I strongly believe that it is one of the most formidable, remarkable, memorable and historical decision that PM Imran Khan has taken and will be credited for in Pakistan's history.

This will segregate Qadianism from the mainstream Islam and the majority of Muslims and give them all the civil, social, welfare, legal, litigation, acquiring property, possession of assets, protection of their lives and businesses as provided to other minorities of the state of Pakistan.

They will not be allowed to call themselves Muslims in Pakistan and excluded and forbidden to preach their theology to the local communities openly or clandestinely.

we muslims are minorities in most western countries and even in india and look what is happeining to us so we should not do the same to other minorities what we need to focus on the law who has to enforce any violations as per SOP

Then i think you don't know about the rights of "ZIMMI" in Islam. They have more rights then a Muslim member. do read it.

This step will put an end to the confusion that surrounds qadiyanis and it is something that all previous governments only use for political point scoring. Also, if qadiyanis consider themselves as patriotic Pakistanis then they should consider this step seriously and stop calling themselves as muslims.
On the other hand, it is amusing to see how all patwaris have suddenly become pious muslims and sharing posts after posts against qadiyanis and conveniently forgort that their chor leader used to compare Islam and hinduism as same, had business in india and indian spy agents used to work in their factories...

اقلیتی کمیشن اور قادیانی: مسئلہ کیا ہے؟

تراویح سے پہلے چند سطور جلد میں لکھ رہا ہوں کیونکہ بہت سے دوست مطالبہ کررہے ہیں۔ تفصیل کی ضرورت ہو، تو بعد میں کوشش کروں گا کہ تفصیل سے بھی لکھ سکوں، ان شاء اللہ۔
1۔ پہلے یہ بات نوٹ کریں کہ 2013ء میں پشاور میں چرچ پر حملے کے بعد سپریم کورٹ کے فیصلے میں اس کمیشن کے قیام کا حکم دیا گیا تھا تاکہ اقلیتوں کے حقوق کے بہتر تحفظ کی ذمہ داری پوری کی جاسکے۔
2۔ اقلیتوں سے مراد ہے اسلام کے سوا کسی بھی دوسرے مذہب سے تعلق کھنے والے پاکستانی شہری ہیں۔
3۔ جن احباب کا خیال ہے کہ قادیانی"مرتد" یا "زندیق" ہیں، یہ ان کی راے ہوسکتی ہے، اور ممکن ہے کہ ان کی راے درست ہو (یا غلط ہو) لیکن کم از کم پاکستانی قانون کی رو سے ایسا نہیں ہے۔ پاکستان کے دستور کی رو سے قادیانی غیرمسلم ہیں۔ اس لیے وہ "اقلیت" کی تعریف پر پورا اترتے ہیں۔
4۔ اگر آپ میری ذاتی راے پوچھنا چاہتے ہیں تو میرے نزدیک پہلی نسل کے قادیانی، جو مسلمان سے قادیانی بنے تھے، وہ یقیناً مرتد تھے۔ البتہ ان کی دوسری یا تیسری نسل کو مرتد نہیں کہا جاسکتا۔ اسی طرح اگر کوئی مسیحی، یا ہندو، یا کوئی اور غیر مسلم، قادیانیت اختیار کرتا ہے، تو وہ مرتد نہیں ہوگا۔ ہاں، اگر اب کوئی مسلمان سے قادیانی بنے، تو وہ یقیناً مرتد کہلائے گا۔ البتہ یاد رکھیں کہ پاکستانی قانون میں اب تک ارتداد کی صرف ایک صورت پر سزا ہے: جب ارتداد توہینِ رسالت کی صورت میں ہو۔ ارتداد کی دیگر صورتوں پر پاکستانی قانون میں سزا نہیں ہے۔ ہاں، انگریزوں کے دور کے ایک قانون کی رو سے ارتداد کی صورت میں نکاح کے خاتمے کےلیے عدالت میں دعوی دائر کیا جاسکتا ہے۔
5۔ قادیانیوں کو اقلیتی کمیشن میں شامل کرنا ان کے "غیرمسلم" ہونے کا لازمی نتیجہ ہے۔ اس لیے مجھے اس پر اعتراض کی وجہ سمجھ میں نہیں آرہی۔
6۔ اگر یہ کہا جارہا ہے کہ وہ خود کو غیرمسلم نہیں مانتے، اس لیے وہ آئین کے باغی ہیں، تو ایک تو یہ محض جذباتی نعرہ ہے۔ اگر آپ انھیں واقعی آئین کے باغی مانتے ہیں تو ان پر آئین سے بغاوت کا مقدمہ درج کرائیں۔ یاد رکھیں کہ آئین سے بغاوت کی تعریف خود آئین میں موجود ہے اور جنرل مشرف کے خلاف فیصلے میں عدالت نے اس کی تفصیلی تشریح بھی کی ہے۔ اس فیصلے کی رو سے جنرل مشرف تو یقیناً آئین کا باغی ہے لیکن قادیانیوں کو آئین کا باغی نہیں قرار دیا جاسکتا۔ ہاں، اگر وہ خود کو غیر مسلم نہیں مان رہے، تو وہ آئین کی ایک شق کی خلاف ورزی ضرور کررہے ہیں اور اگر وہ عوامی سطح پر اس کا اظہار کرکے خود کو مسلمان بتائیں، یا مسلمانوں کی اصطلاحات استعمال کریں، تو اس پر تعزیرات پاکستان کے تحت قید اور جرمانے کی سزائیں موجود ہیں۔
7۔ یہ بات بھی اہم ہے کہ اگر قادیانی آئین کی اس شق کی خلاف ورزی کرتے ہوئے خود کو غیرمسلم ماننے سے انکاری ہیں، تو وہ اس کمیشن میں شامل ہی کیوں ہوں گے؟ اس صورت میں تو پریشانی کی کوئی بات ہی نہیں رہی۔ اس کے برعکس اگر وہ وہ اس کمیشن میں شامل ہوں، تو وہ خود کو غیرمسلم مان کر ہی شامل ہوسکتے ہیں۔ اس لحاظ سے تو یہ نہایت صائب فیصلہ ہوا۔
8۔ اگر یہ خدشہ ہے کہ اقلیتی کمیشن میں شامل ہو کر وہ اپنے رسوم وغیرہ کا تحفظ کرسکیں گے، تو ایک تو وہ ایسا بطور اقلیت، یعنی بطور غیرمسلم، ہی کریں گے۔ اس لیے پریشان ہونے کی بات نہیں ہے۔ دوسرے، وہ بطور غیرمسلم اپنے رسوم کرسکیں گے لیکن ان پر قانونی پابندی برقرار رہے گی کہ وہ خود کو مسلمان بنا کر نہ پیش کریں ورنہ مذکورہ بالا قانون کی رو سے ان کا یہ فعل قابلِ سزا جرم قرار پائے گا۔ چنانچہ ان کے رسوم وغیرہ کا تحفظ اس شرط کے ساتھ مشروط ہوگا۔
9۔ اگر کسی کو یہ خدشہ ہے کہ اس کے بعد وہ اس قانون کو اپنے حقوق سے متصادم قرار دے کر ختم کروانے کی کوشش کریں گے، تو ایک تو سپریم کورٹ کا لارجر بنچ ظہیر الدین کیس میں قرار دے چکا ہے کہ یہ قانون دستور میں مذہبی آزادی کے حق سے متصادم نہیں ہے اور یہ کہ جب تک دستور کی رو سے وہ غیرمسلم ہیں تو وہ خود کو مسلمان کے طور پر پیش نہیں کرسکتے کیونکہ یہ دھوکا ہے اور کوئی دستوری حق دھوکے کی اجازت نہیں دیتا۔ دوسرے، اس صورت میں ہم سب پر لازم ہوگا کہ ان کی اس کوشش کو ناکام بنائیں اور اس قانون کا تحفظ کریں۔
10۔ یہ ساری بحث اس وقت تک فرضی بحث ہے جب تک قادیانی اس کمیشن کی رکنیت قبول نہیں کرلیتے، اور ایسا کرنے کےلیے ان پر لازم ہوگا کہ وہ خود کو غیرمسلم مان لیں۔ اس لیے مجھے تو پریشانی کی کوئی وجہ معلوم نہیں ہورہی۔
