I don't think Asma Jahangir is a lawyer:
A court is always a court of law.
She says Pakistan Supreme Court is not a 'people's court'. This is absolutely non-sense.
She says Pakistan Supreme Court is an 'Establishment Court'. This is absolutely non-sense.
On fundamental Rights:
She claims fundamental rights of her clients: Mr. Hussain Haqqani have been affected by the Supreme Court's short order.
It is all over the world a principle of jurisprudence (Article 8 (ii) of European Convention on Human Rights) that Fundamental Rights get suspended if and when you are suspected of having committed an offence or having done something contrary to the law. If you later on prove that your fundamental rights were wrongly suspended, you can claim compensation or another type of legal remedy.
Rule of Law:
It is strange interpretation of this legal term which Asma Jahangir has given. She con notates if a citizen goes to a court to get determined a point of law or of fact, it is violation of the Rule of Law.
Perhaps she lives in a paradise of fools
I think her law degree is 'via bathinda' law degree or similar to the one which her elder brother Babar Ewan has.
She and PPP is politicizing the legal issues
Parliament is a law-making institution and is not a substitute of a court of law.
To the extent of the President of Pakistan, the matter must have been investigated by high level commission and then brought to the Court for a declaration that an offence has been committed or not and then brought to the Parliament for a decision whether the President should be impeached or not.
To the extent of Hussain Haqqani - it is necessary that he must be within a guaranteed access of an investigating commission and the court.
It is a right decision that he has been banned from going out of the country.
This does not mean his fundamental right of free movement has been violated.
His fundamental right of free movement has been suspended as he is wanted in the commission of an offence against the state.
If he is found innocent that right will be restored and he will enjoy it as usual.
This rule is applied every where in the world.
The fundamental rights are available to a big exception i.e. 'if or subject to the condition' that you have not done anything in violation of the law of the land.
Her hue and cry is un-understandable and illogical - may be politically motivate.
Every patriotic citizen of Pakistan will feel sorry for these monopolizers of wisdom and power 'Theke-daars' in Pakistan.
