An article was writteen by Umar Cheema on Imran khan BENAMI transaction with his wife Jemima Khan . . .
Well according to the article , the Defination of Benami is that :
transaction wherein a person buys a property in the name of another person or gratuitously transfers property to another person without any intention to benefit that other person.In a benami transaction the property is purchased not in the name of the real beneficiary, but someone who is his/her unofficial representative (benamidar). Many politicians and bureaucrats are understood to have purchased lands and kept accounts this way.
Now the basic purpose if doing Benami Transaction is of 2 things :
1) Assets Concealment
2) Tax Evasion
Now in the case of IK nothing of the above has been done :
1) first we talk about assets concealment . . IK bought the land as said by him from his wife Jemima khan money , in 2002 and was declared at its right price and was shown as on Jemima Khan name in his assets decleration of Imran khan of 2003 at 4 crores and 60 lacks , so the purpose of concealment of assets was never the issue . .
2) Now we talk about Tax evasion issue , If IK wanted to evade tax than he would have started from the begining i-e from the registry of the asset at a lower price but he didnt and it was being registered at the right price and the evidence was provided to the media in his press conference of IK and also Ansar Abbasi acknowledges this fact bcoz it was taken form his relative or friend . .
so if IK wanted to evade tax than the land would have stayed with JK and it wouldnt have returned to him after just 1.5 years . .
Now coming to a issue that IK wanted to hide the source of income and that is why he did a Benami transacton ,if the purpose was to hide source of income why did he declare it ??? didnt he knew that people will ask of his source of income ??? and above all he has always said that he has bought this land form Jemima khans money and returned her in 2003 after the amount of 700,000 pounds were transferred to IK through legal channel after the sales of his flat and the respective proceeds were also provided to the media. . and above all if we do agree that IK was hiding his source of income than IK could have bought this land again in 2003 after the respective amounts were recevied to him after his flat sales .. .
