Blanket immunity to President:

Constitutional immunity is available to the President.

Yes but not unquestionably or absolutely.

He has to qualify for it.

Had the President been a robot, the immunity granted by the constitution would have been a blanket immunity or absolute immunity.

In the present case, President is composed of many elements: (1) the President (2) Asif Ali Zardari as a person (3) A leader of PPP.

Now, this has to be decided money in Swiss banks is claimed by (1) the President of Pakistan or (2) by Mr. Asif Ali Zardari as an individual or (3) the party leader of PPP.

Nobody can deny constitutional immunity is available to the acts which the President did as president of Pakistan nor by Asif Ali Zardari as an individual or the party chief of PPP.

Here PPP is confusing the public opinion by claiming that Asif Ali Zardari has a blanket immunity applicable in all cases which is bound to be incorrect.

Who will decide in all the three positions that Asif Ali Zardari should be granted immunity.

Simple answer is - Supreme court of Pakistan.

Because Supreme Court is the only institution that has been granted the constitutional function of interpreting the constitution.

This function cannot be granted to the parliament. No doubt they are makers of the constitution. As at any time, they could say-they meant this they meant that as they are saying now. Therefore, this role has to be taken up by an impartial and independent institution like Supreme Court of Pakistan.

PPP does not say:
there is no money in Swiss Banks,
it is not claimed by Asif Ali Zardari
this money has not been obtained through illegal means while during the previous regime of PPP in Pakistan and
Mr.Zardari is neither pleading guilty nor returning money to the people of Pakistan
