نوے روز میں الیکشن کرانے کی راہ ہموار؟وکیل الیکشن کمیشن کا اہم بیان

سپریم کورٹ میں ازخودنوٹس کی سماعت کورکرنیوالے صحافی فہیم اختر نے دعویٰ کیا ہے کہ نوے روز میں الیکشن کرانے کی راہ ہموار، الیکشن کمیشن کے وکیل نے انتخابی مہم کا وقت کم کرنے کی رائے دے دی، بولے انتخابی مہم کو 14 روز تک کیا جاسکتا ہے۔

فہیم اختر کے مطابق وکیل الیکشن کمیشن نے کہا کہ انتخابی مہم کا دورانیہ دو ہفتے تک کیا جاسکتا ہے جس پر جسٹس منیب پر جواب دیا کہ آئین پر عمل کرنا زیادہ ضروری ہے۔

اس موقع پر اٹارنی جنرل نے کہا کہ نوے دن سے تاخیر پر عدالت اجازت دے سکتی ہے،جس پر چیف جسٹس نے جواب دیا کہ یہ نہ سمجھیں عدالت کسی غیر آئینی کام کی توسیع کریگی۔

چیف جسٹس نے مزید کہا کہ آرٹیکل 254 کا جہاں اطلاق بنتا ہوا وہاں ہی کرینگے

اس سے قبل اٹارنی جنرل نے کہا تھا کہ صوبائی عام انتخابات 25 اپریل سے پہلے ممکن نہیں۔

جس پر جسٹس منیب نے جواب دیا کہ نیت ہو تو راستہ نکل ہی جاتا ہے،الیکشن کمیشن اور متعلقہ حکام چاہتے تو حل نکال سکتے تھے، انتخابی مہم کےلئے قانون کے مطابق 28 دن درکار ہوتے ہیں نوے روز کے اندر انتخابات کےلئے مہم کا وقت کم کیا جاسکتا ہے۔

اٹارنی جنرل نے کہا کہ صدر الیکشن کی تاریخ صرف قومی اسمبلی تحلیل ہونے یا ملک بھر میں انتخابات ہوں تو ہی صدر تاریخ دے سکتے ہیں،

چیف جسٹس نے ریمارکس دئیے صدر کے صوابدیدی اور ایڈوائس پر استعمال کرنے والے اختیارات میں فرق ہے،

اٹارنی جنرل کاکہنا تھا کہ الیکشن 90 روز میں ہی ہونے چاہیں آگے نہیں لیکر جانا چاہیے۔
