Unfortunately you are not correct.
This reply was a personal reply between two people and nothing to do with the courts or law. ex-CJP hasn't started a court case yet so this is nothing but a normal letter.

ISLAMABAD: A para-wise analysis of Imran Khan’s written response to the libel notice by former chief justice (retd) Iftikhar Chaudhry shows that the Pakistan Tehrik-e-Insaf (PTI) chief has taken a double U (w) turn by giving a clean chit to the former chief justice on all rigging allegations and was just complaining that the PTI was not given immediate relief by the apex court after the election in 2013.
The response submitted by his lawyer Advocate Hamid Khan seems to confirm the assertion made by the chief justice in his notice that by making baseless allegations against him, Khan wanted to “extract revenge from the court for not granting relief in your petition in respect of four selected electoral constituencies.”
The PTI chief’s letter also missed two vital points raised in notice served by Justice Chaudhry on July 25. In his response, PTI chief paid rich tribute to the services of former chief justice and requested him not to go ahead with the defamation suit.
However in another big U-turn, Khan tweeted later on Monday that he stands by his allegations against chief justice. “I stand by all my statements on ex-CJ Iftikhar Chaudhry, the ROs, and all those involved in May 2013 electoral rigging.”
The written response filed by PTI chief’s lawyers says: “It was expected that judiciary would be vigilant to prevent injustice. It came as a shock to our client when, after the elections, he and his party meted out step motherly treatment at the hands of the judiciary. The party was pushed into the hands of inadequate and insecure election tribunals.”
The statement clearly shows that PTI chief was expected the Supreme Court to provide quick relief to party candidates and when the expectation were not fulfilled, Imran Khan got angry and frustrated and made controversial statements against the former chief justice.
However, Justice (R) Iftikhar Chaudhry had already clarified in his notice that under Article 225 of the Constitution, the Supreme Court or any other court has no jurisdiction over election dispute and only the election tribunals can decide such cases.
The response also expressed disappointment over objections raised by the Supreme Court on PTI’s application on 6th June for implementation of the judgment in Workers Party Pakistan vs Federation of Pakistan which was rendered to make the elections free, fair and transparent.
Although PTI chief claimed in his response that extensive rigging was committed during the course of May 11 elections, he refrained from levelling any allegation of rigging on the chief justice or the court. He went on to the extent of saying that chief justice was the architect of free and fair elections in Pakistan.
“The voters in Pakistan are grateful to you for issuing declarations, directions and observations which would make the elections free, fair and transparent. Had these declarations, directions and observations been implemented by the ECP, DROs and ROs and others in the electoral process,” says the letter.
It added that: “Our client has high respect and regard for the judiciary as an institution and would continue to do so in the future.
Imran Khan’s lawyers further said he did not mean to “abuse or disrespect any member of the judiciary”, and urged the former chief justice to “reconsider the idea of entering into personal litigation”.
However, it seems the Khan’s lawyer did not have the answer to para 8 and 22 of the notice sent by the chief justice.
Para 8 asked Imran why he did not raise any allegation against former chief justice in his white papers, electoral petitions or other documents and then suddenly came up with strong allegations of rigging against Justice Chaudhry.
In para 22 the former chief justice had claimed that PTI chief had been making calculated and measured speeches and press conferences with underlying mischief to harass him and his family members.

But really, on a serious note, it did make me wonder if he is the PM and made a statement like over some foreign policy issue and then backtracked it.. how embarrassing would that be!
