KARACHI: The Sindh High Court on Wednesday directed the National Accountability Bureau to investigate encroachments carried out by the Ziauddin hospital management on an amenity plot.


A two-judge bench headed by Justice Irfan Saadat Khan also ordered the NAB authorities to file a progress report in this regard within two months.


The court gave the directions while hearing a constitutional petition of civil right campaigner Rana Faizul Hassan, who died three months ago.


The petitioner, who was the secretary general of the United Human Rights Commission of Pakistan, had sought removal of encroachments allegedly made by the administration of the hospital owned by Dr Asim Hussain, a PPP leader and close aide to former president Asif Ali Zardari.


The bench noted that the plot in Block-14 of the North Nazimabad was allotted by the City District Government Karachi to the Hockey Association West (HAW) but it was hardly used as a playground.
The petitioner stated that the plot was being used for commercial activities such as parking and marriage hall.
He said that the matter was in knowledge of the authorities concerned but no action was taken against the people responsible for it.


The petitioner stated that the hospital management encroached upon plots originally allocated for parks in North Nazimabad and Sheerin Jinnah Colony areas of Karachi.
He said the plots allocated for parks and playgrounds were being used as the hospital car parking space but the authorities concerned had failed to perform their duties in removing the encroachments, the petitioner submitted.


He asked the court to direct the respondents to remove the encroachments allegedly made by the Ziauddin hospital management on amenity land and restore these to their original position.


The bench referred the matter to the chairman of the NAB for investigating whether the officials of the KMC, the HAW and the management of by the Ziauddin hospital were responsible for the commercial use of amenity plot.


It directed the NAB to complete the investigation within two months and file a comprehensive report with the court.
Death sentence upheld
A two-judge appellant bench of the SHC upheld the capital punishment awarded to two men in a murder case by the district and sessions court of Dadu.


The bench headed by Justice Naimatullah Phulpoto dismissed the appeals of Ali Bux Loond and Yousuf Loond against their conviction.


The two convicts were given death sentences on March 14 by the judge after they were found guilty of murdering Nasarullah Kangarani on May, 2013 in Johi.



NHA inspectors case
Another division bench dealing with services matters ordered the regularisation of services of five inspectors of the National Highway Authority.
Allowing the joint petition of Shaharyar Abro, Shakil Chandio and three other inspectors, the bench directed the authorities concerned to regularise their services within 90 days.
According to the petitioners, they were posted in the NHA in 2012 and their services were to be regularised within two months under the rules.
