The Supreme Court of Pakistan is hearing the petition regarding memogate case.

A nine-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry will hear constitutional petition regarding alleged memo today.

The CJP, during his remarks, said that there is no possibility of military takeover in the country as the rule of law will supreme in the country and the courts will not validate any unconstitutional step.

He said that the army chief and the ISI head have appealed to the court for the thorough investigation of the memo issue.

Earlier, the federation submitted its reply in the Supreme Court on Thursday in which it was said that according to Article 184, the memo issue does not fall in jurisdiction of the Supreme Court; rather, Parliamentary Committee for national security is authorised to conduct an inquiry into the matter.

The federal government and President House already have rejected the contents of the memo, saying that any representative of the federation or Aiwan e Sadar has nothing to do with the memo.

Mansoor Ijaz and Hussain Haqqani also submitted their replies in the apex court on Thursday. Both of them were of the view that they are unwavering and committed to their stances; if the court orders them to appear, they are ready for that, they said.

The federation said the government had already rejected allegations published in the Financial Times, adding that resignation also had been taken from Pakistani ambassador to the US Hussain Haqqani.

According to federation stance, the matter has been handed over to the constitutionally formed committee of the parliament comprised of elected representatives who are reviewing the matters in detail and depth.

Moreover, according to the Constitution, the parliament is a supreme institution which can take any step while keeping in view that very sensitivity of circumstances.
