Doctrine of Necessity is Alive and Well

Justice Munir should be removed from his grave and hanged till eternity for investing this concept. And all judges who used it in their judgements should be hanged with him.

basically the JC said that because the consequences of their judgement can have severe effects on individual and governments, they decided to ignore the standard of proof used in civil cases aka balance of probabilities. In other words inquiry commission became a debating club.
