution. He explained that there were many in the PPP who wanted the government to aggressively pursue the corruption cases against Nawaz Sharif and other members of the Sharif family, but President Zardari decided otherwise.

The Fact: The alleged corruption case against Nawaz Sharif as "revealed" by interior minister Rehman Malik is neither pending before any court nor being probed by the FIA or NAB. Instead Malik said that he is sending the case to NAB for probe.

The Fact: In Sharifs disqualification case, it was the PPP government which filed appeal against the order to get Shahbaz Sharif government restored. The Gilani government had filed four review petitions against the Dogar Court's verdict disqualifying former prime minister Mian Nawaz Sharif and his brother Mian Shahbaz Sharif from contesting elections and holding any public office.

Yes, you can say ansar abasi is a "Bias Journalist" (who dont follow desi liberals views are either extremist/ talban or bias, same wordings are used for Ifthikhar chudry by these so called liberals)

Few Other Facts about Judiciary actions:

1. Corruption charges against Sharif brothers was stopped by president himself:

NAB chairman Admiral (retd) Fasih Bokhari hinted at a ‘hidden deal’ when he said that President Asif Ali Zardari had instructed him not to open cases against Mr Nawaz Sharif because he did not want a political confrontation to go up in the country. “The NAB chief in his fresh interview with a magazine has clearly mentioned that he has not opened cases against Nawaz Sharif on the directives of President Asif Ali Zardari,” Dr Siddiqua said.

2. In Rental Power Project, Government own report says that its has allot of mis managements in this project:

The government released on Friday the Asian Development Bank report on rental power projects (RPPs) which highlights major inconsistencies and weaknesses in the contracts, violation of procurement and regulatory procedures, lack of available capacity utilisation and up to 87 per cent increase in customer tariff in two years.

3. Hajj Corruption case FIA admited in its report:

“People related to Haj operations in the kingdom have admitted that officials of the Pakistan Haj operations requested them to overcharge pilgrims for a price, but they were not willing to give the statement in writing because the Saudi government would not allow them,” FIA Additional Director General Syed Javed Ali Bukhari told a seven-judge bench.

4. Government own alliance party took the cases to the courts. Rental power project was taken by Faisal Saleh Hayat, and Hajj Scandal was taken to the court by Azam Swati (that time he was JUI member, and JUI was the part of Govt).

5. PMLN also took some cases against PPP govt to the courts. While on the other hand, PPP members used to say tell the "corruption" stories of punjab in TV shows, but they never take any case against them in towards the court. Similarly, Rehman Malik claimed that he had evidence, but nor he used NAB to investigate the cases nor he presenting those evidence in any court.

3. Gilani PM-ship ended because of NRO case. NRO, (aka BiBi k qaber ka trail) was not defended by PPP at any stage till the final judgement of court. But when the final decision was taken PPP start disobeying the court decision. Fact is PPP was not in mood of implemented NRO decision from day one, but still the court give them a relaxation of more than 2 years.

Read the article, few cases issues are mentioned there...

Court can not investigate, all the cases you mentioned are not compeleted because of investigation issue.. not because of SC.
