Defender Lawyer of Molana Burka Aziz comes in action again
ISLAMABAD: Justice Shaukat Aziz Siddiqui of the Islamabad High Court (IHC) here on Thursday issued notice to former president General (R) Pervez Musharraf in the writ petition of a former protocol officer of Benazir Bhutto who has been seeking from the court orders to register a second FIR against Pervez Musharraf and former DG IB Ejaz Shah for their alleged involvement in the suicide blast at Chief Justice Iftikhar Muhammad Chaudry’s reception at F-8 Kutcheri.
A suicide blast in July 2007 had killed 14 people injuring 45 others when the then deposed chief justice Iftikhar Muhammad Chaudhry was to address a reception at the district court premises at F-8. In the said suicide blast most of those killed belonged to PPP.
Later after registering FIR of the incident the law enforcement agencies had arrested six suspects who were later released by the Anti Terrorism Court (ATC) of Rawalpindi in June 2010 due to insufficient evidence.
Chaudhry Aslam, former protocol officer of Benazir Bhutto then filed an application before the Additional Sessions Judge of Islamabad seeking registration of second FIR in this matter against Musharraf and Ejaz Shah. The application was however dismissed and an appeal against the decision has been pending before the IHC for adjudication.
Legal counsel for the petitioner argued before the court that his client’s petition was dismissed as Pervez Musharraf was not inside the country and the notices could not have been served on him. Since Pervez Musharraf has been under the judicial custody at present at his farmhouse sub-jail, so the court could issue him notice and could direct him to submit reply.
The petitioner has alleged before the court that the nominated accused in his petition were perpetrators of the suicide attack and the former Punjab chief minister Chaudhry Pervaiz Elahi also cooperated with them.Issuing notices to Musharraf, the court put off hearing in the matter with date in office.
