Respected Sir,

It has been more than four days since the entire nation is mourning the massacre of our children in Army Public School Peshawar and waiting for concrete steps towards from the government and the armed forces to eliminate terrorism from this soil. As you are aware, the failure of our judicial system, incompetence and unwillingness of consecutive political governments of the country towards punishing all the terrorists which were caught by our security agencies has led to the sad situation we’re facing today.

It has been more than a decade that we have been giving sacrifice of the lives of our brothers and sisters for this war against terror but haven’t yet punished any culprit despite being sentenced to death. Now, tons of water has flowed under the bridge and these terrorists have started to massacre our children, future generation of Pakistan which in any case, is not acceptable to us.

Enough is enough, now we are not ready to give a single drop of our blood for this war unless these arrested and convicted terrorists are hanged without any delay. We have given enough now it’s time for payback; they have to face the music. We do not have any trust in our judiciary and political hierarchy, we as a people, demand you to intervene and use your power to compel the judiciary and government to hang these convicted terrorists. We as a nation are heavily indebted to the innocent people who became the victims of terrorism.

Sir, it’s time to listen to the nation as the Army is our last hope for justice, please hang all the terrorists without any mercy whatsoever, Pakistani nation is standing with our Pak Army.

I say hang the government as well who has used the public funds not for combating terrorism but in false advertising to spread disinformation, to build jangla bus but not to train and arm our police, who wasted money on foreign trips with their families and favored people but did not invest in basic infrastructure... wasted their time in declaring most favored nations to those who are actually funding, training, supporting the very terrorists we want to hang as the only solution to end terrorism.

And yes I fully support hanging each terrorist, target killers, bhatta khores - whether they belong to a banned outfit or a political party. Go all the way. I am sick of them.

Why are you petitioning the COAS in the first place ? Law making and carrying out the law is the work of the civilian govt, and that too without ant petitions, thats what its there for ? Its not the job of the Army to do this, even if military courts are formed, carrying out the execution will still be the job of the civilians.

Instead of hedging all your bets of the Army Chief, strive for a proper civilian govt, not this noora zardaaku cocktail mishmash we have now.

My detailed proposals about setting up Military courts for opinion .

I wish to give my opinion on what is the legal way to handle Terrorism and I fervently desire that people should comment on it .


My advise is to create three type of new courts to deal with Terrorism and instances of extreme violence and requires a rethink on legal system and constitution itself.


a) a) Military courts For areas where actual Combat operations are ongoing and militants are fighting Pakistan army day and night .
Here two types of courts need setting up , one type , i.e the Military trial court should be created but by additional amendments in the Army act and enhance the scope of these courts to properly cover the Antistate actors be they actual militants or armed smugglers or Land grabbers .

As without fuders and safe havens no crime can go on and land or property grabbers and smuggler s are usual source of protection to private armed men. The second type of the military court should be an appeal court which should not be High court or the supreme court as I know well that both high and supreme court do not perform well in murder cases and act like post offices , appeals are decided in not more than 10 minutes in these routinely as they are not interested in justice .

So these The Second type of military court can be called the Assessment and Appeal Military court but its composition should be very different . It should be headed by a military officer , its decisions should be made a jury composed of civilians with experience of administration or be science experts . The court should have two advisers to advise them on law , one a lawyer of anglosaxon law and other a proper Madrassa or University educated Sharia lawyer .

So that the crime is assessed from many pints of view and these courts should have some relaxed guidelines as our state evidence act and logic systems of anglossaxon law contravene scientific logic system so these courts will have parameters and guidelines but need not act strictly using anglosaxon law parameters and rely more on Science . The final appeal should reside not with supreme court but Army chief . One lawyer be allowed for accused. Crime need be proved or else as convincingly denied . Picture and scientific evidence be admissible but need not be basis of conviction . Jail punishments should not be long and death sentence should be based on safe conviction.

b) Military courts For areas where there is chronic law and order situation but there is no evidence of organized war against Armed forces yet. Places like Karachi Baluchistan.

Here too Military courts should be created but the composition of trial courts should be like Military Assessments and Appeal court proposed above , but this acting instead as a first trial court , meaning that it should have a military Brig as head , a civil jury to make decisions , two legal advisers one of anglosaxon law and other of sharia law as friends of court . One lawyer be allowed per accused. The civilian members should be protected and paid for jury services for atleast five years .

The court friend lawyers should be part of military service not parttimers. In these areas the militancy , Qabza activity and smuggling and prostitution go side by side so crimes relating to such activities should be heard by these courts . Areas like Karachi are prime places for such courts but they need to be setup in some number in large Urban areas of Punjab and Balochistan as well .

They should try to follow PPP and CrPC but need not be entirely bound by it or by evidence act as it exists now . The appeal from such courts should reside with Supreme court directly and finally to the President and Presidential office dealing with it be properly manned it should not be rubber stamp like ever erring Supreme court of Pakistan. Every death sentence be scientifically and legally analyzed.

c) Military courts For rest of Pakistan third type of military courts should be setup made up of above like consistency but their job will be to oversee work of Session and civil judges and they can review cases decided by them if they pertain to murder , rape , Dacoity , Qabza activity and narcotics and smuggling , they will review ATC cases and they should follow PPP, CrPC and Qanun Shahadat and their role is a kind of executive Ombudsman and their decisions should be appealable to Supreme and President and not High courts.

No lawyer who misses a court appearance for more than twice for what ever reason be allowed to follow a case and lawyers who consistently prolong case should have their bar memberships suspended for six months by a separate office to be created to oversee lawyers conduct .

The idea behind the above suggestions is that The law is not like science where only one system exists and we need not only have to follow anglosaxon law , we need to use our common sense in the form of civilian jury , we need to apply science , we can take advise from Quranic law and principles , but except for active combat zone cases we need a good appeal mechanism . My proposals see a reduction in scope of work of defective and ill performing high courts and it brings in Islamic law advise and it gives flexibility to the system . I wish people to comment on this , creating Military courts without safeguards and modifications is not proper , similarly to rely on current legal system is foolish and unjust so some thing has to be done .

I feel that controversy of military courts is currently being used to consume some of the fiery temperament in the army and civilians post massacre and to divert people from Blaming Imran Khan , Nawaz Sharif , Interior minister , KPK CM, and SC CJ or even Raheel Shareef for the lapse . If this is so we are doomed anyway as good politics is no replacement for action , ever , either in this world or the next.

I have tried to reduce military- ness of military courts and at the same time try to address the issue.

War zone courts have to be firm otherwise these wild tribes will gain and even make people slave as they did in PreTaliban era in internecine war in Afghanistan.
