if coincidentioally a DISTRICT SP (CSS OFFICER) gets a clash with a major ,, both are 18th grade officers or an ASP with a captain .......... who will be on the winning side........... SP and ASP has power of law and major and CAPTAIN has name of army.............. or in other words i want to ask that who has more powers and authirity ASP and SP or captain and major?? i got this query from css forums.

bro ma but aik taraf ap ne jaha k major ko koi hath nahe laga sakta dusri taraf sp ne kaha k SP major ki dhoti utarwa sakta ha...................so this hasn't confirmed that who has more authority/powers????

Since it seems that you are preparing for CSS - i just wanted to let you know that technically its JAG branch (Judge Advocate General). It basically provides legal services to the military - basically the officers in JAG also includes lawyers.

There could be two answers - one in reality and other one in ideal condition.

In reality - as someone said above 'jiss ki laathee uss ki bhainss" or in other words whoever has the biggest guns or more lethal firepower. Now you do the math of who has the biggest guns in this case :-)

As to what will actually happen on a Pakistani street - legally I don't know but common sense dictates that since the civilian officer will have more jurisdiction compared to the military officer then he should take precedence. Specially if the place where the dispute takes place in not a cantt area and will basically be a remit of a civilian officer and civilian law would apply.

The bigger question here is does the military officer once in the civilian areas are governed by the civilian law or are they still bound by the military law. Lets say if a active duty military officer commits a murder (as in the case of the rangers in Karachi last year where they killed a young man) in the city even while on duty then he should be tried by the civilian court unless the military officer kills a person while discharging his duties - then i guess there are provisions in law that gives the military personnel immunity from civilian prosecution.

But this is a legal and technical issue and has to be researched accordingly.
