Looking at to-days performance, he should return his fee to poor sindh government
who have hardly any money for flood victims.

what a comparison of Pakistan to Japan and Korea.our problem is resources. resources r produced with money. unless we as a nation do not get up against corruption we can not compare our selves with those nations, and they never did all this during the sunamee but after word they made arrangements because they have resources. here if Punjab Govt has announced to close schools for few days to save children from that deadly disease or Sind has closed all educational institutions because they knew that transportation is not possible, what great mistake has been done?. these anchors most of the time try to exploit the non issues and make us fool. plz be aware.as regards Babur Awan, he is the man who is simply idiot and making fool out of ruling class and people of this country. he deserves most serious trial of his KARNAAME.

ISLAMABAD: Senior Supreme Court lawyer and former law minister Babar Awan has been violating SC rulings which bar payment of legal fees from the government exchequer in contempt cases against government officials, whether elected or from the civil service.

The PPP government’s hefty payment to Babar Awan for representing three federal secretaries in such contempt cases will thus be a clear violation of several Supreme Court rulings which prohibit use of public money by the contemnors, legal experts say.

Incidentally, Babar Awan has served as a law minister and is well aware of the fact that he cannot claim legal fee from the government in contempt proceedings. Nevertheless he was quick to send bills of Rs5.5m each to the Establishment Division in Islamabad and the Sindh government. According to a leading lawyer, the payment of fee for contempt proceeding is a potential NAB reference under Corruption and Corruption Practices Act.

Rauf Chaudhry, former Secretary Establishment and one of the contemnors, told The News that the Law Ministry at no point advised them whether or not they are eligible to hire a counsel through public money. Instead, the ministry, when requested for arranging a lawyer, had referred the case to Babar Awan who immediately accepted it.

There are many rulings of the Supreme Court that repeatedly say that the contempt of court is a criminal offence and is “always personal to the contemnors.” Incidentally, the rulings have been delivered in 2009 and 2010, not in the distant past.

“The contempt proceedings are between the court and the contemnor only. This is settled law in that the contemnor may either give explanation or render unconditional apology, etc.” The apex court had recently ruled this in three cases: 2009SCMR477 (Syed Masood Alam Rizvi Vs Dr Muhammad Saeed); 2010SCMR1825 (Shehzad Malik Vs Muhammad Suhail); 2010SCMR594 (Khalid Rashid Vs Kamran Lashari).

In every case, the apex court ruled that the contempt is a matter between the court and the contemnor. It is a settled law that such notices are issued in personal capacity, not in official capacity.

The notice was served to Rauf Chaudhry, for example, when he was secretary establishment. His retirement or transfer to other office does not mean that his successor will be facing the proceedings. This is another story that present secretary establishment, who is also principal secretary to the Prime Minister, Khushnood Lashari, was also served with the contempt notice then.

Not only the bureaucrats have been served with the contempt notices, there are a number of instances where judges and registrars have also faced contempt proceedings but in their personal capacity only. And in no instance, their expenditures were paid by their departments.

A recent example is of contempt notices issued to the serving PCO judges of high courts and supreme courts (PLD2010SC806). In 1998, Justice Shafi Muhammad, who after serving in Supreme Court was posted in Federal Shariat Court, faced contempt proceedings (PLD1998SC388).

In 2002, contempt notice, for example, was issued to a serving District & Sessions Judge (PLD2002SC293 (Muhammad Rashid Ahmed Vs Muhd Siddiqui). Sindh High Court’s registrar was served with the contempt notice in 2002 (PLD2002SC1033) (The matter of Muhammad Sadiq Laghari).

As far as the bureaucracy is concerned, there are very few examples. Apart from serving contempt notices on three federal secretaries and DG FIA in 2010, another instance of recent past can only be traced in 2007 when Inspector General Police of Islamabad and Chief Commissioner were served with such notices in the case of misbehaving with Chief Justice Iftikhar Muhammad Chaudhry when he was placed under suspension by Pervez Musharraf.

I think he is Dockter Awan not Doctor Awan.

Dockter means he was working on a loading dock at the shipping.

Yakeen nahi hota kabhi ya shaks babar awan Tv pay daars a quran bhe deya karta hai ... kya insaan laalach aur iqtedar ki hawas main is haad tak bhe ja sakta hai ... bus allah rahim karay hum sab pay ka gumraahi sai barh ka kuch azab a elahi nahi.

I am agree with you, but you know my brother, Japan, Korea were not like always they are now, they worked very hard even every single person of these countries work for their country and made their nation as a nation. secondly this anchor always critised the other people but noone ever ask him that what is his contribution for his country and for his nation.
