US Congressman accuses Indian IT companies of abusing H-1B system

WASHINGTON: Indian firms, which account for the bulk of H1B visas, have "gamed" the system, an influential American lawmaker today alleged and insisted his legislation introduced in the Congress will help fix the existing flaws.


Congressman Darrell Issa, who recently introduced the legislation which calls for an increase in the salary of H-1B workers, insisted that his move would bring the best talents to the US and help fix the flaws in the existing H-1B system.




The Consolidated Appropriations Act came into effect under George W Bush. It reduced the annual H-1B cap to 65,000 and introduced a separate pool of 20,000 H-1B visas under the H-1B Advanced Degree Exemption for people having a US Master's degree. It introduced anti-fraud fees of $500.


The H-1B Visa Reforms Act came under President Barack Obama in the year 2013.


The Act aimed to cut down the inconsistencies in the H-1B visa programme with a focus to prevent misuse and fraud.

The Act doubled the H-1B fees to $4,000 for companies having more than 50 employees and with more than 50% of them being H-1B or L-1 visa employees.

"The president supports (the bill). I think we will have strong support in the Senate," he told a Washington audience at an event hosted by Atlantic Council at the Capitol Visitor Center.

He alleged that Indian companies have "gamed the system" and made the "best use of this flawed immigration system".

"You can't have 75% of a programme going to an Indian-owner, Indian operated, Indian employee visas and not say that this is distortion," Issa said, adding it's common sense to hire the best and not the other way around.


"It would be interesting that India would be concerned that a relatively simple change (in H-1B visas) that does not target India, somehow happens to be accommodation for India," he said.


"Today 75% of all H-1Bs are coming in about USD 60-65,000, which is pretty absurd considering these are high-skilled visas... If they were told to write USD 100,000 and you will get your H-1B, they will write that check," he said.



The lawmaker from California called for fixing the system and removing the country-based caps. He also said increasing the salary would raise the quality of people coming to the US.

"An auction system is not a bad way to go," he said.


"A graduate with a STEM degree from a US university is not going to take a job with USD 60,000 salary. And that's the reality," said the Congressman.


The H1B visa is a non-immigrant visa that allows American firms to employ foreign workers in occupations that require theoretical or technical expertise. The technology companies depend on it to hire tens of thousands of employees each year.

“Citizens of the Republic of India who are holders of normal passports with a six-month, or more, valid green card or visa issued by the United States of America shall be granted entry visas to the UAE from all ports for a period of 14 days, subject for a single renewal for the same period upon payment of applicable fees,” an official statement said.
According to latest figures, the UAE-India trade has grown to around $60 billion (Dh220 billion) per annum, making India the second largest trading partner of UAE. The UAE exports to India totalled $27 billion (Dh99 billion) while Indian exports to UAE totalled $33 billion (Dh121 billion).
India is investing about $70 billion (Dh257 billion) in the UAE through 45,000 Indian companies, while the UAE is investing $10 billion (Dh36 billion) in the Indian sectors of energy, metallurgical industry, services, technology and construction. A number of UAE companies invest and operate in India such as Abu Dhabi Investment Authority (ADIA), Abu Dhabi National Energy Company (ADNEC), Emaar, and Dubai Ports World (DPP), which currently operates in six major ports in India.
The number of Indian tourists coming to the UAE last year reached about 1.6 million Indian tourists, and there were about 50,000 UAE tourists who visited India in the same year. There are about 143 flights a day between the UAE and Indian cities, at a rate of 1000 flights per week.
Strong bonds of friendship between UAE and India have found clear expression in the series of high-level bilateral visits between the two countries in the past two years, The move of granting entry visas to the UAE aligns itself with the close cooperation between the two countries.
Deep historical ties between the UAE and India were further accelerated by the visit of Prime Minister Narendra Modi to the UAE in 2015, which was the first visit by an Indian Prime Minister after 34 years.
The UAE reciprocated with an official visit where His Highness Shaikh Mohammad Bin Zayed Al Nahyan, Crown Prince of Abu Dhabi and Deputy Supreme Commander of the UAE Armed Forces, met Modi in the Indian capital, New Delhi in February 2016 to discuss ways to strengthen the cooperation and friendship between the two countries.

:lol: ..Brother this is nothing. If you travel on etihad or emirates you can get a visit visa as part of the package too. Plus this is not for regular indians, this is for those heading to the US as they have no purpose of overstaying in Dubai. Its as simple as that. Wait a few months and Pakistanis with foreign visas will get the same facility.

BEIJING: In a setback to Indiantravellers, Hong Kong, a special administrative region of China, has withdrawn the visa-free facility for Indians and they will now have to complete a pre-arrival registration from January.

"The Pre-arrival Registration for Indian Nationals will be implemented on January 23, 2017. The online service for 'Pre-arrival Registration for Indian Nationals' is now opened," the Hong Kong immigration department said in an announcement on its official website.

Fraudulent student visa applications by Indian agents have increased dramatically, according to documents released by Immigration NZ (INZ).
The department cracked down on student visa fraud in May after it was discovered hundreds of students, primarily Indian students, were in New Zealand on visas obtained using fake documents.
Many are facing deportation, despite students claiming that they came here in good faith and were not aware that the agents they used were frauds.
Labour has documents obtained under the Official Information Act which show fraud has increased from 75 cases involving 60 agents in April to 640 cases and almost 300 agents by August.
New agents are springing up in India and others are rebranding themselves after their fraudulent applications were detected.
New types of fraud are emerging, including a "rent-an-uncle" scam which involves a pretence that students are being financed by family members.
Four of out five applications by the new agents are being rejected as more and more go into the "not to be trusted" basket.
Labour's Immigration spokesman, Iain Lees-Galloway, says INZ must increases its efforts, and said he wants it to publish the names of New Zealand education institutions that are using fraudulent agents.
Those names have been redacted from the INZ documents.
"If we knew the names of the providers I think it would change the behaviour of those providers very quickly," Mr Lees-Galloway said.

Yes brother, it is true, the question arises how does one "name & shame" these culprits in eyes of public domain ? To bring it to attention is very good and one thing in itself. But on whole larger level, to propagate the fraudulent activity to mass media is totally another thing. I wonder what or how it can be done by efforts of individuals ??

when a customer's call goes to any call center in endia... no matter how much they try to make ascent they cannot disguise the reality....

for example I was talking to one of those PARROTS..... and he had very good ascent so I was not sure if the call went to UK or endia... so I thought to test the PARROT.....

I asked for the spelling of a word which included letters like "M" and "H".....

almost 95% of endians will have the same ascent in pronouncing these letters...

They would pronounce letter "M" as "yum".... and "H" as "hatch"....
