SC dismisses petition against drone attacks

ISLAMABAD: The Supreme Court of Pakistan has dismissed a petition seeking to halt drone strikes in the country’s tribal areas.

The petition was being heard by a two member bench headed by Justice Tassaduq Jilani.

The apex court stated that affairs related to drone attacks were not within its jurisdiction and the petition related to security, foreign policy and the country’s defence.

Justice Tasaaduq Jilani remarked that the court’s interference in the issue of drone attacks was not feasible.

I think they are right.. Its foreign policy and as long as people(Parliamentarians) are doing things allowed within the constitution, it cannot be challenged in courts.

We don't know the constitution but the judges might know, and unless someone specifically present a clause of the constitution that clashes with the drone attacks inside Pakistan by a foreign country(with or without Pakistan's permission) the case dismissal seems right.

I am unaware of the details of this judgement or determination but it seems to be timed with battle for next chief justice and message given is that successor will not be different from predecessor . The earlier judgement by supreme court when drones first started and a more genuine petition was lodges , the court under direction of probably this CJ said something about lack of jurisdiction . This was bad sign for future and a open permission to aggressors that drones are of no concern to SC. This is a very wrong logic , because those who could help in preventing or reducing drone attacks , the GHQ was in SC jurisdiction. If we cannot help our tribal people then we cannot reject their claim that they need to left alone to protect themselves and we redraw our map.

Buddy this was a petition asking the judges to review the violation of constitution and the judges threw it out. Amazing ..simply amazing !!(clap)(clap)

Yeah our judiciary only knows to take up cases against the army, blame FC for baluchistan violence without proof AND in doing that they are not interfering in Politics, punishing criminal politicians for only a second..etc etc ...dont expect anything else :)

if that's the case then i guess its wrong to dismiss the petition without hearing.

No i didn't, If Pakistani government allows something(with or without a deal), then its Governments constitutional right to do so. Have Pakistan ever sought courts approval for launching operations in swat,Waziristan,Teerah or any other places? In those operations it is Pakistanis that are killed but the excuse is that they are the terrorists and so they have the right to kill the terrorists without seeking courts permission. Now if Pakistan carries out an operation with international help or allow them to carry out an operation all by themselves for this they also don't have to take courts permission.

If your government is allowing others to carry out operations inside your country then lodging a case saying its a violation of sovereignty will be rejected by courts because if your government allows someone then, no one is violating your sovereignty because it then is the same as doing an operation by yourself.

But yes a case can be made against the government for allowing drone attacks which is killing innocent people..

U know it noora knows it Kayani knows it who gets killed with what. Ig govt is doing something wrong, its people who should stop it by protest or courts. I dont see why u r trying to get all logical since u fail miserably because u r missing a true point and u know it.

Bro, even CJ would be hard pressed to find "Things allowed in the Constitution" to justify killing of its own people, without due process, without charges filled against the suspects, without giving them fair trial, allowing legal representation etc. Drones are illegal in international law, no question of foreign policy matter. What kind of foreign policy in which your nationals get killed, even innocents?


Supreme Court of Pakistan is a stain on human's conscious, it is proven now, without shadow of a doubt.

The logic is simple: if you file a case of murder against a person who has committed a robbery, he won't be charged and the case would be dismissed unless he is brought up to the court on robbery charges..

Did you even read my comment to understand what i said? I said when you file a petition, then your claim must be right to get the case approved in the court. If you file something saying Drones are violation of your sovereignty but in fact they are happening with your governments support then the issue of sovereignty would be dismissed by the court. But if you file a case saying that we want to know the identity of each person who gets killed or saying that the drones are killing innocent Pakistanis so it must be stopped or even holding a case against the government for allowing the killings of innocent people, then i guess you have a case and it will be approved by the court and if its not approved then we have every right to accuse the judiciary of dismissing a valid case.
