SC rejects Rana Maqbools plea
ISLAMABAD: The Supreme Court has dismissed a petition of Rana Maqbool Ahmed, a former inspector-general of Sindh, in which he urged the apex court to overturn a decision of the Sindh High Court (SHC).
Justice Pir Ali Shah, of the SHC, had on April 28 last year set aside a decision by an additional sessions judge in Karachi in favour of Mr Maqbool. The latter had cleared him of responsibility in a case regarding alleged torture of President Asif Zardari in Karachis Central Jail, when the former IG was in charge of investigations.
Akram Sheikh, who is representing Rana Maqbool, now Punjabs Public Prosecution Secretary, argued that Justice Pir Ali Shah was a stranger to the High Court because he had to vacate his office after the July 31, 2009, judgment of the apex court holding the Nov 3, 2007, emergency as illegal.
Rana Maqbool had approached the Supreme Court for relief against a letter issued by the governments Services and General Administration Department, which passed on a query by the additional sessions judge, Karachi South, declaring him a proclaimed offender.
The sessions judge is hearing a case registered on Feb 9, 2005, at Karachis Artillery Maiden Police Station against former senator Saif-ur-Rehman, his brother Mujeeb-ur-Rehman, the petitioner, ex-DIG Farooq Amin Qureshi and Najaf Mirza, who was then SP of Central Jail, Karachi. All of them were charged with plotting the elimination of Mr Zardari.
The allegations against Mr Maqbool date back to the events of the 90s when Mr Zardari was required for investigations into charges that he was involved in the murder of Justice Nizam Ahmed and his only son Nadeem Ahmed.
