Swiss Muslim girls must take swimming classes with boys: Europe court

STRASBOURG, France: Muslim parents in Switzerland cannot refuse to send their daughters to mixed school-run swimming lessons, Europes rights top court ruled Tuesday, responding to a challenge by a Turkish-Swiss couple who argued the classes violated their beliefs.

The European Court of Human Rights accepted that the refusal by authorities to exempt girls from the lessons interfered with their freedom of religion.

But the interference, it said, was justified by the need to protect the children from social exclusion.

School plays a special role in the process of social integration, particularly where children of foreign origin were concerned, ruled the court, which is based in the eastern French city of Strasbourg.

Swimming lessons are not just to learn to swim, but above all to take part in that activity with all the other pupils, it added.

The case was brought by a Turkish-Swiss couple who argued that forcing their pre-pubescent daughters to attend the classes violated their faith.

The court found that the Basel authorities had tried to accommodate the parents beliefs by, for instance, allowing the girls to wear the full-body burkini swimsuit.

The court also said that the fine of 1,400 Swiss francs (around 1,300 euros) imposed on the couple in 2010 after a warning was proportionate to the aim pursued of getting them to comply with the regulation.

The case was brought by Aziz Osmanoglu and his partner Sehabat Kocabas, whose daughters were born in 1999 and 2001.

All their appeals were rejected by Swiss courts, after which they took their case to Strasbourg.

Tuesdays ruling is not final. The couple has three months to appeal the decision.

I am not Swiss and France/Switzerland is not my home. If I chose to live there, why should I expect that those Non-muslims would mold their laws/culture according to my faith ?

Non Muslims in Pakistan are sons of soil , they were here before Pakistan and even before Islam came to this region.

While immigrants adopted Europe with their own free will and left their homelands for the equality , safety and prosperity of Europe.

Swiss court raised a good point, we need to protect the children from social exclusion.

They are not "molding" their laws, they are just arm twisting the Muslim family systems and its ethics. What do you think what is more important for the European people , swimming classes of teenage girls with boys or the freedom of expression?

The rationale you are putting up here mainly comes from two kinds of people; one who are living in Pakistan and have unconsciously developed a bias (prejudice) against people who have migrated to other countries, second from those ultra liberals Pakistani expatriate who have forgotten who they are.

Muslim living in the west don't expect them to change their laws in their favor, however these countries should not enact or change their laws just to punish Muslim immigrants just because they look different.

As far as I know, swimming classes are mandatory at school level in many European countries. Means everyone needs to take such classes regardless of religious belief gender and race. Brother, moral values are universal in every religion, be it orthodox Jewish family, a catholic or Hindu, they all have more or less same value system even today. I am not aware, because I don't live in Europe, that swimming is mandatory in some European countries but I do know that forcing Muslims to do something against their right to exercise their freedom is something new and definitely against much cherished culture of freedom in those countries. I do also know that Parents in US have the freedom to opt out from any program that they feel inappropriate for their kids.

Can people come back to their own countries have a lot to do with the prevalent condition and at some point people may have to come back regardless.
