Our memories are short but not that short particularly with respect to Justice Iftikhar Muhammad Chaudhry:
Oath on PCO 1999
1. In January 2000, Justice Iftikhar Chaudhry, then a serving judge on the Balochistan High Court (BHC), was one of the first judges to take the oath on the Provisional Constitutional Order (PCO) of the military dictator General Musharraf in violation of Pakistans constitution. This allowed him to be elevated to the Supreme Court to fill one of the vacancies left by the 11 judges who had resigned in protest at taking this oath.
Validation of the military coup
2. On May 13, 2000, Justice Iftikhar Chaudhry was one of the 12 Supreme Court judges who validated the military coup of Gen Pervez Musharraf. They ruled that the removal of the elected government of Nawaz Sharif was legal on the basis of the doctrine of necessity.
Forced resignation of President Tarar
3. In June 2001, Justice Iftikhar Chaudhry was one of two judges who visited the President House to convince the then President Rafiq Tarrar to resign, and make way for Gen Pervez Musharraf to assume that office.
Validation of Musharraf Military Rule
4. On April 13, 2005 in the Judgment on 17th Amendment and Presidents Uniform Case, Justice Iftikhar Chaudhry was one of five Supreme Court judges who dismissed all petitions challenging President Musharrafs constitutional amendments.
In a wide ranging judgment they declared that the Legal Framework Order (LFO) instituted by General Musharraf after his suspension of the Constitution, the 17th Amendment which gave this constitutional backing, and the two offices bill which allowed Musharraf to retain his military uniform whilst being President were all legal.

Selective judgement on PCO judges
Constitution Petition Regarding PCO Judges:
The decision of the court in CONSTITUTION PETITION NO. 08 and 09 OF 2009 from 14 member bench headed by Iftikhar Muhammad Chaudhry, summarily removed all justices of higher judiciary who were not part of it as on November 2, 2007. There removal was so ordered on ground that advice of de-jure Chief Justice of Supreme Pakistan was not obtained in these cases. In the same decision the court had held the de-jure Chief Justice between the period of November 3, 2007 and March 22, 2009 was Justice Chaudhry.
There were three groups of these removed justices.
  • Those who were elevated to higher courts and initially took oath on PCO.
  • Those who were elevated to higher courts after restoration of constitution, and were appointed by General Pervez Musharraf.
  • Those who were elevated to higher courts after restoration of constitution, and were appointed by Asif Ali Zardari.
This decision have resulted in situation where:
  • Newly appointed justices who never took any sort of oath on any PCO have been removed.
  • Sitting justices who took oath on PCO 2007 are still acting as justices, though their cases are to be sent to Supreme Judicial Council.
  • Sitting justices who accepted reappointed and took oath from Justice Dogar as still acting as justices of court with no action.
  • Justices who took oath on PCO of 1999 are still functioning as justices of higher judiciary.

As far I remember. American puppet Mushi tried his best to get rid of CJ but when People of the country are behind a personality, none can do shit ;). That's how CJ came back and he has full backing of people of Pakistan.

The man stood for the truth when he knew he even could get killed for this. Every true Pakistani support this guy.

The man stood for the truth when he knew he even could get killed for this. Every true Pakistani support this guy.

Why are you going behind the boundry? I have posted an article which I thought to be shared with everyone. I am not going to debate on what a great guy he was. He fought for his own interest when he knew that he would get support from upcming PPP and Nawaz Leauge. The facts will remain facts prove me if I am wrong but come up with some logical arguments instead of a blind praising poem! I look forward to hear from you.

You cant assign a name title to this post. What you really can do is prove me if I have mentioned anything wrong! By the way would you like to mention atleast 10 things he did for the people of Pakistan.

very good sharing bro. We need this kind of eye openers.

Our Jahil awam is so stupid they create idols after idols for them, time and again, never learn any lesson what so ever.

All those who worship Chaudhry should read all these truths, they hury for sure, but they still are truths.

Chaudhry acted as puppet for army general, used to do haazri in his darbaar every day and now trying to be champion of judiciary by dis crediting parliament and democracy.

Shame of Justice Chaudhry.

I wonder why we overlook the fact that after the media now we have a somewhat free judiciary too that is trying to exercise its authority finally.
If nothing else this movement achieved two important things:

1) It showed people that if you rise up against even against the strongest tyrant they have no option but to quit.
2) It laid the foundations on which we can form a free judiciary and hopefully from now on the courts wont give authority to generals usurping power unconstitutionally.

This is why we can hope for an army free government in future which is an achievement if you look at it critically.

He might not be the perfect example of an upright man but atleast he took a stand at some point.

You are right bro, but the problem is media and judiciary are doing exactly the same mistakes what Army and agencies and establishment did and failed. They are becoming dictators in their own right.
Judiciary and media both are not ready to have any code of conduct, any discipline while at the same time they want to tie every body up!!!!! a clear cut hypocracy...

We dont need judicial dictatorship to replace army dictatorship bro. They too have to be in limits.

I would like to add at the end of the blog that Chief Justice Iftikhar Mohammed Ch. was the one who changed the Judiciary's way not to follow the Dictator (Mr. Syed Musharraf Pervaiz) and promulgated the sanctity of the Pakistani Constitution when all the Politicians, Bureaucracy and all walks of of Pakistani nations were licking the sole of Mr. Musharraf.

Please do not forget this brilliant career of such dignitary who is ruling the nation in real senses and still he is fighting for supremacy of LAW although there is no change in the minds of ruling class and resisting him with more stupidity.

There is vast difference between taking a stand and hypocrisy! I have nothing against him but hate to hear when people call a double faced person their hero!

Then let us get together and define those limits instead of bashing the people who helped create the freedom in the first place!

I mean this is all we do. We pit one institution against the other. If the parliament is corrupt we beg the army, if the army goes overboard we beg the judiciary, if the media goes overboard we beg for censorship.

My point is that since we are getting our institutions out of the clutches of self serving goons we should now work towards strengthening them through legislation instead of looking towards another institution to counter and challenge it!

This trend gives rise to hero worship when one person fells another and we sing their praises and then he becomes a tyrant and we look for yet another.

If institutions are strong from within then wont need to look for heroes to take care of us. These institutions will be the saviors themselves.
