The recent verdict of the Judicial Commission (JC) and the release of Ayan Ali exhibit the low standard of our judiciary and corrupt politicians. Pakistan judicial system is under the influence of corrupt politicians like Nawaz Shareef. That's why any justice from the judiciary cannot be expected.
What is judicial independence and how much is it important for a country are the questions which we need to have a clear vision about. Is judiciary pillar of our country is independent and free from any influence and interference from the government in order to claim to be the champion of rule of law. Unfortunately, the answer is in No.
Constitutional theories require that the judiciary be separate from and independent of the government, in order to ensure the rule of law and to ensure that the law is enforced impartially and consistently no matter who is in power, and without undue influence from any other source. Mostly, the independence of the judiciary refers to becoming independent of the dictates of the government.
The doctrine of the "separation of powers" has traditionally proposed that the state is divided into the separate and distinct arms of Executive, Legislature and Judiciary, whereby each arm acts as a "check and balance" on the others. However, there should not be any interference in or any influence, whatsoever, on the judiciary.
Judges are expected to have sound sense and a feeling of self-respect. Judges who have no self-respect, create numerous gods for themselves. Jusice Iftikhar Chaudhry has proved himself to be dirty spot on judiciary. He has no sense of self respect. The worst part of the tragedy is that when such matters surface, they do not feel insulted; Chaudhry has hailed the flawed verdict of the Judicial commision as a milestone in the country's history.
Judges of an independent judiciary do not act in a manner that could result in their own insult. For the same reasons,* former chief justice Iftikhar Chaudhry and Justice (retd) Khalilur Rehman Ramday,* allegedly supervising rigging during the May 2013 general elections, are examples of a highly low standard of judiciary in Pakistan.
In Pakistan, neither the judiciary as an institution nor the individual judges are independent. The release of Ayyan Ali who was arrested in money laundering and recent judicial commision report on 2013 General Elections* are crude examples.
Our politicians, billionaires, are involved in the plundering of national assets whilst each child of the nation has been indebted.
The involvement of judges in any sort of corruption is more detrimental to the society due to betraying their own moral and professional obligations of providing justice in society.
