But he is on a revengeful path, well he is retiring soon, what goes around, comes around, thats how nature works.Inshallah

کیا یہ آرٹیکل اسلام کے مطابق ہے؟
پاکستان ہی کے آئین کے مطابق کوئی ایسا قانون نہیں بنایا جا سکتا جو اسلامی قوانین کے منافی ہو۔ محض چیف جسٹس کی مخالفت میں اس آرٹیکل کی کسی بھی صورت میں تائید نہیں کی سکتی۔
خیبر پختون خوا کے اے این پی سے تعلق رکھنے والے سابق صوبائی وزیر تعلیم نے سبجکٹ سپیشلسٹ اُردو کی پوسٹ پر ایسا آدمی تعینات کیا جو اس پوسٹ کے لیے بنیادی اہلیت ہی نہیں رکھتا تھا یعنی وہ ایم اے اُردو ہی نہیں تھا۔ کیا عدالت کو یہ اختیار نہیں کہ وہ اس تعیناتی کو کالعدم قرار دے؟

The President, a Governor, the Prime Minister, a Federal Minister, a Minister of State, the Chief Minister and a Provincial Minister shall not he answerable to any court for the exercise of powers and performance of functions of their respective offices or for any act done or purported to be done in the exercise of those powers and performance of those functions: Provided that nothing in this clause shall be construed as restricting the right of any person to bring appropriate proceedings against the Federation or a Province. Also, this does not apply to criminal proceeding, except in President and Governer's case.​

are you not taking this as an all excluding clause e.g., a minister murders someone wouldn't the court have jurisdiction.In performing his functions that is the key still this article has been diluted to a great extent by decisions afterward.

No this article was included in the constitution to give state functionaries to avoid nuisance in performing there duties but the conduct of these persons can still be called into question as per legal precedence.
